Last Will and Testament of Mary Gibson

In the name of God Amen.

I, Mary Gibson wife of Henry Gibson being fully impressed that I have nearly run my race allotted for me in this world & must soon be laid in my mother earth---being of sound mind and disposing memory to make this my last Will & Testament.

I commend by Soul to God who gave it.

My name was Mary Coffee. I was married to Henry Gibson in Hancock County Georgia in 1807.

My portion or part of the property owned in common between my husband & myself I dispose as follows.

The debts must all be first paid--Should my husband survive me my will is that all of my property should remain under his control & possession & after his death to be distributed to my children & childrens children as follows.

To the children of my deceased daughter Euphronia M. Bayley six in number I give to each the sum of Five Dollars in money.

The residue of my estate I will & bequeath in equal portions to my children as follows--

To the children of my deceased daughter Cordelia A. Jones one share or portion.
To the children of my deceased son Felix F. Gibson one share or portion.
To John H. Gibson one share or portion.
To Ann E. Gibson one share or portion.
To Mary T. Gibson one share or portion.
To William Gibson one share or portion.
To Peter C. Gibson one share or portion.

I nominate my sons William Gibson & Peter C. Gibson my Executors and provide that no action be had upon this my last Will by the Probate Court, other than to Probate the same & file an Inventory of my estate.

Codicil to my last Will of Testament

Whereas heretofore I and my husband made a deed of gift to our daughter Ann E Gibson of some slaves and among the number was a man by [the name of] Edward--who since the date of said gift has departed this life. Now in order to supply the loss of said slave to my said daughter Anne E. I hereby bequeath & will to her my interest in a negro man slave called Austin. and in case my husband Henry Gibson does not make a like provision for her benefit --It is my Will & desire that she have said man slave Austin out of my Estate and for my said daughter Anne E. to inherit share & alike of the residue of my estate with my other children as set forth fully in my last & Will & Testament.

Done at Matagorda this 25th day February 1859.

Know all men that in consequence of the demise of my son Peter C. Gibson since the execution of this my last Will and Testament and dated the 19th December 1857 to whom I had bequeathed a portion of my Estate. It is now my wish and desire and I do hereby by this Instrument or Codicil to my said above mentioned Will give and bequeath to the following described persons in six equally divided shares & portions the property so bequeathed to my said Son Peter C. Gibson aforesaid.

One share or portion To the Children of my deceased Daughter Cordelia A. Jones.
One share or portion To the Children of my deceased Son Felix F. Gibson.
One share or portion To my Son John H. Gibson.

In County Court August Term A. D. 1859

Before me Matthew Talbot Chief Justice in and for said Matagorda County personally appeared in Open Court George Burkhart a resident Citizen of said County and to me personally well known and being by me duly sworn according to Law on Oath says that he was well acquainted with Mrs. Mary Gibson (wife of Henry Gibson) late of this City and County of Matagorda but now deceased. And deponent further on Oath says that he recognizes the document hereto annexed written on the first and second pages of the annexed sheet of paper dated this 19th day December 1857 and the body of which is wholly in the hand writing of Matthew Talbot and deponent further says that said instrument was signed by said Mary Gibson in his presence and in the presence of Samuel Boggess and Matthew Talbot as Witnesses; and deponent further says that said Mary Gibson signed said document in his presence and in the presence of said other Witnesses and then and there declared the same to be her last Will and testament and requested this deponent and said other Witnesses to sign the same as subscribing witnesses and deponent says that he together with said other witnesses then and there each subscribed their names to said document in the presence of said Mary Gibson and in the presence of each other and he says the Testators signature thereto is genuine, and deponent further on Oath says that he recognizes the document written on the third page of same sheet of paper purporting to be the Codicil to the foregoing last Will and testament the body of which is also wholly in the hand writing of Matthew Talbot bearing "this 25th day of February 1858" and hereto annexed. And deponent says that said Codicil was signed by said Mary Gibson in his presence and in the presence of Samuel Boggess and Matthew Talbot as subscribing witnesses; and deponent says that said Mary Gibson signed said document in his presence and in presence of said other witnesses and then and there declared the same to be her Codicil to her last will and testament and requested this deponent and said other witnesses to sign the same as a subscribing witness and deponent says that he together with said other witnesses then and there subscribed their names to said document in the presence of the said Mary Gibson and in presence of each other and he says that the testatrix signature thereto is genuine and deponent further says that the said testatrix at the time of executing said last will and testament and at the time of Executing said Codicil was of sound and disposing mind and memory. Deponent further says that the said Mary Gibson departed this life several months since in said county.

Before me Matthew Talbot Chief Justice in and for said Matagorda County personally appeared in open Court Mrs. Mary Ann Hefford a resident citizen of said County and to me personally well known and being by me duly sworn according to law on Oath says that she was well acquainted  with Mrs. Mary Gibson (wife of Henry Gibson) late of the city and County of Matagorda but now deceased.

And deponent further on Oath says that she recognizes the document hereto annexed written on the fourth page of the annex sheet of paper dated this 12th day of August in the year 1858 and the body of which is wholly in the hand writing of Joseph T. Hefford. And deponent further says that said instrument was signed by said Mary Gibson in her presence and in the presence of Conrad Franz & Joseph T. Hefford as witnesses.

And deponent further says that said Mary Gibson signed said document in her presence and in the presence of said other witnesses and then and there declared the same to be a Codicil to her last Will and testament and requested this deponent to sign the same as a subscribing witness. And deponent says that she together with said other witnesses then and there each subscribed their names to said document in the presence of the said Mary Gibson and in the presence of the said Mary Gibson and in the presence of each other and she says the testator's signature thereto is genuine.

Last Will and Testament of Henry Gibson

In the name of God Amen

I, Henry Gibson, of the County of Matagorda in the State of Texas, being of sound mind and disposing memory and having in mind the uncertainties of life and the certainty of death, do make this my last will and testament.

Firstly, It is my desire that all my just debts be paid by my executor.

Secondly, I do specially give and bequeath unto my daughter, Annie E. Gibson on negro boy named Guy aged about sixteen years, he being the son of Betty and Davy; and inasmuch as the property in the said Negro boy Guy is held in common between myself and my deceased wife, it is my will that the whole value thereof be accounted for by my executors in favor of the said community out of my share of the estate.

Thirdly, I do give and bequeath to my son William A. Gibson my old and faithful servant Davy.

Fourthly, I do give and bequeath to the children of my deceased daughter Euphrasia M. Bayley, to wit Eliza D. Bayley married to John Duke, Joshua H. Bayley, Thomas S. Bayley, George H. Bayley, Mary Cornelia Bayley and Ann Augusta Bayley, married to West Gayre the sum of five dollars each. The reason of this bequest is this, that heretofore at sundry times, advances have been made by me to my daughter Euphrasia M. Bayley sufficient to make their share of the property fully equal to the amount that I am now enabled to bequeath to each of my other children and in justice to them, (my other children) I can make no further advances or bequests to the children of my said daughter Euphrasia M. Bayley deceased.

Fifthly, I do give and bequeath all the residue of my property, real, personal and mixed, which I do now hold  or may die seized of, as follows, To wit: To the children of my deceased son Felix F. Gibson one share; to the children of my deceased daughter Cornelia N. Jones one share; to my son William A. Gibson, one share; to my son John H. Gibson one share; to my daughter Mary T. Conway, one share; to my daughter Annie E. Gibson one share. And further it is my will and desire that no farther action be taken by the probate court on this my last will and testament, other that the probating thereof and returning of an inventory of the property as required by law. And I do hereby appoint my two sons John H. Gibson and William A. Gibson my executors to carry into effect all the provisions herein contained of this my last will and testament.

Last Will and Testament of Felix F. Gibson

State of Texas
County of Matagorda

In the name of God. Amen

I, Felix F. Gibson being this day of sound mind and knowing the uncertainty of life anxious to dispose of and settle all my worldly affairs before my death, do make and publish this my last Will and Testament.

First. I desire the prompt payment of all my debts which shall not have been settled prior to my death.

Secondly. My dear Wife Margaret being otherwise provided for I give and bequeath all my property real and personal in equal shares unto my children which have been and may be born unto me of my wife Margaret during my lifetime and in proper time thereafter, at present five to wit. William Henry, Mary Coffee, Felix Francis, James Irvin and Mark Tucker. In exception I make two special gifts to wit. I give unto my Son William after my death in case it shall not have been previously disposed of my well known Rifle, and unto by Daughter Mary, subject to the same provisions my well known watch. Time piece.

Now in order to the carrying out of the intent of this my last Will and Testament without any interference by the Courts of this or any other State except the Probating of the same. I do now and forever make, constitute and appoint my wife Margaret Maria my sole executrix to have, manage sell change or otherwise dispose of all or any of my effects during such time as she shall survive me in her single or widowhood state, up to the time one of my children shall have attained the age of majority in which case I desire a valuation of all my effects made, and the portion belonging to such child if he or she shall desire it set apart and delivered over unto his or her control, and in case of my wife Margaret shall not marry I desire such valuation and division made as each several child shall attain the age of majority or marry and in case my wife Margaret shall marry previously to the same I desire a division of my estate, and all my property and estate valued and set apart for the use of my children and to be managed by her, but no longer subject to sole or disposition until one or all attain the age of majority as before provided. And I here name my brother John C. Gibson as agent and adviser of my said wife in said management without any right of dictation or control. Now in case of the death or disability of my said wife, I do hereby make constitute and appoint in her place and stead in these premises my Brother John H. Gibson reserving from him only the right to sell or dispose of any of my effects without a hearing and determining before the proper court in such matters. And in case of the death or disability of my brother John, I do hereby make constitute and appoint in his place and stead in these premises, my friend Alexander Rugeley subject to the same condition and reservation, as above mentioned in the case of my Brother John. And if not previously disposed of, I desire my Plantation on Caney continued and managed for the support and education of my children & any surplus increase from that or any other of my effects invested in property or security with interest until time of division and all expenses and costs which shall arise to him, or grow out of said management. I hereby authorize him to deduct out of my effects, or the increase thereof. And now I do pronounce this to be my Last Will and Testament and I hereby revoke each and every Will by me at any time heretofore made.

Codicil to My Last Will

I hereby revoke that part of this my last Will & Testament wherein I have nominated any other person than my wife as Executor--Leaving her & no other as my sole Executrix--Bur requiring her to make an annual exhibit of receipts and disbursements to the Probate Court as is required by law.

Personally appeared this day in open Court before me Matthew Talbot chief justice in and for said County, William Hillard a resident citizen of the town of Matagorda in said county and who being by me first duly sworn according to law, deposeth and saith that the foregoing and annexed instrument of writing dated this ___ day of ___ A. D. one thousand eight hundred and fifty two purporting to be the last will and testament of F. F. Gibson deceased late of said County and signed by said Gibson and witnessed by W. Hillard, S. B. Bingham and J. W. Lilly was read over to the said F. F. Gibson in presence of this deponent and of the other witnesses thereto, and that the said instrument was exhibited by said testator to this deponent and said witnesses as his last will and testament and that the said F. F. Gibson thereupon understandingly immediately signed and executed said instrument and declared the same to be his last will and testament and requested this deponent together with said other persons to sign the said Will as witnesses thereto, and that the said testator signed said last will and testament at the time of such declaration in presence of this deponent and the other witnesses and that deponent and the other persons named signed the same as witnesses then and there, at the request and in presence of said testator and in presence of each other. And deponent further says that said F. F. Gibson died in said town on the ___ day of ___ A. D. 1857.

Personally appeared this day in open court before me Matthew Talbot chief justice in and for said County George Burkhart a resident citizen of the Town of Matagorda County aforesaid and who being by me first duly sworn according to law deposeth and saith that the foregoing and annexed instrument of writing purporting to be a Codicil to the last Will and testament of F. F. Gibson decd and written on the same sheet of paper on third page at the foot with said Will and dated the 15th day of August 1857 signed by said Gibson and witnessed by George Burkhart and Peter C. Gibson and the testator acknowledged to them deponent and witness that the codicil was read over to the said testator and that he knew the contents and that the said Codicil was exhibited by said Testator as the last and only codicil to his last Will and testament and that the said F. F. Gibson thereupon understanding by immediately signed and executed said instrument and declared the same to be his last and only Codicil to his last Will and testament and requested this deponent together with said Peter G. Gibson to sign said Codicil as Witness thereto, and that the said testator signed said Codicil at the time of such declaration and in presence of this deponent and the other witness named and that said deponent and said witness signed the same as witnesses, then and there at the request and in presence of said testator and in presence of each other.

And deponent further says that the said F. F. Gibson died in the town of Matagorda on or about the ___ day of ___ A. D. 1857.

After Felix died in 1858, Margaret was left with six children, the oldest being William Henry. She wrote a letter trying to get William transferred to a company that was staying in Texas, but was unsuccessful. Following is an abstract of his service record including his mother's letter trying to keep him near home.

William Henry Gibson's cousin, Henry Gibson, son of John H. Gibson (brother of Felix F. Gibson, Sr.), would join Captain E. S. Rugeley's ill-fated company on December 31, 1863 and drown in the norther at age c17.

Sir, I am a widow my only help is engage in the defence of his country, and as times are I would not have him elsewhere and only wish I had others to accompany him. My son had joined Terry’s Reg. and was within two days of leaveing home when a heavy affliction was sent upon us, he then told me he would not leave the state as I had none to protect but would join Capt. Pearesons Company for Coast defence for the war. Cap Peareson went to Austin expressly to see the Gen and adjt. Gen for what service they were called out, both assured him it was for Coast defence they also assured him that they should not be ordered East of Galveston

13. or west of Victoria. In accordance with this Capt Pearson ___ hand bills to be struck off notifying the members of the Company, that such was the case, under these circumstances my son joined Capt. Pearsons Company and now as they are ordered off I beg of you Gen Hebert to transfer him to his original Reg. Terrys. Last summer my son was thrown from his horse & bracked his leg bone – since which time he has not been able to do much walking without giving much pain as well as having the limb to swell – and if he goes with Capt Pearesons Company he will hundreds of miles to march which I know he could not stand it 25 miles. I have stated the case to you please act on it immediately. Let me hear from you by Wednesday as I expect to visit by son on Thursday. May complying with my request a Mothers Blessing will accompany you as also her dailey prayer.

Administrator's Notice

ON the 26th day of July, 1858, the undersigned was appointed by the Honorable County Court of Matagorda County, Administrator of the Estate of Peter C. Gibson, deceased.

Notice is hereby given to all persons having claims against said Estate to present the same as required by law.
