I Wm. Mc.Intosh considering the uncertainty ofthis mortal life and being
of sound mind & memory, (blessed be AlmightyGod for Same) do make and publish this my last Will and Testament inmanner and form following (that is to say) First I resign my Soulinto the hands of Almighty God, hopeing and believing in a remissionof my Sins, by the merrits and mediation of Jesus Christ, And my BodyI commit to the earth to be buried at the discretion of my Executorherein after named: And my worldly estate, I Give and devise asfollows- First I give & bequeath unto the Congregation of MidwayThree acres of Land Situate between two branches & Public Roadwhereon Midway Church now stands; So long as their is a PresbyterianCongregation worpshiping at that place. Also I Give and devise allthe remainder or residue of my Land Unto my four Sons; Wm. H.Mc.Intosh James G. Mc.Intosh Middleton D.Mc.Intosh and Joseph E.Mc.Intosh to be divided in the following manner. Three lines to berun from the Publick Road to the back line in Black River Swampmaking four lots or parcels as nearly equal as may be, the other partof the Lands on the other or North side of the road in like manner tobe laid out into four lots as nearly equal as may be, & attachâdto the first lots laid out of the South side of the Publick Road thatare opposite to each other making but four lots in the whole, eachwhole lot to be Appraised (without taking into consideration thebuildings or other
Improvements that may be on any of the lots) toassertain the whole Amount and if either or any of my Sons should getone of those lots of more value that his proportional part of thewhole valuation of the Lands he must pay over to those who mayrecieve a lot of less value than his proportion, It is my wish andWill that my Son Joseph E Should have that Lot of Land whereon mydweling house Stands & that it is so laid out as to contain myDwelling house & all the out buildings. Also it is my will thatmy Son Wm. H. should have the lot of Land on which he now resides. Also it is my Will that my son James G. Should have that Lot on whichhe first settled & built. And it is also my Will that my SonMiddleton D should have the other or fourth Lot of Land. Also it ismy Will that my beloved Wife Elizabeth keep possession of my dwellinghouse have the use of all my out buildings and that Lot of Land whichwill be laid out for my Son Joseph Erwin without hendrence ormolestation during her Natural Life if She remains my widow. Item Igive & bequeath unto my beloved wife one Negro Woman Named Tenah& her Child March with all her furture increases during hernatural Life, And from & after the decease of my Said Wife myWill is that the Negro Woman Tenah & all her increase be equallydivided among the Children which my Wife Elizabeth hath Born me.Item I give and bequeath unto my four youngest Children, Anna F,Middleton D, Sarah E, and Joseph E. to each, one Feather Bed andfurniture- Item I give & bequeath unto my beloved Wife oneFeather bed and furniture one Horse & Chair or such other ridingCarriage as may be in my possession at my decease - Also it is myWill that my beloved wife Elizabeth Should keep in her possession allmy Household Furniture & Kitchen furniture one Horse two Plows& gears all my Stock of Cattle Stock of Hogs & Stock of Sheepfor the purpose of schooling & maintaining of my four youngestChildren untill thety arrive at the Age of one & Twenty years. IAlso for the better education of my Children Anna F, Middleton D,Sarah E, and Joseph E, I do give & dispose of the Tuition &custody of them & every of them unto my wife Elizabeth Mc Intoshfor such time as they or any of them respectively continue unmarried& under the Age of one & Twenty years and my Said Wiferemains my Widow, but if my Said Wife shall die or Marry during thesingle Life & nonage of my of my said Children so being unmarried& under the Age of one & Twenty years at the Marriage ordeath of my Wife unto my son Jame G. McIntosh. And my Will is and Ido hereby direct my Executor to have the Negro Woman Named & allher issue which I loned unto my Daughter Jane M. Frierson to beAppraised by the Appraiser appointed by my Executor and afterdeducting what the said Appraisers my think a full Compensation (withthe labour of the Wench Nance and her Children) for raising the youngNegroes Nance's Children, and should the neet Amount of theAppraisment be more than her proportional part of the Amount of thepersonal part of my Estate She pay back to the other Children to maketheir parts equal,- And also it is my Will that the Negro WomanVilet and all her increase which I Loaned to my Daughter Mary W.Anderson be Appraised & conducted precisely in the same manner asthat of Jane W.Frierson,-All the rest & residue of my personalEstate, not herein before give & disposed of (after paying all myJust debts Legacies & funeral expenses) I give and bequeath untomy wife and following named Children Wm. H. McIntosh, SusannahKinder, James G. McIntosh, Anna F. McIntosh, Middleton D. McIntosh,Sarah E. McIntosh, and Joseph E. McIntosh to be equally dividedamoungst them Share and Share alike- It is also my Will that aftermy yougest Child comes to age of one and Twenty years that thehousehold & Kitchen Furniture the Stock of Cattle Hogs &Sheep which was reserved in the hands of my Wife for the Schooling& maintainance of my four youngest Children or so much thereof asmay remain be equally divided between my wife (if she is stillliving) and all my surviving Children.
