JUDGEMENT FOR PLAINTIFFS.

FARMERS AWARDED DAMAGES FOR
OVERFLOWED LANDS.

The long pending damage cases, consolidated, styled T. H. Drennan et al vs. the
H. & T. C. railway company, was disposed of in the district court here Thursday,
the jury bringing in a verdict for $2000.00 damage to the plaintiffs.
The cases were filed about a year ago and the action
was to recover damages against the road for injury done to plaintiff's crops and
lands by the overflows of 1902 and 1903.
The cases were consolidated. Henry S. Moorehead of
Bremond and Rice and Bartlett of Marlin represented the plaintiffs and Frank
Andrews of Houston and J. A. Martin of Marlin represented the defendant railway
company. The issues of the case were stubbornly contested by both sides and the
hearing of the evidence consumed seven days time.
At the conclusion of plaintiff's introductory argument,
delivered by Attorney Morehead, the defendant attorneys announced that they
would submit their case without any argument. This had the effect of dispensing
with further argument and the case went to the jury.
The verdict may be said to be a surprise to both sides
and the defendent will appeal.
DAMAGES AWARDED.
The following are the damages awarded
the plaintiffs.
J. L. powers, damage to crops 1902 and 1903, $400.
J. H. Drennan damage to crops, $800; damages to land,
$200, total $1000.
Mollie Moore et aI, damage to crop, $150.00.
W. W. Holland, damages to crop, $400.
A. D. Flowers, damage to crop, $210.00.
Total damages awarded, $2000.
