Deputy Sheriff Lee D. Burgess had just arrested Percy Yeager who was very drunk. He was taking Yeager to put him in jail in Denison, Texas. On the way to the jail they walked past Yeager's house and Yeager tried to go home.

While stopping Deputy Burgess had to fight Yeager, and knock Yeager down with his "billy club." Deputy Burgess then leaned over Yeager and he fell over and died from a heart attack.
Percy Yeager was not charged.
