Will of
HENRY I. SMITH
In the Name of God Amen!
I, Henry I. Smith of Sumter District and State aforesaid (Planter) being weak in body but of perfect mind, memory and understanding, praise be God for the same, and calling to mind that all men must die, I have thought proper to make this my last Will and Testament, I commend my soul to Almighty God who gave it, and my body to be buried in a Christian like and decent manner.
Item 1st. My will and desire in that all my lawful debts funeral expenses and proving this my last Will and Testament be paid.
Item 2nd. I give and bequeath to my well beloved wife Martha, the following property (viz) Old Sam, old Peg, Washington, little Sam, Eley, Mary Martha, little Peg and their issue and increase, Hannah and her issue and increase, also my household and Kitchen Furniture, Two Horses, she taking choices of all that I own, Ten cows and calves or Yearlings, Baroach and Harness, during her natural life or widowhood, and at her death or marriage, the above property to be equally divided between my then surviving children or their issues, which she the said Martha has had by me, to them and their heirs forever. And I wish it expressly understood that my wife Martha is to have the liberty and working the plantation whereon I now live during her natural life or widowhood.
Item 3rd. My Will and desire is that my Executors hereafter named shall as soon as convenient after my death sell all my Rail Road and Rail Road Bank shares, and keep the money arising there from on Interest annually, for the Education of my younger children, and after their Education is completed, the balance if any, shall be equally divided between my them surviving children.
Item 4th. My Will and desire is that all my Lands and the rest and residue of my Estate, not herein bequeathed, shall be equally divided between my then surviving children, or their issues, that I had by both my wives, Ann and Martha, and I wish it understood that my Lands are not to be divided until the death or marriage of my wife, and the negroes of all the children shall have the liberty to work on the plantation in Williamsburg District until that time unless removed by Heirs themselves.
Item 5th. Lastly I do hereby appoint my Wife Martha, my son Daniel H. and my friend Samuel A. Burgess Executors to this my last Will and Testament disannulling all others.
In Witness whereof I have hereunto set my hand and Seal this Nineteenth day of July in the Year of our Lord One Thousand Eight hundred and forty Six, and in the 71st Year of American Independence.
