Joseph Cassell
(Jan 1781 – Dec 1867) is the son of Jacob Cassell of Pipe Creek,
Carroll Co. MD. Joseph lived in
Baltimore city and married Ann Matthews in
1802. She died in Oct. 1816, leaving six small children.
He then married Rebecca Jane Ing in 1817.

I, Joseph Cassell of the city of Baltimore in the state of Maryland do make and publish this my last will and testament, in manner and form following.
First, I commit my soul into the hands of Almighty God and my body to the earth to be buried by my Executrix herein after named.
Second, I direct all my just debts and funeral expenses to be paid out of my estate by my said executrix.
Third, I give, devise and bequeath unto my dear wife ,Rebecca Jane Cassell, to her own sole and separate use, the dwelling house and premises No. 280 Saratoga Street in the city of Baltimore in which I now reside and the lot of ground on which the same is erected together with all the household and kitchen furniture, goods, property and effects including my carpenter tools which shall be in, on, or about said house and premises; also a yearly ground rent of twenty two dollars reserved on a lot of ground on the east side of Light St. between Hamburg and Cross streets in the City aforesaid and all my estate, interest and reversion in the lot of ground out of which said rent issues, also one other ground rent of fifteen dollars reserved on another lot of ground situated on the west side of Abey Alley in the said city and all my estate interest and reversion in said lot of ground, out of which said yearly rent issues; also one other yearly rent of ten dollars reserved on another lot of ground situate on said west side of Abey Alley and all my estate, interest and reversion in said lot of ground last mentioned, also one other annual ground rent of twelve dollars reserved on another lot of ground on the north side of Sarah Ann Street, between Pearl and Pine Streets in the City of Baltimore and all my estate interest and reversion in said lot of ground on Sarah Ann Street, and I also give to my said wife to her own sole and separate use five hundred dollars in cash. And I expressly declare the above devises and bequest to my said wife to be in lieu of her dower and thirds in all my estates and property.
Fourth, I give to my son Henry P. Cassell the sum of sixty dollars.
Fifth, I give to my son, John S. Cassell the sum of sixty dollars.
Sixth, I give to my son, Edward A. Cassell the sum of sixty dollars.
Seventh, I give to my son, George R. Cassell the sum of sixty dollars.
Eighth, All the rest, residue and remainder of my estate, real, personal and mixed including the principal sums of money without interest thereon due and owing to me by my sons at the time of my decease, I will and direct shall be divided by my executrix into thirteen equal parts, one equal part where of I give and devise to my son, Leonard Cassell, subject to the payments by him of the sum of four hundred and fifty dollars without interest owing by him to me; one other equal part whereof I give to my daughter in law, Rebecca Cassell, wife ofmy son Abraham Cassell, to her own sole and separate use with the power to her to receive sell and dispose of the same in any manner in her discretion as she could were she a femme sole; one other equal part whereof, I devise and give to my daughter, Elizabeth Thompson to her own sole and separate use with power to her to receive, sell and dispose of the same in her discretion in any manner as she could were she a femme sole: one other equal part whereof I give and devise to my daughter, Mary Jane Derr to her own sole and separate use with power to her to receive, sell and dispose of the same in her discretion in any manner; one other equal part whereof I give and devise to my son, Samuel Cassell; one other equal part whereof I give and devise to my son Joseph F. Cassell, subject to the payment by him of the sum of two hundred and seventy dollars without interest owing by him to me; one other equal whereof I give and devise to my son George R. Cassell; one other equal part whereof , I give and devise to my son Henry P. Cassell; one other equal part I give and devise to my son John S. Cassell subject to the payment by him the sum of one hundred and twenty four dollars without interest owing by him to me; one other equal part whereof I give and devise to my son, Thomas D. Cassell subject to payment by him the sum of five hundred dollars without interest owing by him to me; one other equal part whereof I give and devise to my daughter Olivia Ann Alexander, the wife of Andrew Alexander of Carroll County, Maryland to her own sole and separate use with power to her to receive , sell and dispose of the same in her discretion in any manner she could were she a femme sole; one other or equal share whereof, I give and bequeath and devise to my daughter Emily Rebecca Forney, the wife of Dr. Cornelius W. Forney, of Hanover, Pennsylvania to her own sole and separate use with power to her to receive, sell and dispose of the same in her discretion in any manner as she could were she a femme sole; and I hereby release all my sons from the payment of any interest on any sums of money owing by any of then to me at the time of my decease; and I give and devise the remaining equal part or share of my said estate to my son Edward A. Cassell, subject to the payment by him of the sum of five hundred dollars without interest owing by him to me.
Ninth, I hereby give and devise to my executrix all and every right, title interest and estate and all and every power and authority requisite to convey and assign by deed, assignment or otherwise how so ever to be by her duly executed and acknowledged, to each of my children and devises aforesaid, the property estate and share of my said estate aforesaid which may fall and be allotted to him or her respectively in the division and allotment of my estate as aforesaid.
Lastly, I hereby nominate constitute and appoint my said wife, Rebecca Jane Cassell, to be sole executrix of this my last will and testament, revoking and annulling all former wills by me heretofore made, ratifying and confirming this and none other to be my last will and testament.
In testimony whereof ; I hereunto set my hand and affix me seal this eighteenth day of December in the year of our Lord one thousand and eight hundred and sixty five.

Baltimore City; On the fourth day of January 1867, came Rebecca Jane Cassell and made oath on the Holy Evangely of Almighty God that she doth not know of any will or codicil of Joseph Cassell, late of said city deceased, other than the above instrument of writing, and that she received the same from the Testator on or about the 18th day of December 1865.
