The State of South Carolina-
In the name of God Amen: I Peter Mellet ofClaremont County in the State of South Carolina aforesaid planter,being in health of body and of sound and disposing mind, memory andunderstanding, praised be God for the same, do make this my last Willand Testament in manner following: I give and bequeath to my belovedwife Margaret Mellet, one Negro woman slave named Cate, and a Negrofellow named Jacob, Also a negro boy named Tom and a negro girl namedSabinah, to be at her disposal for the maintenance of herself andheirs of her body by me during her natural life, and at her deceaseto revert to my Estate; Also the House and plantation whereon I nowlive with the furniture and plantation tools belonging thereto,horses, cattle, hogs sheep, and stock of every kind belonging to myestate at the time of my decease, I will that they may be continuedand made use of on the plantation the same as in my life time, by mybeloved wife for the support of herself and heirs of her body by meduring her life or widowhood, and at her decease or marriage torevert to my estate, I farther bequeath to my said Wife her choice ofone bed and furniture, one horse saddle and bridle, to her and herheirs forever. I Will and empower my wife as executrix, and one ormore of my executors hereafter named, or in case of the death of oneor more of them, the survivor or survivors to sell and dispose of thetract of land I now live on, containing by the original plat sixhundred and forty acres, Also the adjoining tract containing onehundred and fifty acres which I purchased of Stephen Nixon, and tomake good and sufficient titles to any purchases should they thinksuch sale for the benefit of my estate; and should they not disposeof the said lands, I give and devise the same to my two sons Richardand James Mellet to be equally divided between them share and sharealike, then and in such case I Will and bequeath to my daughterMargaret Mellet a Negro girl named Chloe, and to my daughter AnnMellet a Negro girl named Abby, and their future ifsue and increase,to them their heirs and afsign forever- The tract of land containingfour hundred acres more or lefs, which I bargained to William MayrantI Will and empower my executrix, and executors as above stipulated tomake good and sufficient titles to, on the said William Mayrantscomplying in a reasonable time with our agreement, otherwise torevert to my Estate- I Will and ordain that all my negros (exceptthose bequeathed to my two daughters in case the land should not besold, and those bequeathed to my wife during her natural life whichare not to be divided until her decease) may be equally dividedbetween my four children by my present wife, their respective sharesto be delivered to the males when they attain the age of twenty oneyears or day of marriage, and to the females when they attain the ageof eighteen years or day of marriage, should any of my four childrenabove mentioned depart this life before marriage, or attaining to theage of twenty one years, then the portion or part devised orbequeathed to such child or children, to be equally divided betweenthe survivors- I Will and bequeath to each of my four children, abovenamed, one feather bed and furniture. As my son John Mellet, and mydaughter Rebecka Barden have heretofore by certain deeds of giftreceived their respective portions of my estate, I Will and bequeathto them five shillings each and no more. I Will that my sister Marthabe supported out of my Estate as hereto during her natural life,provided she continues on my plantation in the house she nowoccupies, or wheresoever my wife and executors may think proper- AndI do hereby nominate constitute and appoint my loving wife MargaretMellet executrix, and Henry Haynsworth and John Horan executors ofthis my last Will and Testament, hereby revoking and making void allformer Wills and Testaments at any time heretofore by me made, and dodeclare this to be my last Will and Testament. In Witnefs whereof Ihave hereunto set my hand and seal this seventh day of September inthe year of our Lord one thousand seven hundred and ninety nine, andin the twenty fourth year of the independence of the United States ofAmerica
