A Landlord and Tenant Case.

The King-McCreary case, involving the landlord and tenant proposition, forcible
entry and detainer, and sequestration and replevin procedures, took a new turn
Wednesday afternoon. The plaintiffs, Chas. H. and Geo. King resorted to
the sequestration method of regaining control of the premises in controversy,
the apartment in the king building occupied for some time by Mr. McCreary as a
chile restaurant.
The defendant's contention was sustained in
the justice court, followed by a physical disagreement between the court and
attorney for plaintiff.
Plaintiff's attorney next applied to
district court for the writ of sequestration, filed a $40,000 bond and the
sheriff took charge of the property and the restaurant was closed. If the
defendant desires to contest the case further, he will give a replevin bond in
equal amount to the sequestration bond and ask for a trial on the merits of the
case.
