Melissa J. PETCHER, wife of Jerome, protested the sale, claimed
the title wasn't good because it wasn't recorded until six months
after the mortgage. She also claimed she purchased the property
at the sale for $330 and was the highest bidder; however, George
ANGEL refused to acknowledge her and resold it for less. She
further claimed there had not been any default on the note and
she had made arrangements to pay for the purchase.
George ANGEL claimed Jerome PETCHER and his then wife Catharine
(d/o George ANGEL) purchased the property in 1882 and he (George)
had provided the money. A deed was conveyed to Catharine but never
recorded. Upon his daughter's death bed, she asked for it not to be
recorded, but instead to be conveyed to her husband Jerome PETCHER,
the father of Ettie E. PETCHER.
A deed was then issued to Jerome in Jan 1883 by the Etzlers and the
mortgage at the same time and both were filed timely.
The court ruled that Melissa, the current wife of Jerome, pretended to
bid, but never provided the $50 deposit required and she also stated she
didn't know if she could get the money.
Further, if the title was for the the first wife, then Jerome would only
have a life estate and the child would have the land upon the death of
her father. The court overruled the objections and ratified the sale.
