"To all People n home this Present writing may come know ye that I Edward
Fell of Over Killet in the County of Lancaster haveing Occation for to Travell
to London and over Sea to Maryland as I have had and done often before now and
haveing the uncertainty of my time in this World in my mind and the length of
Journey and leaveing my only Child behind me and as I am now in good health and
sound Memory and do think it very proper and convenient for to settle all my
Worldly Concerns here as far as I am capable before I do go from this Country
and therefore I do hereby publish and declare this to be my last and only will
as followeth viz: Imprimis I give and bequeath unto my only daughter Ann Fell
all my lands and Houses and Houseings lyeing or being at or about this Town or
any where in Great Britain and to the her? heirs of her body lawfully to be
begotten but on failure of such heir and after her my said daughter's decease,
Then I do give and bequeath all my lands afore named !
unto my Brother William Fell Son and to his heirs in case he will come to this
Town and live at this Town all his time after he doth inherit and pay out of the
same the Sum of Six hundred Pounds British money unto my Brother Henry Fells
Children the Sum of Three hundred Pounds equally to be divided amongst them but
my said Brother for to have the Interest thereof yearly so long as he doth live
and unto my Sisters Margarett Holme's Children to pay to them the Sum of Three
hundred pounds to be equally divided amongst them but my said Sister for to have
the Interest thereof payed to her so long yearly as she may live. I give and
bequeath unto my Brother William Fell's younger Children all my Lands in
Maryland and to their heirs Joyntly in case my Child decease without heir Male
but in case my Child do Survive as I am in good hope she may live to be a woman
and have Children then my will is that whereas I am pr.? my bond to pay Richard

Abbigail Yeats of Lancaster Two hundred pound which two Sums I do hereby Order
my Executors fo to pay off as soon as they may be able with what goods I have
sold or they may make Sale of and out of the Rents of the land over and above
what may maintain my Child I would not have any of my Household goods sold
except Perishable goods but kept for her and if my Child do live to be a woman
and have issue then I give and bequeath unto my Brother Henry's Children the Sum
One hundred and fifty pounds equally to be divided amongst them and the Interest
arising thereof to be payed unto my said Brother yearly so long as he doth live
and I give and bequeath unto my Sister Margarets Children to be equally divided
amongst them the Sum of one hundred and fifty pounds the interest thereof to be
payed to my Sister as long as she do live those two Legacies above I order to be
payed out of my Traiding Stock which I no!
w have in Maryland or am taking with me there and not out of my Lands in case my
Child do live to be and and for the Education and well bringing up of my Child
and the Execution of this my will I do hereby Nominate and appoint my Friends
William Backhouse of Over Killet in the County aforesaid and Jonathan Headley of
Darlington in the County of Durham my Executor or Executors in Trust with my
Child and Estate and them I will at all times take care of the good Education of
my Child and the well disposing of and if one of them should be taken away by
death or both of or either of them be Removed then I do hereby request and
desire nominate and appoint the Monthly mooting of my friends at Lancaster
called Quakers for the time being for to elect appoint and choose one or more
for to be and remain as Executors in Trust with my Child and Estate during her
non age and that the said Mooting if they will at my request take the Trust I do
hereby fully declare that in such case they ma!
y have full power and authority for to choose nominate and appoint Executors as
aforesaid and at their pleasure to revoke and rechoose any other once every Year

Tetsament in the Presence of us who Subscribed our Names as Witnesses in the

master keeper do by these presents make known to all Men that on the Twenty
Sixth day of March in the year of our lord one Thousand Seven hundred and Forty
three at London before the Worshipfull Robert Chapman Doctor of Laws Surrogate
to the Right? worshipfull John Bettesworth also Doctor of Laws master Keeper or
Commissa? of our prerogative Court of Canterbury lawfully constituted the last
will and Tetsament of Edward Fell late of Over Killet in the County of Lancaster
deceased hereunto annexed was proved approved and Registered the said deceased
having whilst living and at time of his death goods chattels or Credits in
divers diosesses or Jurisdictions by ? whereof the proving and Registring the
said will and the granting administration of all and Singular the said goods and
Chattels and Credits and also the auditing and final discharging the Accompt
thereof are well known to appertain only &? ho!
lly to us and not to any inferior Judge and that administration of all and
Singular the Goods Chattels and Credits of the said deceased and any way
concerning his will granted to William Backhouse and Jonathan Hedley, the
Executors named in the will they having first made a Solemn and Sincere
declaration or affirmation ? of Parliament well and Faithfully to administer the
s? and to make a True and perfect Inventory of all and Singular the ? said goods
Chattels and Credits and exhibit the same unto the Registry of our said Court on
or before the last day of September next ensuing and also to render a just and
true accompt thereof Given at the time and place above written and in the
Seventh Year of our Translation
