August 5, 1897 AS TO THE TOM BEAN ESTATE There is a New Claimant and Another Spirited Contest May Be the Result Mrs. Marmaduke the Applicant Sherman, Tex., Aug 4 - It looks as if another spirited contest will be made in the celebrated Tom Bean estate matter. The applicant will be Mrs. Amanda Marmaduke, No. 1603 North Blair avenue, St. Louis, who writes to her friend, Mrs. William Kortabin of this city a letter in which she incloses an affidavit which may prove important. The affidavit is as follows: "Washington, Ind., July 17, 1897 - To whom it may concern: This is to certify that I have known Mr. Henry H. Feagan, also his daughter, Mrs. Lena Bean, and his granddaughter, Amanda Bean, since 1840 or 1841, when she came from Kentucky to Davies county, Inc. I have almost daily known Mr. Feagan and Mrs. Bean until their deaths. Amanda Bean I have known since a little child up until some fifteen years ago, when she and her husband, Mr. S.D. Marmaduke, moved away from here, about the year 1845 or 1846. Mr. Thomas Bean came to Mr. Feagan's farm, which was close to our farm, on his way to Texas, and wanted to take his daughter, who was then 5 or 6 years old, with him. Mr. Feagan would not let his daughter, Mrs. Bean, nor his granddaughter, go with him, so within a week or ten days old Mr. Feagan took his rifle and drove Bean away from the farm and made him leave a small spotted horse which he had rode from Kentucky. Mrs. Bean afterwards sold the horse. Mr. Bean was a small, dark complexioned man. I think a Canadian Frenchman. I have time and again heard old man Feagan tell his daughter and granddaughter not to worry about his driving Bean away; that when he died they would be all right. Some time, I think about 1855 or 1856, Mrs. Bean received a letter which was mailed from some place in Texas begging her to send him his daughter so he could educate and care for her, but she, Mrs. Bean, would not consent to do so. All the above, with many other things, I well remember. I.V. STEPHENSON." Steps are being taken to prosecute the claim. Dallas Morning News October 2, 1897 News of the Courts Sherman, Tex., Oct. 1 - In the county court today the case of W.B. Yeager vs. H.P. Howard, administrator of the Tom Bean estate, was decided in favor of the defendant. It appears that in 1874 the plaintiff purchased a tract of land from Tom Bean in Collin county. Today in court he alleged that there was a shortage of eleven and three-quarter acres in the tract he holds from the amount the deed purported to transfer. The judgment was on the ground of the case being barred by limitation, as twenty-three years was a long time to hold property and just discover such a shortage in it.
