I John Singleton of Sumter District in the Stateaforesaid; being aware of the uncertainty of Life and at this time inperfect possession of my intellectual faculties do Make and publishthe following as my last Will and Testament.-
First, it is my Will and I hereby will and directthat my debts be paid as soon as the same can be conveniently done,this Monies I may have on hand at my death, all the Money due to meby bonds, Notes or otherwise all the Crop intended for sale andRemaining unsold all that proportion of the Crop planted or growingif any at the time of my death, which can be spared from the supportof the family and plantation; are hereby constituted and declared tobe the fund for that purpose; but should such funds not be sufficientthen in that case the balance shall be paid out of the proceeds ofthe Trust estate herein after Mentioned in the will.
ITEM - I give and bequeath devise to my belovedWife Rebecca fourteen hundred and Seventy Nine Acres of land beingthe land and plantation whereon I now generally reside, called theMidway plantation laying all upon the East side of the GreatCharleston Road except two hundred and eighty eight acres of woodlandlaying on the West of said road and Adjoining the lands possessed byW Theus, the Midway plantation being divided from the lands of my sonRichard by a line Running from a Stone corner Marked as such, thewhole containing seventeen hundred and sixty Seven Acres by ResurveyMade by John McDonell to the said Rebecca for and during her Naturallife; and I also give and devise my House and summer Residence in theSand hills with five hundred Acres adjoining thereto to the saidRebecca and during her Natural life.
ITEM - I give and bequeath to my beloved WifeRebecca the use of all the slaves that May be on the said Midwayplantation at my death, that is such as are Attached to and workingon said plantation, all said Slaves for and during her natural life,and also all the Use for and during her Natural life of all theHorses, cattle and stock of every kind with all the plantationUtensils of every kind as they may thereon at the time of my death,except as herein after excepted.
ITEM - I give and bequeath to my Wife Rebecca forand during her Natural life the Use of all My House Servants, orSlaves, also all the slaves employed about the kitchen, Gardensstables and poultry Yard, and also the Carriage I first bought inPhiladelphia.
ITEM - I give and bequeath to My Wife Rebecca onehundred shares of the Bank stock of the Bank of the United States,subscribed by me, And also all my household and kitchen furniture ofevery kind whatsoever and all the plate of which I may die possessed,and all my wines, spirits and other stores that may be at my saiddwelling house at the time of my death.
ITEM- I will and direct That my Executor orExecutors herein After Named shall Make proper and Ample provisionfor the support of the family, the slaves Horses and all other Stockon the said Midway plantation for the remainder of the year in whichI may die, and also for the year following.
ITEM- I give and devise to My Son RichardSingleton to him and his Heirs forever, all that tract and plantationwhereon he resides laying South of the above Midway plantation, anddivided from the said Midway plantation by a line running from theStone Corner on the great road East to Jone's line, now William H.Moore's, then bounded on the East by the lands granted to ThomasJones, South by the lands belonging to Mathew W. Moore, West by thelands owned by John W. Rees and North by a line through the Middle ofthe woodland above described laying on the West side of the greatroad thence down the great road to the Stone Corner and containingone thousand Acres More or less.
ITEM- I also Give and devise to my said SonRichard Singleton to him and his Heirs forever all the plantation Ipurchased of William Doughty, known by the name of Trueblue NearOrangeburg containing two thousand five hundred Acres, of which thesaid Richard is now in possession.
ITEM- I give and confirm to my said son Richardall the Negroe slaves I have heretofore put him in possessionof.
ITEM- I give and bequeath to said son Richard myMolatto Man Robert a taylor by trade, also my Grey English MarePhysche and her bay filley by Sir Archey and my Gold Mounted doublebarrelled Gun Made by Martimore.
ITEM-I give and devise after the decease of mybeloved wife to my son Richard Singleton and his Heirs all the landplantation called the Midway plantation described above as devised towife for life, in Trust however for the intents and purposes hereinand here after Mentioned, that is to say, that the said Richard andhis Heirs will permit my daughter Mary Martha McRa to Occupy,possess, and enjoy the same during her Natural life, with all theissues and profits thereof for her sole separate use and benefit, notsubject in any Manner to the interference or control of her HusbandPowel McRa or the debts and Contracts of the said Powel McRa.
Item- It is also my will and I do hereby desireand direct that the said real estate so devised in trust to my sonRichard and his Heirs is hereby declared also to be in Trust that thesaid Richard and his Heirs shall after the decease of the said MaryMartha McRa permit my Grandson Powel McRa to inter upon occupy andpossess the said Midway Plantation & devised and described asaforesaid and receive and enjoy the issues and profits thereof duringhis Natural life and after the decease of the said Powel McRa thatthe oldest Male issue of the said Powel shall be permitted to interupon possess and occupy the same and issues and profits thereof himand his Heirs forever; but should there be no such issue Male of thesaid Powel living at the time of his death, then that the eldest Maleissue of my Grand daughter Arabella McRa shall be permitted to enterupon occupy and possess the same and the issue and profits thereofhim and his Heirs forever; and in case there should be such IssueMale of the said Arabella, that the eldest issue Male then living ofmy late daughter Harriot Richardson Spann shall be permitted to enterupon occupy and possess the said premisses him and his Heirsforever.
ITEM- I give and bequeath to my son RichardSingleton his Executors and Administrators the following slaves VizNelly house Servant, her daughter Jude and Betsy daughter of Jude;Maria daughter of Nelly and her Children William a Taylor and Sallyand Margaret, Edmund house servant, Clarender poultry Minder herdaughter Esther, and her Children, Clarenda Jemmy Frank and Merrimanin Trust however for the use and benefit of my daughter Mary MarthaMcRa and for her sole and separate use Not subject to the controls ofher Husband Powel McRa or his debts and contracts of the said PowelMcRa Natural life; and in the farther Trust and confidence that Afterthe decease of the said Mary Martha the said Richard his Executors orAdministratorsshall Afsign and convey agreably to law the Said slavesto my Grandson Powel McRa and my grand daughter Arabella McRa to bedivided between them share and share alike to them and their Afsignsforever.
Item; I give and bequeath all the Negroe Slavesconveyed to me by my daughter Mary Martha McRa by deed bearing datethe fifth day of April eighteen hundred and feventeen together withsuch increase or issue as they may have to My Grandson Powel McRa andmy Grand daughter Arabella McRa to be divided between them share andshare alike if both living or to the Survivor of them should one ofthem have died: And in case they should both die without issue livingat their death then I give the said Slaves to my Grandsons John PeterBrown, Charles Dundus Brown and Robert Henry Brown.
Item: I give and bequeath to my Grandson PowelMcRa and my Grand daughter Arabella McRa the following Horses to witmy Gray Mare from Phyche by Bluebeard her grey Filly by youngBedford, her bay Filly by Rofesccruteon, and my Grey colt from Phycheby Young Buzzard to them share and share alike.
Item: I give my grandson Powel McRa my largedouble barrelled Gun silverMounted with all that belongs to it.&emdash;
Item: I give and devise to my Grandson John PeterBrown all that tract of land laying in the fork of the Congaree andthe Wateree known by the name of the Gear pond tract and Originallygranted to Paul Smiles containing eight hundred and forty Acres tohim and his Heirs forever; but should the said John Peter Brown diewithout issue Male living at the time of his death then in that caseI give, and devise the said tract of land to his Brother CharlesDundus Deas Brown to him and his Heirs and Assigns forever and shouldthe said Charles Dundus Deas Brown die without issue male living atthe time of his death then I give and devise the said tract of landto Henry Robert Brown to him and him Heirs forever. -
Item: I give and devise to my Grandson CharlesDundus Deas Brown all that tract of land in Sumter District on theSantee River, known by the Name of the Cuddoes ponds and Conveyed tome by Hartwell Macon and John R Spann containing by estimation aboutfifteen Acres to him and his Heirs forever; but should the saidCharles Dundus Deas Brown die without male issue living at the timeof this death, then in that Case I give and devise the said land andpremisses to John Peter Brown to him and his Heirs forever, andshould the said John Peter Brown die without male issue living at thetime of his death then I give and desire the said land and premissesto Henry Robert Brown to him and his Heirs forever-
ITEM- I give and devise to Henry Robert Brown andhis Heirs all that tract of land laying between the Wateee River andthe great Road leading from Manchester down by My Summer Residence,bounded on the North by lands belonging to the Estate of Isham Mooreon the South by lands of the Estate of William Richardson deceased,Sir John Cotteton John Dawson, Jacob Belsar, James Singleton andJacob Belsar, buy the River Wateree on the West and the above road onthe East, being the land on which my father first settled in the Yearseventeen fifty two, containing by estimation three thousand Acres;But should the said Henry Robert Brown die without issue Male livingat the time of his death, then in that Case, I give and devise thesaid land and premisses to the oldest Male issue of John Peter Brownhis brother to him and his Heirs; And should the said John PeterBrown die without leaving issue Male living at the time of his deaththen in that case I give and devise the said land and premisses tothe eldest Male issue of Charles Dundus Deas Brown his Brother to himand his Heirs: it being understood as an express condition that suchpersons or person when under the above limitations shall take and usethe Surname of Singleton; And it is also my Will and I do devise thatshould the said Charles Dundus Deas also die without leaving issueMale living at the time of his death then I give and devise the landand premisses aforesaid to the eldest Male issue of my Son RichardSingleton to him and his Heirs forever-
ITEM- I give and bequeath to my grand son JohnPeter Brown all the Horses Cattle and other stock all the waggons andplantation tools and utensels of every kind that May be upon the saidplantation in the fork of the Wateree and Congree Rivers (which Ihave above given to him) at the time of my death.-
Item- I give and bequeath to Charles Dundus DeasBrown all the waggons and plantation tools and Utensels of everykind, all the Horses cattle and other stock that may be upon theabove described plantation of the Cuddoes ponds (which I have givenhim) at the time of my death.-
ITEM-I give and bequeath to Henry Robert Brown allthe Horses cattle and other Stock all the waggons and plantationtools and Utensels of every kind, that may be upon the abovedescribed plantation laying between the Wateree and Great Road (whichI have above devised to him) at the time of my Death.-
ITEM- I give and bequeath to John Peter Brown theGrey filly from Phyche by Bedford, a Sorrel filly the first from thesorrel Bedford Mare; also My old double barrelled Gun silver Mounted,and my short double barrelled Gun steel Mounted; and also my GoldWatch,-
ITEM - I give and bequeath Charles Dundus DeasBrown, a sorrel filly by Buzzard from the Bedford Mare, a bay fillyby Rosecruescian from the same Mare; also a double barrelled GunSilver Mounted purchased for me by Ralf Isaac-
ITEM I five to Henry Robert Brown all the Books inmy Library and also My Sorrel Mare by old Bedford and her sorrelfilly by Rosecrucian.-
ITEM- I give and devise to my Son RichardSingleton and to my Grand sons John Peter Brown, Charles Dundus DeasBrown and Henry Robert Brown all that tract of land laying South ofthe town of Manchester and on the East side of the Great Road leadingfrom Manchester by my Summer residence containing two thousand acresMore or less to them and their Heirs as Tenants in Common and not asJoint Tenants, relying firmly upon My said Children that they willmake a proper provision of part of the said land for a residence inSummer for my daughter Mary and her Children and excepting the devisefor life to my wife Rebecca.-
ITEM- I give and bequeath, to my son RichardSingleton in Trust, for the separate use and behoof of his SisterMary Martha after the decease of my Wife Rebecca the close Pannelledcarriage, her choice of two of the horses that May be used then ascarriage horses and also a saddle horse; and I also give and bequeathto him in Trust as aforesaid one third of all the work horses andMules cattle and all other stock on the said Midway plantation at thedeath of my wife and also one fourth part of the waggons, ploughs andother plantation tools that May be thereon as aforesaid; the saidproperty not to be subject in any manner to the controls or the debtsand contracts of her husband Powel McRa.
ITEM- I give and bequeath to my son RichardSingleton and my Grandsons John Peter Brown, Charles Dundas DeasBrown and Charles Henry Robert Brown the sum of thirty thousanddollars upon the trusts= and to and for the intents and purposesherein after Mentioned expressed and dictated of andconcerning
the same.
ITEM-I give and bequeath to my said son RichardSingleton and my said Grandsons John Peter Brown Charles Dundas DeasBrown and Henry Robert Brown their Executors and Administrators, allthe rest and residue of the negroe slaves of every Description ofwhich I may die possessed, and not herein before bequeathed or thenother wise disposed of, together with all the rest and residue of mypersonal estate not otherwise bequeathed or disposed of; upon thetrusts and to and for the intents and purposes, herein afterMentioned expressed and declared of and concerning the same-
ITEM- It is my will and I do hereby direct thatthe said Richard Singleton, John Peter Brown, Charles Dundas DeasBrown and Henry Robert Brown trustees appointed as aforesaid shallAct in Succession in the Order in which they are Named that is my SonRichard Singleton during his Natural life and upon his death then thesaid John Peter Brown during his Natural life, and then the saidCharles Dundas Deas Brown during his Natural life and then the saidHenry Robert Brown.-
ITEM- It is my will and I do hereby devise anddirect and declare that the said Richard Singleton as Acting Trusteeas aforesaid, shall as soon as possible after my death invest thesaid thirty thousand dollars so bequeathed in thrust in the purchaseof Lands for the purpose of carrying This Trust into effect as hereinafter expressed and declared, and the said Acting Trustee and theirHeirs shall stand seized of such Land and real estate or estates sodirected to be purchased upon the trusts and to the intents andpurposes herein After Mentioned in this will as if they had beenimmediately and expressly devise to them and their Heirs in this willfor the said purpose and Trusts.
ITEM- It is my will and I so devise and directthat the wholeof the estate real and personal so devised andbequeathed as above to Richard Singleton John Peter Brown CharlesDundas Deas Brown and Henry Robert Brown in trust is hereby declaredto be upon Trust that they the said Richard Singleton JohnPeterBrown, Charles Dundas Deas Brown and Henry Robert Brown and theSurvivor and Survivors of them do and shall from Year to Year andfrom time to time during the natural lives of My said son RichardSingleton, Mary Martha McRa John Peter Brown Charles Dundas DeasBrown Henry Robert Brown, John Singleton son of said Richard MarySingleton daughter of said Richard Marion Singleton daughter of saidRichard Angelica Singleton daughter of said Richard; Powel McRa sonof Mary Martha McRa and Arabella daughter of said Mary Martha andduring the Natural lives and life of the survivors and survivor ofthem the said several persons as aforesaid shall in the Order hereinbefore directed superintend and direct the conduct and Management ofthe whole of the said Trust estate and estates real and personal andshall sell and dispose of the Crops and surplus stock and receive theissues and profits of the said estate and estates whether real orpersonal, devised accumulated or purchased and divide and dispose ofthe same as herein afterwards by this will directed.
ITEM-It is my will and I do hereby direct that theslaves so bequeathed in Trust and their issue shall be worked uponthe Lands so purchased under the Trust as above in such Manner and insuch Crops as my Acting Trustee Appointed as aforesaid shall deemMost advantageous, and I will and direct that until the Landsdirected to be purchased for the Trust estate as above shall bepurchased, the Negroe Slaves belonging to the Trust estate shallcontinue to be worked for the benefit of the Trust Estate on theplantation whereon I may leave them at the time of my death it beingclearly understood as part of my will that the slaves and otherproperty given to my wife Rebecca for life shall not be removed or inany Manner interfered with except by her consent until after herdecease.
ITEM- In further declaration of the said Trust Ihereby, will and declare that the said Trust Estate and Estates shallbe and Remain subject to their own expenses and that the Nettproceeds of the Crops and stock collected received & soldtherefrom by the said Acting Trustees of said Trustees shall then bedivided Annually every Year or as soon as * be after the sale of said * * * * * equal lots or shares, the said Richard Singleton shallduring his Natural life retain one third of the said Nett proceedsfor his own use and benefit, and also retain in his hands one otherthird for the sole and separate use of his Sister Mary Martha McRaduring her Natural life as her Trustee and the other one third heshall pay over to his Nephews John Peter Brown, Charles Dundas DeasBrown and Henry Robert Brown to be divided among them share and sharealike during their lives, And in Case of the death of the saidRichard, then the said John Peter Brown or other Acting Trustee shallpay to the Children or lineal descendants of the said Richard onethird of the Nett proceeds of said Trust estate to be divided Amongthe Children or lineal descendants of said Richard, share and sharealike: And after the Death of the said Richard the said John PeterBrown shall retain one third of the Nett Annual proceeds of the saidTrust estate to be divided between the said Trustee and his Brothersor their lineal descendants share and share alike, the Childrenrepresenting the parent after the decease of such parent, when suchdecease shall happen and remaining one third to be paid over to thesaid Mary Martha McRa, or her Trustee, if she is living, And in caseof her decease then to her Children or lineal descendants share andshare alike and in the case of the death of any of the said Childrenleaving children then in that case such issue or Children shallrepresent their parent deceased: And after the death of the saidRichard Singleton, should any of the Children of the said Richard dieleaving children such Children shall in like Manner represent theirparent so deceased.
ITEM- It is my will and I do hereby direct thatwhenever it shall so happen that the lands hereby directed to bepurchased in Trust as aforesaid shall not be sufficient to work thesaid slaves upon to Advantage and more land May be Necessary then inthat case the Acting Trustee of my Trustees shall have power andheirs hereby directed to invest so much of the issues and profits ofthe said Trust estate in the purchase of More lands for that purpose,as in the Judgement of said Acting Trustee May be Necessary; and thesaid Acting Trustee and Trustees shall stand siezed they and theirHeirs of such real estate or estates so directed to be purchased uponthe Trusts and to the intents and purposes herein before of After**************************************** expressly devised to themand their Heirs with the other real estate devised in Trust.
ITEM- It is my will and I do hereby direct thatAfter the decease of the Survivors of the said several persons duringwhose lives the issues and profits of the real estate and slaves andother property divided in Trust or purchased, agreeably to thedirections of this will are directed to be received Managed anddivided by the said acting Trustee or Trustees, then when suchdecease shall happen of the last Survivor of said persons, the wholeTrust estate or estates whether Originally devised or purchased andaccumulated shall be divided into three lots or parts of equal valueor as near thereto as possible, and the lands and slaves and otherproperty contained in one of such Allotments shall be conveyed andassured in Law to the eldest Male lineal descendant then living of mysaid son Richard Singleton to him his heirs Executors andAdministrators forever, and it is hereby declared and directed thatsuch eldest Male lineal descendant shall be entitled to the firstchoice of such allotments; and in case there shall be no such Malelineal descendant them living of my said son Richard then the realestate slaves and other property contained in the said allotmentabove Mentioned shall be conveyed and assured in Law to the eldestMale lineal Descendants then living of my late daughter HarrcotRichardson Spann to him his Heirs Executors Administrators forever;And in case there shall be no such Male lineal descendants thenliving of my said daughter Harrcot Richardson Spann, then it is mywill and I do hereby direct that the said real estate slaves andother property contained in said allotment shall be conveyed to theeldest Male lineal descendant of my daughter Mary Martha McRa to himhis Heirs Executors and Administrators forever.
ITEM- It is my will and I do hereby direct anddevise that the real estate slaves and other property contained inone of the two remaining allotments shall be conveyed and assigned inlaw to the eldest Male lineal descendant of my late daughter HarrcotRichardson Spann then living, who shall have Choice of saidallotment, to him his Heirs Executors and Administrators forever; andin case there shall be no such Male lineal descendants then living ofmy daughter Harrcot Richardson Spann, then the real estate slaves andother property contained in the allotment last above described shallbe conveyed and assined in Law to the eldest Male lineal Descendantof then living of my son Richard Singleton to him his Heirs Executorsand Administrators forever And in case there should be no such malelineal descendants then living of my son Richard Singleton then inthat case it is my will and I do hereby direct that the real estateslaves and other property contained in the said allotment last abovedescribed shall be conveyed and assined in Law to the eldest Malelineal descendant of my daughter Mary Martha McRa to him his HeirsExecutors and Administrators forever.
ITEM- It is my will and I do hereby direct anddevise this the real estate slaves and other property contained inthe remaining third allotment shall be conveyed and assined in Law tothe eldest Male lineal descendant of my daughter Mary Martha McRa tohim his Heirs Executors and Administrators forever; And in case thereshall be no such lineal descendants then living of my said daughterMary Martha McRa in that case the real estate slaves and otherproperty contained in the said allotment shall be conveyed andassined in Law to the eldest Male lineal descendant then living of mysaid son Richard Singleton to him his executors and Administratorsforever; And in Case there shall be no such Male lineal descendantsthem living of My said son Richard Singleton then in that case it isMy will And I do hereby direct that the real estate slaves and otherproperty contained in the said Allotment last above described shallbe conveyed and Assined in Law to the eldest Male lineal descendantof my late daughter Harriot Richardson Spann to him his HeirsExecutors and Assigns forever.
ITEM- It is my will and I do hereby direct anddevise that should it so please God that at the time of the death ofthe Survivor of the said several persons during whose lives theissues and profits of the real estate, slaves and other propertydevised in Trust or purchased agreeably to the directions of thiswill are directed to be received Managed and directed by my saidActing Trustee and Trustees there should be a failure of male linealdescendants in the whole of the said three ranches of my family(which I hope and pray to God may not be the case) that is to say ofmy said son Richard Singleton of my late daughter Harriot RichardsonSpann and my daughter Mary Martha McRa, then in that case I herebydevise and direct that the whole of the said Lands slaves and otherproperty hereby devised in Trust as aforesaid purchased orAccumulated under said Trust shall be divided into three parts ofequal value or as nearly thereto as possible, and the said allotmentsshall be conveyed to the eldest female lineal descendants of my saidson Richard Singleton, my late daughter Harriot Richardson Spann andMary Martha McRa in the same Manner with the same preference andpreviledge of Choice as herein before directed with respect to theeldest Male lineal descendants of the said Richard Singleton, HarriotRichardson Spann and Mary Martha McRa to be conveyed and assined tothem their Heirs Executors and Administrators respectively in likeManner forever, with crops remainder between and among the saidseveral eldest female lineal descendants in the same cases andcontingences and in the same Manner and order as herein beforedirected with respect to the eldest Male lineal descendants of thesaid branches of my family.
ITEM- It is my will and I do hereby further deviseand direct that from the time or times any of the Male linealdescendants of my said son Richard Singleton or my daughter HarriotRichardson Spann*************************************************************************Allotments of the aforesaid estates and premisses as well thosedevise as those purchased or Accumulated under the Trust He and theyand all claiming under him or them respectively, when and being ofthe Age of twenty one Years or upwards shall from thence forthHereafter at all times severally and respectively take and Use theSurname of Singleton only, and in default thereof I do hereby willand direct that such persons so refusing shall forfit all claimwhatsoever in Law or equity to any part of the said Trust estate orestates real or personal and I do hereby order and direct and will,that all such estate devise purchases or accumulated under the Trustin this Will and contained in such Allotment, shall then be conveyedand assined in law to the Next eldest male lineal descendant of thatBranch of my family if any such be living, who shall take on the samecondition, and if there shall be None such then such allotment shallgo over and be conveyed by my Trustee or Trustees in the same Manneras herein before directed in this will in the case in which thereshould be no Male lineal descendant living of that Branch of myfamily.
ITEM- It is my will and I do devise and directthat the Person Acting as Trustee under this Will shall not be liableto Any suits in law, or damage for any accidents whatsoever or errorsof Judgement.
ITEM- Whereas the said Richard Singleton, JohnPeter Brown, Charles Dundas Deas Brown and Henry Robert Brown may alldie before the Trust above mentioned would expire of its ownlimitation then it is my will and I do hereby direct that properApplication be Made to the Court of Equity to Appoint a trustee fromamong the blood or branches of my family.
ITEM- Whereas I have acted as the Guardian of myGrandsons John Peter Brown, Charles Dundas Deas Brown and HenryRobert Brown and managed the property of the estate of their Fatherand Mother in the Manner I thought Most conductive to their Interest.Now is my will and I do hereby declare devise and direct that shouldthey or any of them bring suit in Law or equity against my Executorsor representatives on account of any transaction or Management ofMine relating to the same such person of them shall forfit all claimunder this will to any Devise Legacy or interest containedtherein.
ITEM: And whereas from the peculiar andunfortunate situation of my daughter Mary Martha McRa I am compelledto take charge of her property, It is my will therefore that shouldshe or any persons claiming through or under her being any suit inLaw or Equity against my Executors for any thing arising out of myManagement of said property, them in that case she and all claimingunder or through her shall forfit all benefit and advantage, deviseor Legacy contained in or derived from this will.
