Will of Richard Harvin, Senior

In the Name of God, Amen. I, Richard HarvinSenior, of State and District above mentioned being very sick andweak in body but of perfect mind and memory thanks be given unto Godcalling unto mind and memory the mortality of my body and knowingthat it is appointed for all men once to die do make and ordain thismy last will and testament that is to say principally and first ofall I give and recommend my soul into the hand of Almighty God thatand as touching such world estate wherewith it has pleased God tobless me in this life I give demise and dispose of the same in thefollowing manner and formÉ..

 

First, after my just debts are paid it is myrequest that my Executors shall sell all my lands lying on SammySwamp in this manner [Viz] The purchaser shall pay one third of thepurchase money on the day of contract one third more at theexpiration of twelve months and the reaming third at the end of twoyears and I moreover request that they shall not take less than fivethousand dollars for the land but get as much more as they can theyshall also take a mortgage of the land with a bond and approvedsecurity for the payment and themselves, give a forfeit bond fordouble the amount to make titles after the full payment of thepurchase money. I, also, wish [if they should sell these lands] thatthey would purchase three hundred acres of land convenient to theChurch and Schoolhouse on Nasty Branch and settle my family thereon.And in case they should not sell my lands, I wish them [my Executors]to hire a man and place him on my plantation to oversee and manage myaffairs here. And, I wish them [my Executors] to purchase ten orfifteen acres of land convenient to the Church of Nasty Branch andplace my family thereon in order that they should receive the benefitof religion and education. And again in case the land is not sold Iwish it equally divided between my five sons. And they [my sons]shall pay my two daughters fourteen hundred dollars in cash inproportion to the value of their lots of land each son inheriting hisland as he becomes of age and makes payment accordingly to mydaughters and should one or more of my sons not live to inherit theirland the survivors shall pay so much more to my daughter as thejudgement of Executors shall think proper according to the value oftheir different lots of land.

 

Item, I give and bequeath unto my wife,Elizabeth Harvin, one Sorrel Horse Riding Chair and Harness, also,one Negro woman named Nanny during life or widowhood and if my wifeshould marry, the above Negro woman Nanny shall return to my Estatetogether with her increase.

 

Item, Willliam Washington Harvin, ThomasJefferson Harvin, Richard Alexander Madison Harvin, SeptimiusAurelius Harvin, Robert Bradford Harvin, those my sons shall heir theland according to the above will. I merely mention their names inorder that they should be known as they were omitted above and mydaughters, Sarah Rebecca Harvin and Amanda Naomi Harvin, shallreceive from my sons so much money as will pay them for their shareof land if it were equally divided between the seven children as itis my intention, my daughters shall have no land.

 

Item, none of my children shall receive a Negrountil married and as they marry then they shall receive aproportional part of Negroes by appraisement. As I neglected tomention this above, I now say that it is my will that if my land issold, my Executors shall lay out all the proceeds of it can be sparedin the purchase of young Negro men together with two or three youngNegro women and it is my particular request that my Executors shalluse their best endeavors to sell the aforesaid land.

 

Item, all my stock consisting of horses [withthe exception of the above mentioned Sorrel Horse] cattle, hogs andsheep and goats all of my heirs shall share and share alike of theabove stock if in case any of the above stock shall be so that theycannot be fairly divided it is my will that they can't be dividedshall be advertised twenty one days and be sold at public auction andthe proceeds arising therefrom shall be equally divided among myheirs. As I neglected to mention above, it is my will that my wifeshall be supported out of my Estate during her natural life orwidowhood; but, if she marries she must move off and if she shouldmarry a good woman must be hired to take care of my children. Asmall tract of land I own containing sixty acres more or less beingpart of a tract of land which Chosel Weeks purchased from JohnOwen&emdash;I wish my Executors to sell and place the proceeds to theuse of the estate. As I come near the conclusion of my wil,l I thinkit proper now to mention my Executors. And as those I mention aremen in whom I can place full faith and confidence, I solemnly appointJesse Nettles, Henry Byrd, Samuel Harvin and Capt. Thomas Davis,Executors, to this my last will and testament. In witness whereof Ihereunto set my hand and seal this thirtieth day of January in theyear of our Lord one thousand eight hundred and twenty seven and inthe fifty first year of American Independence.

Be it known to all men by these present, that I,Richard Harvin, of Sumter District and Clarendon County, have madeand declared my last will and testament in writing bearing date thethirtieth day of January one thousand eight hundred and twenty seven. I, the said, Richard Harvin, by this present Codicil do Ratify andconfirm my said last will and testament and do further will andrequest that my Executors shall make Chosel Weeks a good and lawfultitle to all the land which I have sold him. The said Weeks which iscontained in a plot made by Joseph Cessions in December one thousandeight hundred and twenty five the said Weeks has paid me for sixtynine and a quarter acres and he now owes me for the balance of saidland at the rate of three dollars and a half per acre. When myExecutors shall make the said Chosel Weeks a title,

I wish them to take up from the said Weeks a titlewhich I have made him for a part of the land say sixty nine and aquarter acres. And my will and meaning is that this Codicil beadjusted to be a part and parcel of my last will and testament. Andthat all things therein mentioned and contained be faithfully andtruly performed and as full and amply in every respect as if the samewere so declared and set down in my said last will and testament.Witness my hand this second day of February one thousand eighthundred and twenty seven.
