WILL OF THOMAS P. CUBBAGE

 

 

In the name of God, Amen, I Thomas P. Cubbage ofSumter District being sick and weak in body, but of sound and perfectmind and memory do make and ordain this my last will and testament, Icommend my spirit to God, my body to be decently buried in myfather's Burying Ground my worldly estate to be divided as follows,to wit.

 

Item&emdash; I give and bequeath unto my true andfaithful Negro woman named Amelia her freedom and do by thesepresents enfranchise her from the bondage of slavery during hernatural life, leaving her my dwelling house to live in, my gin housefield to plant in, with my rye patch, garden and orchard, during hernatural life and at her death to descend back into the tract of landthat its taken from.

 

Item&emdash; I give unto her the said Amelia afeather bed and furniture, my bureau and its contests, all my kitchenfurniture, two gentle milk cows and calves, six head of brood hogs,the liberty of raising stock on my plantation, the white maretogether with rail timber to refence her fields when it wants it, andmore ground [if required], a flock of geese and the sum of tendollars to be paid her the said Amelia annually.

 

Furthermore, I do hereby authorize my executorsherein after named, them or any two of them or any one of them topetition the Legislature for confirmation of this clause of my willthat respects her freedom, showing cause what she has been faithfuland good to me her Master in sick and lanquid condition for a longtime.

 

Item&emdash; I give and bequeath unto my brotherstwo children Daniel Cubbage and Rebecca Cubbage all that plantationor tract of land containing one thousand acres [more or less] lyingand being on Bull Head Bay, the waters of Black River, to possess andenjoy either at their marriage or at the age of twenty one years andif either of them die before then the survivor is to heir thewhole.

 

Item&emdash;I give and bequeath unto my niece MissEliza Carr, a lame girl, three Negroes named Ozborn, Zuasiba and MaryAnn to possess on the first of January next ensuring.

 

Item&emdash;I give and bequeath unto WilliamMcKelveen, Junior all my blacksmyth tools,

 

Further, it is my will and desire that myplantation be continued on as it now stands; without any publicvandue or hiring out of Negroes, and that if there is any more madeannually than what pays Amelia and necessary for the plantation itsto be kept in the hands of my executors for the said Amelia aforesaid[if she should happen to be in want]. And I do positively order thatmy neighbor John J. McFaddin take the possession of all my keys at orbefore my death when lying in a low estate and order and make thenecessary arrangements for my burial.

 

Item&emdash; I give and bequeath unto John JamesMcFaddin all the residue of my Estate, both real and personal, to himhis heirs and assigns, together with all my horses, cattle and hogs,my mark and brand, two feather beds, one wagon, all the plantationutensils, Horse Mill Stones and all my goods and chattels, rights andcredits to posses and enjoy either at this marriage or at the age oftwenty one years. I, do hereby authorize, constitute nominate andappoint John J. McFaddin, William Anderson, William McKintosh, Juniorand William McKintosh, Esquire, them, or any two of them, or any oneof them to be my whole and sole Executors or Executor of this my lastwill and testament nothing doubting but it will be managed with allrequisite prudence.

 

And I do hereby utterly disallow and disannul alland every other former will and testament by me heretofore made&endash; Ratifying and confirming this and no other to be my lastwill and testament.
