WILL
OF MARY WITHERSPOON
In the name of God Amen. I, Mary I. Witherspoon of
Sumter District South Carolina being of sound mind, and memory, thanks be to
God, and Calling into mind the mortality of the body, Do make and ordain this
my last will and Testament. Then 1st I
will and bequeath unto my Son John S. one negro man named Nero. Then 2nd, I will and bequeath unto my son
Chalres Leroy, one Negro boy named Tom.
Then 3rd, I will and bequeath unto my Daughter Lillis the sum of Five
Dollars together with one Fourth part of my household and Kitchen
furniture. Then 4th, I will and bequeath
to my three daughters vs Matilda, mary and Ann, all my household furniture beds
&c to be equally devided between them except as before stated, the Fourth
part to my daughter Lillis.---------- Then 5th I also will and bequeath to my
three daughters before named Matilda, Mary and Ann, all the remaining property
negroes horses stock of all kinds and whatsoever I may die possessed of to be
equally devided betwen them after the payment of all my lawful and just
debts. Then 6th It is my will and
desire, that should either of the three last daughters named die leaving no
lawful issue that the portion of property they may have drawn from my estate
return to the other two and so on to the last one of the three that is Matilda,
Mary & Ann,
Then 7th it is my will and desire, That at the
decease of my daughter Mitilda, that her portion be equally divided between her
five youngest children ---, Sumter, George Washington, Sidney, Robert and David
Reese. Further more I nominate and
appoint my son John S. Witherspoon, Alfred Scarboro and Stephen Lacoste
Executors to this my last will and Testament in testimony thereof I hereunto
affix my hand and seal this seventeenth day of September in the year of our
Lord one thousand Eight hundred and Forty seven and in the 72nd year of
American Independence. Signed, sealed
