Will of Simon Kelly
I
Simon Kelly of the State of South Carolina and District of Sumter do make
ordain and Constitute this my last will and testament in the manner and form
following Item 1st I give and bequeath
unto my beloved wife Sarah Kelley, one negro boy named Daniel one negro boy
named Peter and one negro woman named Rachel during her natural life or
Widowhood and at her death or mariage I dispose of the above named negroes in
the following manner, the above named Daniel I give to my daughter Purity ann
Sophrona to her and her heirs forever; the above named Peter I give to my
daughter Amanda adaline to her and her heirs forever, and the above named woman
Rachel to be sold and Equally divided between my Six Daughters Jane Dubose, Mary
Belk, Abigail King, Sarah Boykin, Purity Ann Sophrona Kelley, Amanda Adaline
Kelley, Item 2nd I give and bequeath
to my Daughter Sarah Boykin one negro woman named Luisa during her natural
life, if the said Sarah Boykin should die childless the said negro to return
to my Estate and be sold and Equally
divided among all my Daughters then living and if any of my daughters should
die before that time leaving a child or children such child or Children to
represent the mother and take such portion as the mother would have taken if
alive; but if the said Sarah Boykin Should leave a child or children the above
named Luisa I give to them and their heirs forever Item 3rd I give and bequeath to My Daughter Abigail
King one negro girl
called
Siller to her and her heirs forever Item 4
I give and bequeath to my daughter Jane Dubose one negro woman named
Margaret and one Hundred Dollars to her and her heirs forever Item 5 th I give and bequeath to my Daughter Mary Belk
one negro woman named argent to her and her heirs forever Item 6th
I give and bequeath to my Daughter Purity Ann Sophrona one negro girl
named Emaline to her and her heirs forever
Item 7th I give and bequeath to
my daughter Amanda Adaline Kelley one negro girl named Ellen to her and her heirs
forever Item 8 my will and desire is
that the following negroes (to wit) Ellick Dick and Jack remain in the
possession of my beloved wife during her natural life or widowhood for use and
benefit and at her death or marriage to be sold and Equally Divided among my
daughters that shall be then liveing and if any of my daughters should die
Leaving a child or children said child or children to represent the mother and
take such portion as the mother would have taken if alive Item 9th

givea my beloved wife Sarah Kelley two hundred Acres of Land including all the
houses & gin house and screws during her natural life or widowhood and at
her death or mariage to be sold and Equally divided between my seven sons Simon
Kelley William Kelley, Reddick Kelley Thomas Kelley George Kelley Robert
Kelley, Middleton Kelley, Item
10th I give and bequeath to my daughter
Mary Belk twenty five acres of Land including the house and plantation whereon
She now lives to her and her heirs forever
Item 11th I give and bequeath to
my son Thomas
Kelley
all my land on the south aide of the branch known by the name of the Kelly
Branch whereon he now lives to him and his heirs forever. Item 12th
I give and bequeath to my son William Kelley that part of my land Lying
on the north side of the branch Known by the name of the Kelley Branch between
said branch and the Land belonging to the Est. of John Alexander not heretofore
given away also twenty five acres on the west side of the road leading from E
Dixons
to
Mary Alexanders to run parallel with Mary Alexanders line and adjoining E.
Dixon to him and his heirs forever Item
13th I give and bequeath
to my sons George Kelley Simon Kelley, Reddick Kelley and Robert Kelley, all my
lands not heretofore given away to be Equally divided between them so as for
George Kelley to have his portion whereon he now lives Item 14th I give and bequeath to my Grand
children Simon McClandon James McClendon Kinnian McClendon & Robert
McClendon Each one Hundred and twenty five dollars Item 15 I give and
bequeath my Children Middleton Kelley Robert Kelley, Purity ann Sophrona Kelley
Amanda adaline Kelley one bed and furniture to Each of them Item 16th
I give and bequeath to my wife Sarah Kelley two beds and furniture two
horses and one mule and all my farming Utensils one buggy Waggon & carts
dureing her life or widow hood and at her death or marriage to be Sold and
Equally
divided between all my children, and my four grand children Simon McClendon,
James McClendon, Kinnian McClendon & Robert McClendon Item 17th
I give my wife provisions sufficient to do her the present year. and my
stock of hogs & cattle & geese dureing her life or widowhood Item 18th
I desire all my Estate not heretofore given away to be sold and all my
Just Debts paid and also the money paid that I have heretofore givin away and
if any balance remains to be Equally divided among all my children and my four
grand Children Simon McClendon, James McClendon Kennian McClendon & Robert
McClendon, And I do hereby Ordain Constitute and appoint Abner Alexander
Executor of this my last will and testament in witness whereof I have hereunto
set my hand and seal this the Eleventh day of January one Thousand Eight
hundred and fifty two
