Will of Ann MacCubbin

Ann MacCubbin,
Book 6, 21 Jan 1791

"In the name of God Amen, I Ann Maccubbin of Baltimore County in the State
of Maryland, being greatly indisposed and weak in body but of sound and
disposing mind memory and understanding and being desirous to settle my
worldly affairs and thereby be the better prepared to leave this world when
it shall please god to call me hence do make and publish this my last will
and testament in manner and form following that is to say first and
principally I commit my soul into the hands of Almighty God and my body to
the earth to be decently buried at the discretion of my Executor herein
after named and I devise and bequeath as follows,  I give and devise unto
Zachariah Maccubbin son of my late Husband Zachariah Maccubbin deceased, a
tract of Land Lying in Baltimore County aforesaid known by the name of
Garden originall: granted unto my Brother William Otty deceased to him the
said Zachariah Maccubbin and his heirs in fee simple
Item  I give and devise unto said Zachariah Maccubbin all my right title
claim and Interest that I may be possessed of or any wise entitled to, the
Land lately possessed by and belonging to my brother William Otty, deceased
or all the compensation that I may be entitled to under the law of the State
as discoverer of the said Land being subject to confiscation, to the States
late agent; to him the said Zachariah Maccubbin his heirs and assigns for
ever and it is my will and desire that if any of the last mentioned and
devised Land shall be recovered by said Maccubbin his heirs or assigns or
any compensation made or recovered of the state by my disclosing the same,
as confiscated property and Ann Otty of Great Britain, wife of my late
brother William Otty should be living in that case I give and bequeath to
the said Ann Otty one half of the clear worth of said Land or the
compensation recovered aforesaid either the land to be Sold by the said
Maccubbin his heirs or assigns at their discretion, or the value thereof
ascertained by some one two or three persons to be chosen for that purpose
and the money arising from said valuation or sale to be transmitted to the
said Ann Otty by the said Maccubbin his heirs or assigns but in case she the
said otty should be dead then the said Land or compensation aforesaid to
belong to the said Maccubbin as devised above (the name of her brother could
be Olty)
Item  I give and bequeath unto the said Zachariah Maccubbin all my Right and
Estate of every kind whatsoever which I may be entitled to under the law of
this State by the death of my late Husband Zachariah Maccubbin Senr. to him
and his heirs except what is herein after otherwise disposed of.
Item  I give and bequeath unto my Step daughter Sarah Maccubbin one hundred
pounds part of a debt loaned by me to the united States about the month of
March 1777 in equal proportion of principal and Interest now due to be paid
by my Executor when recovered as also my two small chests of drawers-
Item  I give and bqueath unto my Step daughter Deborah Dorsey twenty five
pounds part of said loan to be paid her by my Executor in equal proportion
of principal and the Interest now due when recovered and her own receipt
Shall Exonerate my Executor-
Item  I give and bequeath unto my Step daughter Ann Maccubbin one hundred
pounds part of said loan in equal proportion of principal and the Interest
now due to be paid when recovered by my Executor as also my large Chest of
drawers-
Item  I give and bqueath unto my Step daughter Mary Dorsey twenty five
pounds part of said loan, in equal proportion of the principal and Interest
now due to be paid to her by my Executor when recovered whose receipt shall
be a good discharge for said Legacy
Item  I give and bequeath to my said Stepdaughters, to wit Sarah and Ann all
my wearing apparel of every kind whatever that I may be possessed of at the
time of my death, also it is my will and desire that my Silver Watch and Bed
and furniture shall remain where they are subject to the joint use of my two
Stepdaughters last named so long as they live with their Brother and remain
unmarried or either of them and after their death or marriages which shall
first happen I give and bequeath the said watch Bed and Furniture to my Step
Son Zachariah Maccubbin his heirs and assigns.
Item I give and Bequeath unto said Zachariah Sarah and Ann all my plate, to
be Equally divided among them.
Item  I give and bequeath unto said Zachariah Maccubbin the remainder of the
aforesaid loan both principal and Interest and all the rest and residue of
my Estate and it is my will and desire that the said Zachariah Maccubbin
shall pay unto the several legatees all the gifts and bquests herein
Bequeathed agreeable to the true intent and meaning of this my last will and
testament, otherwise every devise and bequest herein made him shall be null
and void and the Land and Estate devised and bequeathed unto him shall be
the right and Estate of my two Step daughters Sarah and Ann Maccubbin.
And Lastly I do hereby Costitute and appoint my Stepson Zachariah Maccubbin
to be Sole Executor of this my last will and testament.  I do hereby forbid
any administration other than the said Zachariah Maccubbin shall give Bond
to pay all just Debts if I should have any, and pay the Legacies herein
bequeathed.  In Testimony whereof I have hereunto set my hand and seal this
twenty first day of January one Thousand Seven hundred & ninety one?

who at her request and in her presence
have subscribed our names as witnesses
