Will
of William Humphrey
In the name of God, Amen - I William Humphrey
of the State of South Carolina, and District of Sumter, do make & ordain
this my last will, & testament in manner & form following -
First - I give & bequeath unto my Beloved
Daughter, Sarah W. Benbow, the following named Negro Slaves with their increase
‑ Binky, Fanny, Billy, Moses, Nancy and Jim - also the plantation or
tract of Land whereon I now reside; also my new Carriage & two Horses
together with all my Household & Kitchen furniture during the term of her
natural life, and at her death to such Child, or Children as may survive her in
fee forever -
Second - I give & bequeath unto my
Beloved Grand Son William Washington Benbow; the following named negro Slaves,
with their increase - Lucy, & her son John, Isaac, Susey, Ellen Agnes, Tom
& Aron - Also all the rest, & residue of my real Estate, together with
half of my Stock of Horses, Mules, Cattle, Hogs & Sheep - But in case he
should die, leaving no lawful ifsue, then, & in that case, his part or
portion to be equally divided between my Daughter Sarah W. Benbow, & her
Surviving Children ‑
Thirdly - I give & bequeath unto my Grand
Children, William Washington Benbow, Pinkney Green Benbow & Henry Laurens
Benbow, all the rest & residue of my Estate, to them & their heirs
forever, & in case one or more of my Grand Children above named shall die,
leaving no lawful ifsue, then his or their part, or parts, portion or portions,
shall be equally divided between my Daughter Sarah W. Benbow, & such Child,
or Children, as may be then living‑
Fourth ‑ It is my will & desire
that my Executors herein after to be named, shall, & they are hereby
exprefsly enjoined to Keep my whole Estate together until the above named
Legatees, shall respectively arrive at the age of Twenty one years, or Marry‑
then their parts or portions, to be delivered over to them & not before ‑
And it is also my will & desire, that my Executors, shall
permit my Father, now living with me, to
remain here, & they are exprefsly directed to support him during his life,
out of the proceeds of my Estate-— The remainder to be appropriated to the use
& benefit of the Legatees -
Lastly - I hereby constitute & appoint my
trusty & worthy Friends, William Haynsworth, George I McCauley, and Adam
Dingle Executors to this my last will, and testament. And I do hereby revoke,
& render Null & void, all & every other Will, or Wills, heretofore
made by me -
In Witnefs whereof, I have hereunto Set my
hand & Seal this the Eighteenth day of November, in the year of our Lord,
one Thousand Eight hundred & thirty five.
