Will of William Osteen

 

The State of South Carolina

County of Sumter

 

                                                In the name of God Amen. I William Osteen of the County and State aforesaid being of sound and disposing mind and memory and mindful that it is appointed to all to die, do make and ordain this as my last will and testament:

 

First; It is my will that all my debts shall be paid.

 

Second; I give devise and bequeath unto daughter Easter Osteen to her and her heirs forever the following property to wit; one hundred acres of land more or less consisting of three parcels to wit; one parcel situate in said County and State containing forty six and one half acres being the tract of land conveyed to me by J.W. Broadway by Deed dated 6 June 1859 and recorded in the office of Register of ……..Conveyance for Sumter County in book 22 page 64 and being represented by a plat there of made and certified to by W.H. Brunson D.S. on the 24th May 1859 and attached to said Deed above mentioned:

Also one parcel situate in said County and State containing forty five and one half acres more or less being that part of the tract of 388 ½ acres of land conveyed to me by G.W. Lee and D.W. Foxworth by Deed dated 1st December 1860, and recorded in the Registers office aforesaid in book 22 page 308, which lies on the West side of Triar Branch and includes the said Branch- (said tract of 388 ½ acres of land being fully represented by a plat thereof made and certified to by W.H. Brunson D.S on the 15th Nov. 1860 recorded in said Registers office in book 22 page 308:  Also one other parcel in said County and State containing ten acres of land more or less, being a part of the tract known as the Mill Tract originally containing 417 ½ acres as per survey and plat of R.D. Bradford made on the 24th Feby. 1850, the said ten acres more or less hereby bequeathed lies in the South Eastern part of the said plat by R.D. Bradford and adjoin lands hereafter bequeathed to Theola Easter Osteen and Joseph Manly Osteen, lands of Caleb Osteen and other land above bequeathed to my said daughter Easter Osteen.

 

Third: - I also give devise and bequeath unto my said daughter Easter Osteen one bay mare that I now own or any horse that I may own at my death, one horse cart, one cow to be of her own selection from among my stock of cattle, all my household and kitchen furniture, all my poultry, also all my crops of whatever kind whether gathered and housed or in the field, including whatever provisions I may have on hand at the time of my death.

 

Fourth: - I give devise and bequeath unto my grand children Theola Easter Osteen, Joseph Manly Osteen children of my deceased son Manly Osteen to them and their heirs forever, to be equally divided between them the balance of the said tract of 417 ½ acres more or less represented by the plat of R.D. Bradford D.S. dated 27 Feby. 1850 after cutting off 86 acres heretofore given by me to my deceased son Caleb Osteen and one hundred and fifty acres heretofore given by me to my son Joseph A. Osteen, also the ten acres above bequeathed to my said daughter Easter Osteen, leaving a balance of one hundred and seventy acres more or less which is hereby bequeathed as aforesaid the 170 acres more or less being bounded North and West by land of Joseph A. Osteen, on the East by land bequeathed to my said daughter Easter Osteen on the South by the ten acres bequeathed to Easter Osteen and the said lands given by me to Caleb Osteen.

 

Fifth: - I will and bequeath all my persona property which I may have at the time of my death excepting that already devised to my daughter Easter Osteen, to my daughter Elizabeth Hodge (wife of Edward Hodge), Easter Osteen, my grandchildren Alice Osteen & Willie Osteen children of my deceased son Caleb Osteen and my grand children Theola Easter Osteen & Joseph Manly Osteen children of my deceased son Manly Osteen to be equally divided between them share and share alike.

 

Sixth: - I hereby nominate, constitute and appointed my sons Thomas J. Osteen and Joseph A. Osteen to be the Executors of this my last will and testament.

 

Witness my hand and seal this fifth day of September in the year of our Lord one thousand eight hundred & seventy six and in the one hundred first year of the Independence of the United States of America.
