FILES SUIT FOR ALLEGED DAMAGES ACCOUNT ROAD
Commissioner, Engineer and Citizens Committee Named as
Defendants.
Suit for $850 alleged damages to a tract of land on the Wilson survey in the
southwestern part of Falls county in connection with building of a road in that
section has been filed by W. F. Barclay against Henry King, commissioner of
precinct No. 3, Van Harris, highway engineer, and Powell Tyson, Ben Winkelmann,
Louie Becker, Fred Frerichs and I. B. Wunsch, set forth as members of a citizens
committee.
Plaintiff avers that he has 200 acres of land bounded on the south by a 30-foot
road and that in an attempt to widen the road so it would be not less than 60
feet wide, a strip of land not less than 15 feet wide was plowed up across the
entire south side of the tract and a ditch approximately 2 1-2 feet deep and
1452 varas long was cut through his property, while further excavations were
made at the southwest corner.
It is set forth that it will cost $750 to restore the land to its previous
condition while an additional $100 is asked for cotton which it is claimed could
have been produced on it this year.
The defendants have not filed an answer in the case, but from other sources it
is indicated that the work was done in the belief there had been an
understanding with the owner.
