AGREED JUDGMENT ENDS
SUIT IN DISTRICT COURT
Decree Recites Death of One Plaintiff
and Dismissal of Two
Defendants.
Agreed judgment of $7,500 for F. M. Pucek against the Central Texas Refining Co.
and R. L. Wheel(missing)ock, as its receiver, and reciting sam(e) has already
been paid, entered (missing) Falls county district court Thursday afternoon
ended a damage suit which has been on trial all week.
The case was outgrowth of a (col)lision on
state highway No. (missing) Christmas eve last near Lott bet(ween) a car and a
truck in which (missing) Pucek was killed and her daughte(r,) Christine, was
fatally injured.
Taking of testimony had been completed,
both sides had rested and arguments were slated when the agreement was
announced.
The decree recited that one of the
plaintiffs, Mrs. Rhoda Thames(,) mother of Mrs. Pucek, had died since (missing)
institution for the suit and that "h(er) heirs are not entitled to recover a(ny)
thing."
The decree also recited dismiss(missing) of
the defendants, Texas Pacific Coal & Oil Co., Southern Surety Co. and D. Currey,
driver of the truck.
