In the name of God Amen, I James Benson of theState of Georgia and County of Jones being weak of body but ofperfect mind and memory and calling into mind the mortality of mybody and knowing that is is appointed unto man Once to die, do makeand ordain this my last will and testamint, viz, first. I commend mysound in to the hands of God who gave it and my body to the earth tobe buried in a decent christian burial at the discretion of myexecutors and as touching such worldly Estate as it have pleased Godto bless me with, I give, bequeath, demise and dispose of the same inthe following manner and form, viz, It is my wish that al my lands inS County be Sold immediately if it can be done advantageously and ifit can not, as soon as it can after another crop is made and that mypresent crop of cotton with all the stock that can be spared be Soldas soon As possible, and the crop that may be made the present yearif the land can't be sold, and when the land is sold with al thestock and all debts collected that is due me and all paid that is duefrom me, then it is my wish that an Equal division be made betwixt mybeloved wife and heirs of my son James H. My daughter Rebeckah,Elizabeth, Aretta and Jemima, with the following excepts I hive tothe children of my son James a childs part of my Estate to be at hisservice and use but the right never to be conveyed out of theirreach, and to his son, my grandson Jesse Shadrack the sum of fivehundred dollars over and above and that my daughter Rebeckah have herproportion of my Estate in money and not to have any part of mynegroes, and that my daughter Mary Tisdale be paid or allowed anEqual part in money with the rest of my children after deducting fivehundred dollars which it is calculated she has already received andit is my wish that my Executors do use their own discretion inEmploying an overseer and keeping the stock making a crop and doingwith and for my Estate the present year as they may think most to thebenefit of the same. And I do hereby nominate and appoint my trustyfriends Lazarus Battle, Luke Bowd, Jesse McKennie Pope Emund Lowe,John Cook & Peter Cyche the sole Executors of this my last willand testament. In Witness whereof I have hereunto set my hand &seal this tenth day of February in the year of our Lord 1817.
