In the Name of God. Amen, I. Robert W. James, ofSumter District and State of South Carolina, Divine, Being in feeblehealth of body but of a Sound and disposing Mind, Calling to mind theMortality of the body and the uncertainty of life, do make this Mylast will and testament, Viz, I bequeath my property so much of it asMay be necessary to the payment of my just and lawful debts for thispurpose, I do hereby appropriate the following negroes to be sold ifnecessary for the payment of my debts, and I. do authorize Myexecutors and executrix to sell the following negroes, and apply theproceeds or as much of it as may be necessary to the liquidation ofmy debts Viz My negro man Frede Zackey and woman Lavinia & hertwo Children. I do hereby authorize My executors and executrix tosell all my real estate of which I am now in possession of; and tomake warrantee titles to the purchaser for the same; The proceedsresulting from the Same to be vested in the purchase of other landselsewhere at the discretion of my executors and executrix for thebenefit of my heirs.

I give and bequeath unto My adopted son FrancisMarion James of Sumter District and state aforementioned at the, ageof twenty one years the following negroes Viz Jarred Abram Julius& woman Silvay & her two Children with their future issue. One half of my library of Books, and the privilege of his negroescultivating the lands of my estate during his minority free fromrent.

The residue of my estate real and personal I giveand bequeath unto my two daughters Sarah Adalene James & MaryElizabeth James on the days of their respective Marriages or ages oftwenty one years, to be equally divided between them Share and sharealike. As my heirs arrive at the ages of twenty one years or Claimtheir portion of my estate under the will, I do hereby Authorize myexecutors & executrix to Choose at least three disinterested Menwho shall divide to him or her their portion fo the estate withoutreference to court.

I do hereby Constitute nominate and appoint SamuelMcFaddin and John T. James of Sumter District William E James ofDarlington District executors & Elizabeth L James of SumterDistrict executrix of this my last will and testament. In witnesshereof I have hereunto Set my hand and Seal this the twentieth day ofNovember and in the year of our lord One thousand eight hundred andforty

I Robert W. James of Sumter District and State ofSouth Carolina divine do make the following a Codicil to be attachedto my last will & testament which is dated the 20th day ofNovember One thousand Eight hundred and forty. And so altering mywill and testament in the following particulars. Whereas I havewilled and bequeathed to my adopted Son Francis Marion James ofSumter District and state aforesaid, the privilege of Cultivating aportion of the lands of my Estate free from rent. I do now herebymake void that portion & clause of my will & testamentleaving that portion of my will bequeathing to Said X Francis XMarion James. One half of my library of Books & the followingnamed negroes Viz James Abram Julius & woman Sivvey & herChildren with their future issue in full force and Virtue And I dohereby Constitute nominate and apporint my friend James E.Witherspoon Executor over that portion of my estate which isbequeathed by my will & testament to my said Son Francis M. Jamesalso making him the said Jas. E. Witherspoon guardian over my saidson Francis M. James. And I do authorize my executors &executrix to turn over all the property of my estate above mentionedas bequeathed to Francis M. James into the hands of James E.Witherspoon releasing them from all obligation & responsibilityon account of Said property bequeathed to said Francis M. James. Theother parts & clauses of my will & testament except theportion thus intended to be altered, I do hereby Confirm andestablish in every particular. In witness hereof I have here untoSet my hand and seal this the Twenty Ninth day of March In the yearof our lord one thousand eight hundred and Forty One.
