Will of Holloway James
I Holloway James, being in my proper senses
& Knowing the uncertainty of life--Do make this my Will‑‑‑Viz
I give to my Wife Roxana James during her life time or so long as she remains
Virtuously my Widow, The plantation & House where I now live, The furniture
& out Buildings, utensils tools &ca necefsary
to carry on the said plantation‑‑together with the following
Negroes--Rose, Bob Lucy & Nuson Hansurd‑‑secured to her by
Marriage Contract, & duly recorded in Columbia--together also with the
Negroes her Mother give here with the following proviso--I appoint John B
Miller my Executor-I charge all concerned to pay off my just Debts, & I
charge all concerned to give my Children as good an education as circumstances
will permit-- and when the eldest becomes of age or marrys, then all the lands
& residue of my property to be equally divided The Mothers part if she be
alive covering the Settlement where I now live, on the same condition specified
before, & if she does well up to this time may take charge of the property
of the Jun. Children until they become of age but if she violates the condition
in that case, I give her only the Herny Tract of Land in lieu of the land first
given during her lifetime, adjoining lands of Wm Wheloing & others,
containing one hundred Acres By plot, and about a Mile below where I now live,
or an equevalent in land (if that should be sold,) according to the discretion
of my Executor-But under ever circumstance of the management of my Estate, I
give to John B. Miller my Executor the right to sell the whole or any part of
my Estate at any time; & to make such disposition of the same as he may
think best for the Interest & Welfare of all the children‑-Shou’d any
one or more of my Children die before becoming of age, the survivor or
survivors as the case may be of the child or Children shall heir all‑‑The
Mother being already provided for during her life time‑‑& after
hir death all the property she may have from me or hir Mother will go to my
Children as it is written--the child or children that may Heir any thing from
their grand Mother Ann E Howard that is if she gives specially to one, more
than the rest, then the rest are to have an equivalent from my Est. previous
to
gen.l division, and all put on an equal footing, even to a dollar. a present I
have four Children, Viz Lucian James; Wm. Alex.r James; Benj. Albert James;
& Martha Ann James there may be more or lefs at my Death for all that I
know.---
