Will
of Robert Muldrow
In
the Name of God Amen I Robert Muldrow of Salem County, District of Sumter,
South Carolina Planter, being of Sound mind and in comfortable Health of Body
do make this my last Will and Testament, as follows (to wit)
First
I give and bequeath unto my Daughter Jane M. Muldrow Twenty Negroes of average
Value as per appraisement (excluding Superanuated and infirm and including in
the number my man Nelson, and his wife Vicy and their three children Celia,
Frances and Serena, also my driver fellow Cupid, his Wife Patsey and their
Children, Laura, Caroline and Martha and their increase, also Dennis, my
Blacksmith, and Blacksmith Tools, also my man Abel my Coachman, but‑‑
should
any of the above designated negroes die before they are allotted off to her,
their places to be supplied by others from the plantation of Equal value for
and during her natural life for her sole and seperate use, whether she remain
single or be married, freed from the debts, contracts or liabilities of any
Husband that she may ever have, and after her death to such children or child
as she may leave, the issue of a deceased child. Then the said negroes and
their increase are to be divided as follows: One Fourth part of said negroes
and their increase to my Daughter Sarah I. Plowden on the Same uses trusts and
limitations as the property herein bequeathed and divised to her. The other
three fourths of said negroes and their increase to be equally divided between
my other children, The issue of a Deceased child to take their Parents part
thereof.
Second
I give and bequeath unto my Son Robert B. Muldrow my goldwatch, chain, Key, and
Seal.
Third
I give and Bequeath unto my Daughter Jane M. Muldrow, my carriage and Carriage
Horses, One Bed, Bedstead and furniture (not including her Bed and chamber
furniture) The remainder of my Beds Bedsteads and furniture, I give to my other
children to be Equally divided among them
Fourth
I give to my daughter Jane M Muldrow, my Waggons, carts, plows plantation
Horses, Mulls and plantation tools, my Cattle sheep, and Hogs, with the
exception of one third of the Same, which one third I give to my Son William J.
Muldrow.
Fifth
I give and bequeath unto my Son Warren A Muldrow and his Heirs forever, and my
Daughter Sarah J. Plowden my plantation on the East side of Black River, and
all my other lands on the Same side of said Stream, to be divided between by
Boundaries as I have personally communicated to them; The upper part to be for
my Daughter Sarah J. Plowden on the trust hereafter mentioned, and lower part
for my said Son Warren A. Muldrow. The part of the plantation above mentioned
and devised to my Daughter Sarah J. Plowden, to be for her sole
and
seperate use, during the term of her natural life, not to be liable or subject
to the debts, contracts, or liabilities of her present or any future husband
she may ever have; She has liberty to clear any of the said land devised to her
as may be necessary for the Employment of her Laboures without impeachment of
Waste, and from and after her death to be Equally divided between such children
as she may leave at her death, the issue of any child that may predecease before her to take the share of their
deceased parent.
Sixth
I give and bequeath to my Son, William J Muldrow my clock, desk, Book Case,
side Board, Tables and all other of my Household and Kitchen furniture, and
Silver plate (except one sett of Desert Spoons not much used) I give to my
Daughter Jane M. Muldrow, and also excepting the furniture at my Capus place,
which I desire to remain on and go with the place
Seventh
I give and bequeath my Library to be Equally divided between all of my
children, but if any of them should die, before the Division, the Issue of the
one so dying to take the share their parents would if alive.
Eighth
I give and Bequeath to my Daughter Sarah J. Plowden Ten Negroes of an average
Value of the plantation negroes my man, George (Taylor) to be included in the
number, and in case George should die before the Division of my Estate, his
place is to be supplied by an other, and also the infirm and Superanuated not
to be included in the number To be held by her on the Same uses, trusts, and
Limitations as are mentioned in the Fifth clause hereof.
Ninth
I give and devise to my Daughter Jane M. Muldrow my plantation Known as the Capers
plantation, together with one hundred acres of the upland, and the upper swamp
land purchased from Mrs Susan Cover. to my said Daughter to the same uses
trust, and Limitations as the negroes are bequeathed in the first clause
hereof: and should she die leaving no children or child or issue of a deceased
child, Then the ssid Lands I give to my Son William J. Muldrow and his
Heirs.
Tenth.
I give and devise unto my Son William J. Muldrow, and his Heirs forever, The
plantation upon which I reside, including the swamp Lands adjoining the same
purchased of Mrs Susan Covert; I also give to my said son W. J. Ruldrow Ten
Negroes, of an average Value, among whom the infirm and superanuated are not to
be included
Eleventh
I desire and it is my will that my Daughter Jane M. Muldrow and my son W. J.
Muldrow have each a years provisions, or so much as may be necessary for them
Respectively.
Twelfth
I give to my Nephew Robert Marshall, Son of my Brother Matthew E. Muldrow, Five
hundred dollars, to assist in giving him a liberal Education, the one half to
be paid at the expiration of one Year from my decease, and the other Half at
the expiration of one Year there after. I also give to my Niece Margaret
Frierson, daughter of my Brother M. E. Muldrow the Sum of Five hundred Dollars
to be paid in like time with the Legacy to Robert Marshall, the Legacies above
named to be not subject to interest.
Thirteenth
The rest and residue of my Estate real and personal I desire and Will shall be
Equally divided between my children share and share alike, but should either of
my children die before the Division of my Estate, that the Issue of the child
or children shall take their parents part, as they would have done if living,
and the shares hereby intended for my two Daughters shall be for
the
uses, and Subject to the same trust and Limitations as is expressed in the
Fifth, First, and Eighth clauses of this Will. It is my will also that my Two
Negro Women Phillis, and Nanny and my House servant John select their owners
among my children and be included in their shares at their appraisement.
Fourteenth
I do hereby authorise and empower my Executors or a majority of them to appoint
in writing five disinterested Free Holders any Three of whom may act to divide
and apportion off my Estate as is herein directed. Their Division and
apportionment to be made under their hands and seals and to be recorded in the
same office as this my last Will and Testament may be by Law.
Fifteenth
I do hereby constitute my Sons George C. Muldrow Robert B. Muldrow, Warren A
Muldrow, and William J. Muldrow Executors of this my last Will and Testament
hereby revoking all other wills and Testaments heretofore by me trade.----
Witness
my hand at Bottom of each sheet and my hand and seal at the Bottom of this last
fifth sheet this thirteenth day of April in the Year of Our Lord one Thousand
Eight hundred and fifty two, and in the Independence of the United States the
Seventy sixth Year.

hereby revoke and make null and void the legacy of five hundred dollars,
bequeathed in the twelth clause of this my will and Testament to my neice
Margaret Frierson, Daughter of my Brother Matthew E Muldrow, in as much as I
have given my said Neice a negro girl named Julia Valued at five hundred
dollars in place of said Legacy bequeathed to her‑-Witness my hand Seal
this twentyeth of February one thousand eight hundred and fifty three‑‑‑

Codicil
State
of South Carolina, Sumter District
Know
all men by these presents, that I Doctor Robert Muldrow of the State and
District aforesaid, do make and ordain this Codicil to my last will and Testament,
bearing date the thirteenth day of April one thousand eight hundred and fifty
two, It is my will that in the sixth line from top, in section first of my said
will. The word Twenty be annulled, and that the word fifteen (15) be
substituted, and to include in that number, my man Nelson, and his wife Vicy
and their children, Celia, Frances, and Serena, my man Cupid and his wife
Patsey, and their children, Laura, Carolina, and Martha, and their increase,
and my man Dennis (Blacksmith) and also in the twelveth Line from top in said
section first, I desire that the name, of my man Abel, my coachman be stricken
out and annulled. It is my will that the word “Ten”, in second Line of
Section
Eight of my said mentioned will be annulled and the word Eight be substituted
in its place, I also give to my Son Warren A. Muldrow, Six Negroes, of an
average value in addition to what I have given him in the Body of my will
aforesaid and Lastly I do hereby adopt and make as a part of this my codicil to
my last will and Testament aforesaid, The note above this and at the Bottom of
my said will, in reference to the Legacy to my Neice Margaret F. Muldrow, dated
the twentieth day of February, one thousand eight hundred and fifty three.

witness I hereunto set my hand and affix my seal to this codicil this twelfth
day of April one thousand eight hundred and fifty three
