#13 John F. Martin Estate by O. H. P. Hill acting admin.
This day comes on to be heard the petition of O. H. P. and Carolina Hill his
wife formerly Carolina Martin and widow of the said John F. Martin dec'd
praying a partition of a half League of land lying in Grimes County the
headright of Tandy H. Walker and of the Homestead two hundred acres in _____
___ Jacks headright grants of a League between the said Carolina Hill and the
minor heirs of said dec'd to wit: William A, Winston T., John F., and Margaret
O. Martin. Whereupon it is ordered that the prayer of petitioners be granted
and that Henry Fanthrop, S. W. Cautham, A. Buffinton, John Graves, and William
Patrick and _____ ______ by appointed commissioners to partition said land
setting apart one half in value thereof to the said Carolina Hill and the other
half to the minor Heirs aforesaid.
Furthur ordered that James Lawrence, Esq be and is hereby appointed Guardian ad litem to represent the minor heirs in said division.

This day came on to be heard and determined the petition of D. P. Hadley
praying for a partition and distribution of the negro property belonging to the
Estate of Obedience Hadley deceased. Whereupon it was ordered and decreed by
the court that James Scott, James Bennett, M. T. Kennard, S. S. Mooring, and
Reuben W. Bennett be appointed commissioners to partition the negro property
belonging to said estate equitably among the following named Heirs to wit:

This came said adminstration O. H. P. Hill and presented their final account
with said Estate and vouchers with the same and a petition pray of discharge
whereupon With? was examined approved and allowed by the court and said account
ordered to be recorded. Furthur ordered that the clerk of this court be and he
is hereby required to give the legal notice of said application for discharge.
Furthur ordered that J. W. Barnes, John Graves, William Patrick, R. W. Bennett,
and G. B. Black be and are hereby appointed to set apart to the said Carolina
Hill (formerly Carolina Martin and widow of said dec'd) all the property to
which she is entitled. Except the negro property. Say one half of the common
property said one third lifes Estate in the separate lands and allow her the
sum of one thousand three hundred and seventy 50/100 ($1370.50) Dollars out of
the common property being the amount due her on final settlement of said
estate. Furthur ordered that W. F. Case be appointed Guardian ad litian to
represent minor heirs for same Estate in said Partition.

This day came to be heard the petition of O. H. P. Hill praying that he be
appointed Guardian of the persons and Estates of the minor heirs of John F.
Martin dec'd and the Court being satisfied that the Legal Notice of said
petitioner has been given and no person appearing and contesting the same It
was ordered and decreed by the Court that the prayer of the Petitioner be
granted and the said O. H. P. Hill be appointed guardian of the persons and
estates of William A. Martin, Winston T., John F., and Margaret O. Martin minor
heirs of John F. Martin dec'd by his giving the bond and making the oath
required by law.

This day this case came on to be heard for receipt of the distribution in
partition and the adminstrator failing to appear and present the same to court
and it appearing to the satisfaction of the court that there is no legal
guardian for the minor heirs to said estate authorized to receive and receipt
for the property belonging to said minors.
It is therefore ordered that this case be continued and the adminstration allowed until the next Term of this Court to obtain and file said receipts.

This day came O. H. P. Hill in pursuance of an order of the court made and
extend on the first day of this term of court and entered into bond as Guardian
of the minors and testates of the Minor heirs of said John F. Martin in the sum
of Thirty Thousand Dollars With J. W. Barnes and J. F. Terrell as sureties.
Which bond was approved by the court and the said Hill took and subscribed the
oath required by law as such Guardian and Therefore decreed by the Court that
letters of guardianship issued to the said O. H. P. Hill upon the foresaid
estate of William A. Martin, Winston T., John F., and Margaret O. Martin minor
heirs of the said John F. Martin. Whereupon the corresponding letters.
Furthur ordered that J. W. Barnes, John Graves and William Patrick be and are hereby appointed appraisers to appraise the property belonging to said minors and make report of their acts as such within time prescribed by law.

This day the receipts of the distributions of said estate was presented to the
court and filed. Whereafter it was ordered that the adminstratrix upon said
estate finally and fully discharged as order made and entered in the last term
of this court in the matter of petition for final discharge of said

that said adminstration be closed and that he be discharged from the same whereupon it was ordered by the court that said final statement be filed & recorded the same being sworn to and the ____ of said application for discharge be given.

This day came on to be heard and determined the petition of said D. P. Hadley
praying for final discharge from and administration. Representing to the court
that all the property belonging to said estate has been distributed and placed
in the possession of the several distributees of said Estate. Whereupon it was
ordered & decreed by the Court that the said D. P. Hadley be finally and
fully discharged from the administration aforesaid upon his filling receipts of
said distribution for their respective shares of said estate in this court and
furthur upon the payment of all costs and court fees incurred by said
adminstration and distribution.
Furthur ordered that John R. Kennard be allowed the sum of ten dollars for his services attorney and the furthur sum of ten dollars for services as guard ad Letin of H. F. Hadley and the sum of ten dollars for same service rendered G. H. Hadley in the partition of said estate.

distributions of said Estate for their respective portions of the same. Where
upon it was ordered that said receipts be recorded and the administrator
finally and fully discharged from said administration after paying all costs

Petition of A. Lacy for Title to Land.
On this first day of the term comes on to be heard and considered the
application of Alexander Lacy praying title from the adminstrator of the Estate
of Joshua Hadley to one third of Eleven hundred and seven acres of land deeded
to said estate by Edd McCown Executor of the last wife of James McCown dec'd
Claimed by said Lacy under oath for services rendered in locating and securing
patent for same, and the court having satisfied from the evidence exhibited of
the justship of the said claim the administratix interparting no objection it
is therefore considered ordered and decreed by the court that Joyce V. McGuffin
admtrx of said Estate make a deed and convey to the said Alexder Lacy Three
Hundred and Sixty nine acres of said tract of land, so deeded as if ____ said,
having due required to quality.

said dec'd for the year 1854. Authorization is give to hire Lewis for year
1854. Further ordered that the contract made of said administrator with John C.
Edward as to rent of the term be and is herey approved [shortened].

This day came on to be heard and acted upon the petition of Alex. Lacy praying
the appointment of Commissioners to partition and divide Eleven hundred and
seven acres of land Deeded to said estate by the executors of James McCowan
dec'd lying in Kaufman County as per decree of this court made and entered at
the last November term thereof. Where upon it is considered by the Court
adjudged and decreed that Wm. Reed, James McCarty and Adam Sullivan be and are
hereby appointed Commissioners to partition and divide Eleven Hundred and Seven
acres of Land laying in Kaufman County said deeded to estate of Joshua Hadley Dec'd
by the executors of James McCowan dec'd in two Equitable shares of the
following property to wit setting apart one equitable third of said tract to
Alexander Lacy and remaining two thirds to the heirs of Joshua Hadley dec'd
making Plat and field notes of each share.

This day comes on to be heard the petition of Denny P. Hadley praying that he
be discharged from his trust of guardian of this person and property of the
said Henry F. Hadley and the said guardian having presented to the court his
final account & exhibit of the condition of the said Ward estate and the
same being sworn to as correct was examined with accompanying vouchers allowed
and ordered to be recorded. And it the Court being satisfied that the said
Henry F. had arrived at the age of twenty one years and he the said Henry F.
appearing in open court and acknowledging the receipt and possession of all his
property from his said guardian. It was considered by the court ordered and
decreed that said guardian be fully and finally discharged from his bond as the
guardian of his said Ward the said Henry F. Hadley upon the payment of $22.44
the balance in cash due said Ward and the court fees therein extended.

This day Commissioners Wm. Rayl?, Lat.? McCurley & Adam Sullivan appointed
to partition and divide a tract of land in the County of Kaufman between the
Heirs of said Hadley and A. Lacey presented to the court their report of said
division which is examined and approved by the court. And further decreed that
the admx is hereby ordered to execute the corresponding letters to said A. Lacy.

This day came on this case to be heard when Joice V. McGuffin, Mary E.
McGuffin, and James Floyd personally appeared in open court as witnesses and proved
the noncupative will of David B. Floyd deceased, which will being submitted to
writing was sworn to by said witnesses so required by law - and admitted to
probate and ordered to be recorded. Further ordered that E. Floyd be appointed
administrator with the will annexed of said estate, the legal notice having
been given and the said Mother of dec'd Joice V. McGuffin having in open court
waived her legal right to the same whereupon appeared the said E. Floyd and
gave bond in the sum of six thousand dollars with H. H. Boggess and W. J.
Chandler as securities. Bond approved and ordered to record, and letter to
issue, where upon corresponding letters issued.

This day the admx returned a account of the sale of 300 acres of land, said
sale made in conformity of a decree of this court, for the education of Joshua
Hadley, a deaf - mute minor of said dec'd, and she having qualified to the same
and the court being satisfied that said land had sold for a fair valuation, it
being appraised at $2.00 and having sold for $2.15 cents per acre and being
furthur satisfied that the sale was conducted with the requirements of the law,
Be it therefore re____ and decreed & ordered to the said adminstrators
ordered to make title to H. Brigance, the purchaser, he complying with the
requirements of the law as much and provided no such cases by Commissioners
appointed by this court which report is hereby approved and ordered recorded.

The Court proceeded to examine Said account amount with vouchers and being
satisfied with the sums same ordered that be approved and confirmed and
recorded. Furthur ordered that the Adminstratrix be and she is hereby fully and
finally discharged from her bond.

This day this case came to be heard where upon the petition of the Executor
filed at a former term of this court, it is ordered and decreed that Executor
be authorized and required to sell the Hayes? Land Certificate belonging to said
decedent, in connection with the estate of his dec'd father, and also the
cattle belonging to said estate of D. B. Floyd dec'd ____ credit of twelve
months giving the legal notice thereof and sells the same at the late residence
of said decedent. Furthur ordered that at the same time and same place he and
authorized & required to sell the cotton belonging to said estate for cash
giving notice in like manner and complying in all respects with the law -
regulating such sales. Court adjourned till 9AM Wednesday morning March 28th.

Petition to Probate Will #108. This day came on to be heard and acted upon the
petition of Elisha Floyd praying that he be permitted to have the last Will
& testament of Joice V. McGuffin probated, and it appearing to the
satisfaction of the court that the legal notice of said application had been
given and no person appearing to contest the same it was considered, ordered
and decreed by the court that the prayer of the petitioner be granted and said
will probated. Whereupon came & personally appeared in open court W. E.
Kennard one of the subscribing witnesses to said Will and took and subscribed
to the oath as necessary, and required by law to from the same. Where upon it
was ordered that said Will be recorded by the Clerk. Furthured ordered that
Letters of Executorship issued to said Floyd and took & subscribed to oath
of office and corresponding letters were issued the will exempting him from
bond. Furthur ordered that M. L. Kennard, John P. Roan, and J. W. Jenkins be
and they are hereby appointed appraisers of said estate and required with the
assistence of the executor to make a complete list and inventory of all the
property belonging to the same, and make appraisement thereof and return to
this Court in Sixty Days.

necessary bond and taking the oath of office. Where upon appeared the said E.
Floyd and entered into bond in the sum of six thousand dollars with O. H. P.
Hill and D. P. Hadley as sureties which bond was approved by the court, and
ordered to be recorded and letters issued.

partitioned as prayed for to James V. Floyd be set apart three fourthes
interest in said negro woman, and to Joshua Hadley the remaining one fourth

Upon the petition of O. H. P. Hill et al, in which all of the heirs join as are
represented by their legal guardians to wit Carolina Hill, Grantham H. Hadley,
Denny P. Hadley, Henry F. Hadley, Joshua H. Hadley, William B. Hadley, and
Anthony D. K. Hadley praying a partition and distribution of the estate of
Joshua Hadley dec'd in accordance with the division of the will of said dec'd
(the widow of said deceased having died) It is ordered that said petition be
filed and recorded by clerk. It is further ordered and decreed that said
partition and distribution be made as prayed for in said petition. Further
ordered and decreed that James Bennett, R. W. Bennett, J. W. Jenkins, S. M.
Garban and Jno. P. Roan be and they are hereby appointed commissioners of
partition and required to partition the whole of the estate contained in the
inventory to which reference is here made in the following manner. Viz.
First discharging the debt of
$546.45 due Joyce V. McGuffin on her final settlement as admx of said estate,

Then set apart out of the general
estate the sum of $177.20 1/3 to the minor Joshua H. Hadley - and the further
sum to each Joshua H. Hadley and William B. Hadley and Anthony D. K. Hadley
$562.50 for their support and education, and to Joshua Hadley set apart the
notes of H. Brigance for $645.00 in part payment of his allowance, then add the
$177.20 1/3 to the $562.50 allowed, will leave the sum of $94.70 to be paid him
out of the estate before distribution - Then charge the heirs with the
following advances made them by the Testator, as follows, as per original
inventory & appraisement To Wit: D. P. Hadley in land, the sum of $500.00

R. A. Whiting be & is hereby appointed ad litem to represent the minor heirs in said petition and distribution.

This day the Commissioners of partition made their report in writing & they
have qualified to the same, & it having the written approval of the

litium be allowed five dollars per day for eight day services. Further ordered
that the parties who are oweing the other heirs be allowed twelve months to
make payment by giving notes with legal interest, if required. Further ordered
that each one of the heirs and distributees pay equal portions of expenses
incured in the partition of said estate.

administratrix be discharged on filing the receipts of the distrubutees - It is
further ordered upon the petition of the administratrix that a partition and
distribution of the negro property belonging to said estate be had & the

as rendered in said Final Exhibit. Further ordered that Isaac Parks, J. M.
Baines, J. W. Terrell, William Patrick, and John H. Owen be & they are
hereby appointed commissioners of partition and distribution and required to
divide and partition said estate among the heirs - dependents before named and
in manner and form of the foregoing decrees of this court & report their
actions to this court within sixty days. Further ordered that E. B. Roble? be
appointed guardian ad Litem to represent the minors in said partition.

Carolina Hill vs. Joshua Hadley heirs.
This day Carolina Hill one of the heirs of Joshua Hadley dec'd filed her
remmitance to the report of the commisioners of distribution and praying the
court to set aside and annul the same - On examining the pleas set up by the
party complaining, the court is of the opinion that the commissioners erred in
this, in going outside of the estate to make their distribution, neither they
nor this court have the power to compel an heir (without their consent) to pay
the others a sum of money out of their own private means, and in this case the
court is of the opinion that this error might have been avoided, at least the ?
Need not have been so great as to cause complaint or prove offensive to any,
and the companant in this case having been condammed? to pay $505.14 3/4. It is
adjudged and decreed by the court that said distribution and report be set
aside and declared null & void -
Further ordered that the decrees of approval and confirmation made on the first
day of the present term of this court be and the same is hereby revoked,
Further ordered that the same commisioners who were appointed at the Oct term
of this court be and they are hereby reappointed & are required to act in
conformity with the decree of notification formerly made in said estate, and
under the writ of that court then opinion -

they having qualified to the same and said report having the written approval

the minor heirs of said decedent for the property allotted to them, and the
court being satisfied that all of said estate has been distributed, she is hereby
fully and finally discharged from said administration.
