In
the name of God Amen I, Joseph W. Anderson of the state and district above
mentioned being in feeble health of body, but in perfect mind and
memory(blessed be god for the same) but calling to mind the mortality of my
body, and knowing it is appointed unto all men to die, do make and ordain this
my last will and testament, Principally and first of all, I resign my soul to
God who gave it, and my worldly estate with which it has pleased him to bless
me, I give and bequeath in the following manner.---
Item
1 st It is my will and desire that all my Just debts be paid, as soon after my
decease as posible--
Item
2d It is my will and desire that my Est. be kept together for the benefit of my
wife and children untill they become of age or marry, or the marriage of my
widow, then in either case it is my direction that my estate be appraised (by
three or five disinterested free holders which my executors may designate for
that purpose) and one equal share or shares as the case may be)
be
given
to the one arriving at age, or marrying the balance of my estate be again
thrown together and again appraised and kept together untill an other of my
children become of age or marry,
and
again to be divided as in the first instance, and in a like manner, untill all
my children arrive at age or marry, that part of my estate alluded to is the
personal and perishable, not including real estate.

3d It is my will and desire, that
should my wife intermarry with any person, that she be given by my Executors a
childs part of my personal and perishable property, with or previse to
be
hereafter named.-‑‑Viz. that should she have no children, that that
part of my estate that she may receive be returned to my executors to be
equally divided amongst my children or their
heirs,
but should she have children, it is my will and desire that her proportion of
property received from my estate be equally divided amongst my children
and those she should have by
another
husband--

4th It is my will and desire that should my wife receive any property (real or
personal or perishable) from her
fathers estate, that she have the disposal of it as she may deem fit, and
that
my executors have no control over the same unless she should desire them to
take the same in charge for her benefit or when she may direct them to give it
to by will or otherwise---

5th It is my will and desire that my wife take the first choice of my negro
women---
Item
6th It is my will and desire that when my first Son becomes of ago or marries,
that my executors have my land valued, or appraised, and that my remaining sons
pay him their respective portion of the appraisment and the same course to be
pursued with all my sons the youngest son to have and to hold the whole of my
lands provided he pays to each of his older brothers there respective valuation
of my lands---

7th I will and bequeath unto my Wife my carriage and two horses‑‑‑
Item
8. It is my will and desire that all my children be given, a good English
education, or should my Sons desire, or my Executors deem it necessary to give
any of them a classical Education, the expense attending the said education be
paid off in there respective proportion of there estates---
Item
9. It is my will and desire that my Executors carry the provisions of this my
will into effect, without application to the court of Law, or equity, further
than is necessary in such cases and for that purpose do constitute and appoint
Stephen Lacoste Robert L McL.eod and James G McIntosh my Executors of this my
last will and testament, revoking and annulling all former wills and
testaments---
In
witness whereof I have hereunto affixed my hand and seal this the 14th July in
the year of our lord one thousand eight hundred and forty one, and in the 66th
year of American Independence--
