WILL OF SAMUEL LOWRY

 

 

I, Samuel Lowry of Salem County, Sumter Districtin the State of South Carolina, Planter, being sick and weak in bodybut of sound mind and memory for which blessing I desire to bethankful to Almighty God. I do make this my last will and testamentas follows to wit --

 

First, I give and devise to my brother, WilliamLowry, for during his natural life my Plantation whereon I now livebeing formed of several adjoining tracts of land; and from and afterhis death I give and devise the said Plantation of land to his sons,during their natural lives and after their deaths their parts thereofto their children forever --

 

Secondly -- I give and bequeath unto mybrother, William Lowry, during this natural life only the followingNegroes to wit, Jerry and Minder, his wife and his children, also,Patsey and her children and a Negro Bill. And from and after thedeath of my brother, William Lowry, I give and bequeath the abovenamed Negroes and their increase to my nephew, James Lowry, son ofWilliam, during his natural live and after his death to hischildren.

 

 

Thirdly -- I give and bequeath unto mybrother, William Lowry, during his natural life only, the followingNegroes, to wit, Maria and her family, Hanna and her family, andNifsey and her child and from after his death I give and bequeath thesaid last mentioned Negroes as follows to wit -- to my brotherWilliam's three daughters, to wit, Maria and her family, and theirfuture increase to Isabella Lowry during her natural life and afterher death to her children. Hanna and her family and their futureincrease to Mary Ann Lowry during her lifetime and after her death toher children. Kissiah and her child and their future increase toElizabeth Lowry during her lifetime and after her death to herchildren.

 

Fourthly -- It is my will and desire that therest of my Negroes be divided into four equal parts to be divided asthe rest and residue of my real estate is hereinafterdirected.

 

Fifthly -- I give and bequeath unto my nephewJohn Lowry, natural son of my deceased brother, David Lowry, the sumof one thousand dollars to be paid to Dee Dollard for his use as thesame may be wanted.

 

Sixthly -- I desire that all the rest of myreal Estate be sold at public auction by my Executors on a credit ofone, two, three, and four years with interest from the day of saletaking from the purchaser or purchasers thereof a bond with personalsecurity such as they may approve and a mortgage of the same. Also,that the rest of my personal Estate [Negroes to be divided as above]to be sold at public auction on a credit as above, with interest,taking from the purchaser or purchasers thereof a bond and withpersonal security such as they may approve.

 

It is my will that my Negroes directed to bedivided into four parts, my real and personal Estate directed asabove to be sold and all monies, debts, corps and other personalEstate to be divided into four equal parts.

 

To my brother, William Lowry, and his heirsforever I give one of the said fourth parts.

 

To my brother, Joseph Lowry, of Ireland and hisheirs forever, I give one fourth of the said fourth parts.

 

To my two nephews, John and Samuel Capwell ofIreland, one of the said fourth parts, but should either of them diewithout children or a child alive at their death the survivor to takethe whole. The Negroes that may be allotted to them to be hired outby my Executors until they come of age then their parts to bedelivered paid to them.

 

To my niece Ann Sinclair Lowry, daughter of mydeceased brother, David Lowry, I give one of the said fourth parts,but should she die without children or a child alive at her deaththen the fourth part hereby given to her to go to and be equallydivided between my brothers, William and Joseph, and their heirsforever. The Negroes that may be allotted to her in her part to behired out until she comes of age then to be delivered and paid toher; her part subject to the above limitations.

 

Lastly, I do hereby nominate and appoint mybrother, William Lowry, and my friend, John B Miller, Executorshereof

CODICIL TO SMAUEL LOWRY'S WILL

Whereas I purchased at Sheriffs sale of propertyof James C Fullwood several tracts of land for which land I haveFullwood titles but no title from the Sheriff has been executed to meby said Sheriff and I also purchased two Negroes. Rachel which Ihave suffered to remain in the possession of said Fullwood. Theother Darky is in my possession and where as I have paid several sumsof money which are mentioned in my book with the credits also othersums of money not yet entered in said book. And am also,liable -- to pay for said Fullwood a large sum or sums of money,I have assumed and promised to pay for him -- Now on his payingthe balance due to me what I am and may be liable to pay for him andall expenses to which I have or may be put to with the interest onthe said sum of money. I do hereby agree to convey to him all thesaid lands purchased of him or at sale of his lands and the saidNegroes as above mentioned, but as the same may not be full settledwith the said James C Fullwood in my lifetime. It is my desire thatthis be considered as a codicil to my will -- So as to enable myExecutors to convey to him the said lands and Negores.
