In the Name of God, Amen.
I, Michael Blackwell, of Sumter District,Planter, being of sound and disposing mind and memory do make andordain this my last will and testament in manner and form followingviz.
First, I lend to my wife, Mary Blackwell, tenNegroes viz: Sam, Jim, the blacksmith, Cate, Caty, Jack, Mary,Louisa, Betsey, Scilla and Amaritta, with their future increaseduring her natural life and at her death to be equally dividedbetween the lawful heirs of her body.
Item, I give to my loving wife, Mary, one horseand riding chair and she is to have her choice of the said horse ofthose which I have on my Plantation at that time to be hers and herheirs.
Item, It is my will that my wife, Mary, shallhave the use and benefit of the houses and Plantation whereon I nowlive together with one half of my household and kitchen furnitureduring her natural life. And at her death to be equally dividedbetween all my surviving heirs share and share alike except Arthur MWhite who is to have no part or share of my landed Estate.
Item, It is my will and desire that all the restand residue of my p¯tð ꯸ð notalreadyÙú`posed of shall be equally divided between all myheirs as they come of age or marry. Nevertheless, should any of mychildren die without leaving lawful issue then their part or share ofmy estate shall return and be equally divided between my survivingchildren or their lawful issue share and share alike. And likewiseshould any of my children die leaving lawful issue and that issueshould die without lawful issue then the property shall in likemanner return and be divided between my surviving children or theirlawful issue.
Item, It is my will and desire that my landedEstate shall be equally divided between my sons, Michael I.Blackwell, James C. Blackwell, Samuel B. Blackwell and Edmond B.Blackwell.
Item, It is further my desire that my propertybe kept all together until there are sufficient funds raised for theeducation of my younger children viz: Samuel B. and Edmond B.Blackwell and also my grandson, Michael White, and that the propertywhich shall fall to the said Michael shall remain in the hands of myExecutors hereinafter named until he shall have arrived to the age oftwenty one years or marries: But should he the said Michael diewithout leaving lawful issue or should he die leaving lawful issueand that issue die without lawful issue then and in that case thepart and dividend which he shall have received of my Estate shallreturn and be divided between my surviving children or their lawfulissue.
Lastly, I nominate and appoint my sons, MichaelI Blackwell and James C Blackwell, and my wife, Mary Blackwell,Executors to this my last will and testament. In witness whereof Ihave set my hand and seal this 12th day of October one thousand eighthundred and twenty six.
