WILL OF THOMAS HUMPHRIES

 

In the name of God, amen. I Thomas Humphries ofthe State of South Carolina, and District of Sumter, Planter andminister of the Gospel, being sick and weak in body, but of Sound anddisposing mind, memory and understanding, Praised be God for theSame, do make and declare this my last will and testament in mannerand form following; that is to say, I give and bequeath unto mybeloved wife Elizabeth these three negroes, following, to wit, Paddy,Charlotte and Isaac, also the sum of three thousand dollars to becollected from my debtors and paid over to her by my executorsimmediately after my death; also I give and bequeath unto my saidwife Elizabeth all my Stock of horned Cattle, my Library, the wholeof my household and kitchen furniture, my carriage and two horses tobe purchased by my executors for her immediately after my death--thewhole of the aforesaid Negroes money Stock, furniture, carriage,horses I give and bequeath unto my said Wife Elizabeth, forever to bedisposed of at her discretion. Also I give and bequeath unto My saidWife Elizabeth the use of my house wherein I now reside so long asshe wishes it, also my outbuildings adjoining it.---I give andbequeath unto my son John, my waggon & harnefs, all of my horses,my gun and all my stock of hogs more or lefs: also I give andbequeath unto my said John & for his use and benefit, the amountin cash of a Bond of Robert Campbell and a note of Cornelius Joiner,to be applied to the erection of a mill or mills on a certain tractof land which I have given by Deed to my said son John, the saidmoney to be collected by my executors and applied asaforesaid.

I give and bequeath unto my son in Law GabrielCapers, one thousand dollars to be collected from my debtors and paidimmediately after my death: also I give unto my said son in LawGabriel Capers my sulkey and harnefs.

I give and bequeath unto my son in Law, SamuelWragg Capers, five hundred dollars, to be collected from my debtorsand paid immediately after my death.

I give and bequeath two hundred dollars for thepurpose of aiding in the building of a Methodist Church in theneighbourhood where in I now reside.

I give and bequeath unto my grand children,William and Thomas Humphries Snow, all my lands in Marion District,situate between the waters of Pee Dee and Lynches Creek--to them& their heirs forever I give and bequeath the said lands.

It is my will and desire that my executors do makesale of a certain tract of land which I own in Darlington District& that the monies arising from such sale be equally dividedbetween my three children Ann Snow Capers. John Humphries &Frances Rebecca Humphries.

I give and bequeath unto my wife and children andgrand children a suit of mourning each to be purchased by myexecutors, and distributed accordingly.

I give and bequeath unto my Daughter Ann SnowCapers, my son John and my daughter Frances Rebecca, after all myjust debts are paid all the rest, residue and remainder of my estateand the money due from my debtors-the whole to be divided equallybetween them share and share alike.

Lastly, I do hereby nominate, constitute andappoint my Sons in Law Gabriel Capers, Samuel Wragg Capers and my sonJohn Humphries, Executors of this my last Will and testament; herebyrevoking and making void all former or other will and wills by memade: and do hereby declare this to be my last will and testament. Intestimony whereof I have hereunto set my hand and seal this third dayof October in the year of our Lord one thousand eight hundred andtwenty and in the forty fifty year of American Independence.

A Codicil. Whereas I Thomas Humphries of the Stateof South Carolina and District of Sumter have made and duly executedmy last will and testament in writing bearing date with this codicil,do hereby in addition to what is expresed in the said my last Willand Testament confirm and establish the Several Deeds of Land andnegroes which I have given to my children, Ann Snow Capers, JohnHumphries, and Frances Rebecca Humphries-It is my last will anddesire that they my said children do hold & pofsefs the saidlands & negroes according to the true meaning and intent of theDeeds which I have signed & delivered to my said children.--alsothe land & negro girl Louisa which I have given by Deed to mygrandson Samuel Elizabeth Capers I desire & will to be his,according to the true meaning & intent of the Deed Signed; &Delivered to Samuel Wragg Capers, the Father of the Said SamuelElizabeth Capers. In testimony whereof I have hereunto set my handand seal this third day of October, anno Domini one thousand eighthundred and twenty and in the forty fifth year of AmericanIndependence.
