Will
of HANNAH VAUGHAN
The State of South Carolina
Sumter District
I Hannah Vaughan, of the said District and State,
being weak in body but sound in mind and memory, do make and ordain this my
last Will and Testament that is to say.
1. First-
I give and bequeath to Dr. John B. Witherspoon and Anthony White, and their Executors
and Administrators the following negro slaves, to wit Lawrence, Rosa and her
three children Bob, Frank, and Kate, also Grace and the future issue of the
females. Also my bay colt and cart, in
trust that they shall appoint the annual proceeds thereof to the use and
support of the family of my son Christopher D. Vaughan, during his life in such
a manner that the same shall not be subject to the debts of my said son, and,
at his death, he leaving issue then alive, it is my wish that the said property
shall vest absolutely in his issue, the issue of any of his children that may
be then dead taking such deceased child’s share; but should my said son leave
no issue alive at his death, I give the said property to such of my children as
may survive him and the issue of any deceased child, such issue representing
the parent and taking the parents share.
2. Secondly
I give and bequeath to my daughter Sarah W. Allen, one negro fellow Dick and
three hundred dollars, to her sole and separate use during her life and after
her death to her issue if any, the issue if any of any of her children then
deceased taking the parents share; but should she leave no issue alive at her
death I give the same to John William Allen the youngest son of her husband. It is my wish that the said pecuniary legacy
e paid to her before the rest of my property be divided as herinafter directed,
and that my said daughter shall have power, from time to time, to invest the
said money and change the said investment as she may desire.
3. I
give and bequeath to my daughter Mary E. Vaughan the following negro slaves,
Julia Ned and Randy and the future increase of the said female, to her sole and
sperate use during her life and at her death, she leaving issue, to her said
issue, the issue of any deceased child representing such child and taking his
or her share; but if my said daughter
Mary E., shall die leaving no issue alive at her death, I give the said
property to my daughter Charlotte A. Bradford, or if the said Charlotte A.
should be then dead, to her issue then alive if any; but if the said Charlotte
A. should then be dead leaving no issue alive at her death. I give the said property to my surviving
children – the issue of any of my children that may be then dead leaving issue,
representing such deceased child and taking his or her share. – I also give to
my said daughter Mary E. absolutely the sum of four hundred dollars, and the
balance, after payment of the pecuniary legacies herein given, of my share of
the crop now growing,
4. I
give and bequeath to my daughter Charlotte A. Bradford the following negro
slaves, Sue and her three children LeGrand, Brazil, and Winny, also Adam,
Charles, and old Adam and Anna, and I desire that she shall take charge and
support comfortably my old negro woman Candance. The said negroes I give to the sole and separate use of the said
Charlotte A. during her life, and at her death to her issue, if any, then
alive, her children taking equally and the issue of any of her children that
may be then dead taking such deceased child’s share; should the said Charlotte
A. leave no issue alive at her death I give the said negroes to my daughter
Mary E. if then alive, or to her issue if she then be dead, the issue if any of
children then deceased taking such deceased child’s share; but if my said
daughter Mary E. should be then dead, without issue then alive, I give the said
negroes to my surviving children and the issue of any child that may be dead,
such issue representing the parent.
5. I
give to my son James H. Vaughan the sum of two hundred dollars, and I also
release to him all claims and demands of every description which I have against
him.
6. I
give to my daughter Mar E. and Charlotte A. my carriage, household, kitchen and
milk house furniture, my plantation tools, wagons and all my horses except the
bay colt above bequeathed.
7. It
is my desire that the pecunary legacies above bequeathed shall be raised our of
my cotton crop now on hand and my share of that now growing, and if that should
not be sufficient by the sale of so much of my stock of cattle sheep and as may
be sufficient there for The reminder of my stock of cattle sheep after the
payment of such pecuniary legacies I give to my daughter Mary E. and Charolotte
A.
8. All
the rest and residue of my estate I give equally to all my children.
9. I
nominate and appoint my friends John B. Witherspoon and Anthony White Executors
of this my last will and Testament.
In witness whereof I hereto set my hand and seal
this twenty sixth day of April in the year of our Lord one thousand eight hundred and fifty.
