State of South Carolina) In the name of God AmenI, Joseph W. Anderson of the state and
Sumter District) District above mentioned being infeeble health of body, but in perfect mind and memory (blessed be Godfor the same) but calling to mind the mortality of my body, andknowing it is appointed unto all men to die, do make and ordain thismy last will and testament, Principally and first of all, I resign mysoul to God who gave it and my worldly estate with which it haspleased him to bless me I give and bequeath in the followingmanner.----------
Item 1st-It is my will and desire that all my Justdebts be paid as soon after my decease as possible----
Item 2nd-It is my will and desire that my estatebe kept together for the benefit of my wife and children until theybecome of age or marry, or the marriage of my widow, then in eithercase it is my direction that my estate be appraised (by three or moredisinterested free holders which my executors may designate for thatpurpose) and one equal share or shares as the case may be) be givento the one arriving at age, or marrying the balance of my estate beagain thrown together and again appraised and dept together until another of my children become of age or marry and again to be dividedas in the first instance, and in a like manner, until all my childrenarrive at age or marry, that part of my estate alluded to is thepersonal and perishable, not including real estate.
Item 3rd-It is my will and desire, that should mywife inter marry with any person that she be given by my Executors achilds part of my personal and perishable property, with or previceto be hereafter named.--Viz. That should she have no children, thatthat part of my estate that she may receive, be returned to myexecutors to be equally divided amongst my children or their heirs,but should she have children, it is my will and desire that herproportion of property received from my estate be equally dividedamongst my children and those she should have by another husband--
Item 4th-It is my will and desire that should mywife receive any property (real or personal or perishable) from herfathers estate, that she have the disposal of it as she may deem fit,and that my executors have no control over the same unless she shoulddesire them to take the same in charge for her benefit or when shemay direct them to give it to by will or otherwise---
Item 5th-It is my will and desire that my wifetake the first shoice of my negro women-------
Item 6th- It is my will and desire that when myfirst son becomes of age or marries, that my executors have my landvalued, or appraised, and that my remaining sons pay him theirrespective portion of the appraisement and the same course to bepursued with all my sons the youngest son to have and to hold thewhole of my lands provided he pays to each of his older brotherstheir respective valuation of my lands----
Item 7th- I will and bequeath unto my wife mycarriage and two horses----
Item 8th-It is my will and desire that all mychildren be given a good English education, or should my sons desire,or my Executors deem it necessary to give any of them a classicaleducation, the expense attending the said education be paid off intheir respective proportion of their estates----
Item 9th-It is my will and desire that myExecutors carry the provisions of this my will into effect, withoutapplication to the court of Law, or equity, further than is necessaryin such cases and for that purpose do constitute and appoint StephenLacoste Robert L. McLeod and James G McIntosh my Executors of this mylast will and testament, revoking and annulling all former wills andtestaments---
