Will of Amos
Davis
In the name of God Amen I
Amos Davis of Sumter District and State of South Carolina, Planter being of
sound mind and memory do make this my last will and Testament.
1st I give
and devise to my son Thomas J. M. Davis
one tract of Land containing Sixty three acres known as the Thigpen Tract also one other piece or parcel of land
containing seventy five acres to be
taken from the Tract purchased by me from Francis Sumter, said Seventy five
acres to be adjoining the Thigpen Tract, the other piece or parcel of Land to
be taken from my house tract by a line running from the Pine corner of the
Thigpen tract north Sixty one east to
the Sumter Tract, to have and to hold all and singular the said several pieces
or parcels of alnd and their appurtonances unto the said Thomas J. M. Davis his
heirs and assigns in trust that he the said Thomas J. M. Davis his heirs and
assigns will suffer and permit my daughter Martha J. Laurence to have hold use
occupy and enjoy all and singlular the said land during her natural life and
after her death to any issue she may leave at her death to and for her sole and
separate use, not subject – to the debts incumbram cos alimations of her
present or any future husband she may have.
2nd I give and
devise all my other lands to my five other children (Viz) Thomas J. M. Davis,
Elisa Allsbrooke, Mary E. Davis, Edwin D. Davis and Harriett J. Davis to be
equally divided among them by three men to be chosen by my Executors herafter
named to be as divided that my these unmarried (Viz) Mary E. Davis, Edwin D.
Davis and Harriet J. Davis have their portions, so as to include the cleared land and each one of them to have the use
of my dwelling house so long as they remain single and no longer.
3rd I give to
Mary E. Davis, Edwin D. Davis and Harriet J. Davis thwo hundred and fifty
bushells corn, three thousand pounds
fodder,one hundred and fifty pounds sugar,
forty pounds coffee, one thousand pounds pork, three barrells flour and
all the rice crop, one small wagon and gears, my household and kitchen
furniture, Plantation tools, any one of the above named provisions and
furniture----
4th It is my
will and desire that my Executors sell my stock of cattle, horses and stock
hogs, sheep, the corn and fodder net willed and the pork not willed, also my
cotton crop to be sold and the proceeds to pay my just debts, and out of the
balance, if so much be left, I give my
grandson Wiliam M. Davis, two hundred dollars, which I wish my Executors to use
for him in the way think best, the said W. M. Davis to be sent to school out of
it but if the said W. M. Davis should
die under Twenty one years of age and
leaving no child or children then my executors shall pay to my heirs the amount
in their hands at the time of his death.
5th If there
should be any money left after paying my debts and the two hundreed dollars to
W. M. Davis the balance to be equally divided among my children.
6th I wish my
rifle gun kept for the use of the plantation , my double barrel shot gun I wish
sold.
Lastly I nominate,
constitute and appoint my son Thomas I. M. Davis and Turner Davis Executors to
this my last will and Testament, Given under my hand and seal this twenty
eighth day of September in the year of our Lord one Thousand Eight hundred and
forty seven.
