Upton Bruce sells
land to Henry WRIGHT. The following deed was recorded the 30th day of
August 1810.
THIS DEED made this 8th day of March in the year of our
Lord, 1810, between Upton Bruce, Elizabeth Key Scott and John Scott, her
husband, now all of Frederick County, in the State of Maryland of the one part,
and HENRY WRIGHT of Allegany County and state aforesaid, of the other part.
WITNESSETH whereas Susanna Gardner Bruce, deceased, late of Frederick
County, mother of the aforesaid Upton Bruce and Elizabeth Key Scott was seized
and possessed of and held and owned a tract or parcel of land lying in Allegany
County and state aforesaid (except one acre which she, the said Susanna had
heretofore conveyed to a society for religious uses) called Walnut Level
containing 390 acres originally, and patented to John Ross of Anne Arundel
County, on the 10th day of August, 1753 Allegany County being then a part of
Frederick County and whereas the said Susanna G. Bruce died intestate, leaving
as heirs the aforesaid two children, Upton and Elizabeth, who inherit her
property and on _____ of cause the right to aforesaid tract or parcel of land
called WALNUT LEVEL decends and devolves (?). Now therefore, they the said Upton
Bruce and Elizabeth Key Scott, by virtue of the power and the right so derived
and John Scott the husband of the said Elizabeth, and for and in consideration
of the sum of $1600.00 current money of the United States to them in hand paid
by the said Henry Wright, before the sealing and delivery of these presents, the
receipt whereof they the said Upton Bruce, Elizabeth Key Scott and John Scott,
doth hereby acknowledge and from every part and parcel thereof doth hereby
acquit, exonerate and discharge the said Henry Wright, his heirs, executors and
administrators, they the said Upton Bruce, Elizabeth Key Scott and John Scott,
have granted bargained, sold, aliened, enfeoffed and confirmed and by these
presents doth give grant bargain, sell, alien, enfeoff and confirm unto the said
Henry Wright his heirs and assigns forever, all that tract or parcel of land
called WALNUT LEVEL, except the one acre as before excepted, now lying in
Allegany County and patented as aforesaid to John Ross on the 10th day of August
1753 for three hundred and ninety acres, and all the estate, right, title and
interest whatsoever of them the said Upton Bruce, Elizabeth Key Scott and John
Scott her husband, both at law and in equity, of in to and out of the said tract
or parcel of land and premises hereby bargained and sold, and every part and
parcel thereof so as aforesaid, devised to them the said Upton, Elizabeth and
John her husband, and acquired as heirs to the aforementioned Susanna G. Bruce,
and such and the same as she the said Susanna that and was possessd? of
reference being had to the _____ conveying the same to her will more fully
appear. TO HAVE AND TO HOLD the aforesaid tract or parcel of land and premises
unto him the said Henry Wright, his heirs and assigns forever and to and for no
other use intent or purpose whatsoever, and the said Upton Bruce, Elizabeth Key
Scott, and John Scott for themselves and their heirs do hereby convenant, grant,
promise and agree to and with the said Henry Wright his heirs and assigns to
warrant and defend to him and them the aforesaid tract or parcel of land and
premises, except as before excepted, as well against the said Upton, Elizabeth
and John and their heirs as against all persons claiming or to claim and or
them.
IN WITNESSETH whereof the said Upton Bruce, Elizabeth Key Scott and
John Scott have hereinto subscribed their names and affix their seals the (day?)
and year first herein before written.

Be it remembered
that on this 8th day of March 1810 personally appears Upton Bruce and John
Scott, two of the party grantors within named, before us the subscribers two
justices of the peace for the County aforesaid, and acknowledged the within deed
or instrument of writing to be their act and deed, and the land and premises
therein mentioned and thereto bargained and sold, to be the right and estate of
the within named Henry Wright, party grantee also therein named, his heirs and
assigns forever, according to the true intent and meaning of the said deed or
instrument of writing, and the acts of assembly in such case made and provided,
And now at the same time personally appears Elizabeth Key Scott, wife of the
said John Scott, before us, the two Justices aforesaid, and acknowledges the
said deed or instrument of writing to be her act and deed and the land and
premises therein mentioned to be the rights and estate of the within named Henry
Wright, his Heirs and assigns forever, and the said Elizabeth Key Scott being
examined by us privately and apart from and out of hearing of her husband,
whether she doth make her acknowledgement of the same willingly and freely,
declared she did the same willingly and freely and without being induced thereto
through threats or ill usage of or through fear of incurring the displeasure of
her said husband - at the same time came also Sarah, Wife to the said Upton
Bruce, and being by us examined separate and apart from and out of the hearing
of her said husband, relinguished her right of dower in and to the within land
and premises unto Henry Wright his heirs and assigns and acknowledged and
declared she did the same voluntarily and freely and willingly and not through
threats or ill usage of or fear of incurring the displeasure of her said
husband. Taken and Certified the day and year above written. Thos. Jones and

State of Maryland Frederick County - I hereby certify that
Thomas Jones and Joseph Little, Gentlemen, before _____ the acknowledgements of
the foregoing deed or instrument of writing appear to have been made and who
have thereto subscribed their names were at the time thereof Justices of the
Peace in and for the County aforesaid duly commissioned and sworn.
In
Testimony whereof I have hereto subscribed my name and affixed the seal of
Frederick County Court the 12th day of March in the year 1810. Signed by William

The following deed
was recorded October the 30th 1826.
THIS INDENTURE made this 22nd day of
July 1826 between Isiah Frost and Sarah Frost his wife, formerly Sarah Neff and
Thomas Wright and Elizabeth Wright his wife, formerly Elizabeth Neff and William
Wright and Susannah Wright his wife, formerly Susannah Neff and Elisha Combs and
Annay Combs, his wife, formerly Elizabeth Neff [Elisha Combs first married Anna
Neff. At some time after this indenture, Anna died, as did her brother Jacob.
Then Elisha married Elizabeth Hoffman Neff, Jacob's wife.], of Allegany County
and State of Maryland of the one part and John Neff and Jacob Neff of the county
and state aforesaid of the other part.
WITNESSETH that the said Isiah
Frost and Sarah his wife and the said Thomas Wright and Elizabeth his wife and
the said William Wright and Susannah his wife and the said Elisha Combs and
Annay his wife, for and in consideration of the sum of $800.00 current money of
the United States to them in hand paid by the said John Neff and Jacob Neff
before the sealing and delivery of these presents the receipt whereof they the
said Isiah Frost and Sarah his wife and the said Thomas Wright and Elizabeth his
wife and the said William Wright and Susanna his wife and the said Elisha Combs
and Annay his wife doth hereby acknowledge and from every part and parcel
thereof doth hereby acquit, exonerate and discharge the said John Neff and the
said Jacob Neff their heirs, executors and administrators they the said Isiah
Frost and Sarah his wife and Thomas Wright and Elizabeth his wife and William
Wright and Susannah his wife and Elisha Combs and Annay his wife, have granted
bargained sold aliened enfeoffed and confirmed and by these presents do grant
bargain sell alien enfeoff and confirm unto the said John Neff and Jacob Neff
their heirs and assigns all their right title interest and claim as heirs at law
of John Neff late of Allegany County, deceased unto four ninth parts of the
following lots and parcels of land situate lying and being in Allegany County
Westward of Fort Cumberland, to wit: Lots 3500 and 8530 580 6350 and 8735
hundred and 8835 hundred and 8935 hundred and 9035 hundred and 91 [See lots
below. There is a problem with the lots listed above. Those below are consistent
with the lots occupied by John Neff at the time of Deakins Survey - 1788]
containing 50 acres which said lots patent to John Neff, late of Allegany County
deceased on the 16th day of October 1801 together with all and singular the
buildings, Improvements, woods, ways water courses rights liberties privileges
heridements and appertances whatsoever belonging or in anywise appertaining and
the reversions and remainders unto ____ and profits thereof and all the estate
right title interest and claim whatsoever of them the said Isiah Frost and Sarah
his wife and Thomas Wright and Elizabeth his wife and William Wright and
Susannah his wife and Elisha Combs and Annay his wife both at law and equity of
in to and out of the said lands and premises hereby so as aforesaid described as
by whatsoever name the same may be called together with all and singular the
buildings and appurtanances and all and singular other the premises hereby
bargained and sold or ment mentioned or intended hereby so to be and every part
and parcel thereof with them and every of them appertances unto the said John
Neff and Jacob Neff their heirs and assigns forever and to and for no other use
intent and purpose whatsoever and the said Isiah Frost and Sarah his wife and
the said Thomas Wright and Elizabeth his wife and the said William Wright and
Susannah his wife and the said Elisha Combs and Annay his wife for themselves
their heirs executors and administrators do hereby covenant grant promise and
agree to and with the said John Neff and Jacob Neff, their heirs and executors
administrators and assigns that they the said Isiah Frost and Sarah his wife the
said Thomas Wright and Elizabeth his wife and the said William Wright and
Susannah his wife, and the said Elisha Combs and Annay his wife and their heirs
the said lots of land No. 3885, 3586, 3587, 3588, 3589 3590 and 3591 and
premises hereby granted bargained and sold in witness whereof the said Isiah
Frost and Sarah his wife, the said Thomas Wright and Elizabeth his wife and the
said William Wright and Susannah his wife and the said Elisha Combs and Annay
his wife have hereunto subscribed their names and affixed their seals the day
and year first herein before written.

THIS INDENTURE made this 28th day of Feb in
the year of our Lord 1853, between Thomas Wright and Elizabeth, his wife of
Allegany County in the State of Maryland of the first part, and James Lorimer
Graham of the city of New York in the State of New York, of the second part.
WITNESSETH that the said Thomas Wright and Elizabeth, his wife, for and in
consideration of the sum of $68,228.12 to the said Thomas Wright in hand paid by
the said James Lorimer Graham at and before the sealing and delivery of these
presents, the receipt whereof the said Thomas Wright doth hereby acknowledge,
have granted, bargained and sold and by these presents do grant, bargain and
sell, alien, enfeoff, release, convey and confirm unto the said James L. Graham
the several tracts, parts of tracts, lots, pieces or parcels of land lying and
being in Allegany County in the state of Maryland herein particularly mentioned
and described, that is to say, THE THREE SPRINGS granted by the State of
Maryland to Baker Johnson by patent bearing date on the 25th day of May 1789,
for 111 acres; (could be Frizzles) T?RIZZLE'S ADDITION granted by the State of
Maryland to John T?rizzle by patent bearing date upon the first day of April
1796 for 12½ acres; CHESTNUT GROVE granted by the state of Maryland to Henry
Wright by patent bearing date on the 18th of January 1817 for 30 3/4 acres;
SAFETY, granted by the State of Maryland to Thomas Wright by patent bearing date
on the 31st day of December, 1838, for 13 3/4 acres; STRIFE granted by the State
of Maryland to Thomas Wright, John Wright, William Wright, James Wright, Rachael
ARNOLD, Jane Rowen?, Eleanor Anderson, Samuel Wright, Emily Totten, Rachael
Totten, Henry Totten, Ann Totten, Indiana Totten, Sara Totten and Minerva Totten
by patent bearing date on the 12th of January 1842, except to much of the said
tract called STRIFE as is conveyed by the said Thomas Wright and wife to a
certain William HUMBERTSON by deed bearing date on the 7th of September 1849 and
recorded in Liber U.B.No 5-folios 527, 528, one of the land records of Allegany
County, containing 4 3/4 acres; the entire tract granted for 60 acres; all that
part of a tract of land called TUESDAY's WORK on GEORGES CREEK which was laid
off by Thomas Percy(?), trustee for the sale of the real estate of Henry
O'Neill, deceased, under a decree of Allegany County Court as a Court of Equity,
in a cause No. 300 on the docket of said court and designated as lot number 6 of
TUESDAY'S WORK ON GEORGES CREEK and which is particularly described in a deed
from the said Percy?, Trustee to the said Thomas Wright, bearing date on the
23rd day of February 1853, containing 71 acres - - Lots lying to the Westward of
Fort Cumberland usually called soldiers' lots numbered as follow - 3707, 3708,
3709, 3710, 3711, 3712, 3713 and 3961 granted by the State of Maryland for 50
acres each; ACCIDENT granted by the State of Maryland to Thomas Wright, by
patent bearing date on the 4th day February 1850 for 4 1/3 acres, except that
part of Lot 3711 conveyed by deed of Thomas Wright, William Wright and others to
Elisha Combs, Isiah Frost and Henry Koontz, recorded in Liber A.B.No 9(?)-folios
126, 127 of Allegany County: - together with all and singular the buildings,
improvements, ways, waters, water courses, rights, members, advantages and
appurtenances thereunto belonging or in any wise appertaining, and all the
estate, right, title and interest, at Law in Equity, of them the said Thomas
Wright and Elizabeth, his wife, of in and to the same.
TO HAVE AND TO
HOLD the aforesaid described tracts, parts of tracts, pieces or parcels of land
with the appurtenances thereunto belonging, unto the said James Lorimer Graham,
his heirs and assigns forever. - And the said Thomas Wright, for himself, his
heirs, executors and administrators, and for every of them doth covenant,
promise and agree to and with the said James Lorimer Graham, his heirs and
assigns, by these presents in manner and form following, that is to say, that he
the said Thomas Wright, his heirs and assigns, the tracts, parts of tracts,
lots, pieces or parcels of land and premises above described and herein
mentioned to be granted, bargained and sold, with the appurtenances, to the said
James Lorimer Graham, his heirs and assigns, shall and will warrant and forever
defend by these presents against all and all manner of incumberances, and
against the claims of all persons whomsoever.
IN TESTIMONY WHEREOF the
said Thomas Wright and Elizabeth, his wife, have hereunto subscribed their names
and affixed their seals on the day and year first herein written.
Signed, sealed and delivered in the presence of John White and J.B. Widener
State of Maryland, Allegany County, to wit: Be it remembered and it is
hereby certified that on this 28th day of February in the year before
subscribed, two Justices of the Peace of the State of Maryland in and for
Allegany County, personally appeared Thomas Wright and Elizabeth, his wife, they
being personally known to us to be the persons who are named and described as
and professing to be the parties to the aforegoing deeds or indentures, and do
severally acknowledge the said indenture or instrument of writing to be their
respective act and deed - the said Elizabeth having signed and sealed said
indenture before us out of the presence and hearing of her said husband.
"Whether she doth execute and acknowledge the same freely and voluntarily and
without being induced to do so by fear or threats of or in usage by her husband
or by fear of his displeasure" declareth and sayeth that she doth. - In
testimony whereof we hereunto subscribe our names on the day and year aforesaid.
The words "except that part of lot 3711 conveyed by deed of Thomas Wright,
William Wright and others to Elisha Combs, Isiah Frost and Henry Koontz,
recorded in Liber U.B. No A(?) Folio 126, 127 of Allegany County in 16th line of
third page before signing and sealing interlined?.____

made this 1st day of September, 1864 by Henry T. Weld and Harriet E. Weld, his
wife, of Allegany County in the State of Maryland.

consideration of $2154, the said Henry T. Weld and Harriet E. Weld his wife doth
grant unto C.M. Graham and Sarah Wright of said County and State, and their
heirs and assigns forever as tennants in common, all their right title and
interest in and to one undivided fourth part of a tract of land known and
distinguished by the name of MOUNT ETNA, lying and being in Allegany County and
state of Maryland contained within the following metes and bounds to wit:
BEGINNING at a bounded maple standing south 89½ perches from the end of the
first line of a lot number 684 and running thence West 200 perches to a pine
marked with 9 notches, south 360 perches to a spruce pine south 57º, East 28
perches to a pine, south 65º, east 12 perches, east 30 perches to a hickory,
south 18º, west 30 perches, south 65º, east 76 perches to a white oak, south
20º, east 20 perches to a maple, north 57º, east 176 perches to a white oak,
north 10º, west 64 perches, north 55º east 72 perches, north 51½º, west 40
perches, north 144 perches to lot number 791, west 106 perches, then by a
straight line to the beginning containing 718 acres in fee simple and the said
Henry T. Weld and Harriet E. Weld his wife, doth hereby covenant that they will
warrant generally the property hereby conveyed and that they will execute such
other and further assureances as may be requested.

Mariah Percy his wife of Allegany County and State of Maryland.
WITNESSETH that in consideration of $1436.00, we Douglas Percy and Maria E.
Percy do grant unto C.M. Graham and Sarah Wright of Allegany County and State
aforesaid and their heirs and assigns forever, as tennants in common, all their
right title and interest in and to one undivided fourth part of a tract of land
known and distinguished by the name of MOUNT ETNA lying and being in Allegany
County, State of Maryland and contained within the following metes and bounds,
to wit:
BEGINNING at a bounded maple standing south 89½ perches from the

Frederick County and State of Maryland.
WITNESSETH THAT in consideration
of the sum of $6,500.00 current money I Margaret R. Graham do grant unto C.M.
Graham and Sarah Wright and their heirs and assigns forever of Allegany County
and State of Maryland, tennants in common, all the following lots, pieces or
parcels of land being Military Lots lying to the westward of Fort Cumberland, in
Allegany County, State of Maryland:
Lot number 666; Lot number 669; Lot
number 670; Lot number 673; Lot number 631; Lot number 632; Lot number 635; Lot
number 636; Lot number 707; Lot number 708; Lot number 709; Lot number 640; Lot
number 630; containing in each lot of land 50 acres, in the whole 13 lots hereby
conveyed, 650 acres. And the said Margaret R. Graham doth hereby covenant that
she will warrant and defend Generally the lots or tracts of land hereby conveyed
and that she will execute such other and further assurances as may be requisite.

[Note that Johnston and Johnson are both used in this deed,
intermittently. I think this is actually Thomas Johnson, grandson of
Thomas Johnson, first governor of Maryland. Joshua Johnson did die about
1853. Joshua did own property in Western Maryland, west of Fort
Cumberland.]
AT THE REQUEST of Curtin M. Graham this deed
was recorded 8 Mar 1865.
THIS INDENTURE made this 21st day of February
1865 by Thomas Johnston and Juliana Johnston his wife of Allegany County
Maryland of the one part and Curtin M. Graham and Sarah Wright of said county
and state of the other part.
WITNESSETH that the said Thomas Johnson and
Juliana Johnson, his wife, in consideration of the sum of $3,000.00 do grant,
bargain and sell unto the said Curtin M. Graham and Sarah Wright all those four
lots or parcels of land lying and being in Allegany County in the State of
Maryland, known and distinguished as Lots Numbers 571, 572, 573, 574, of the
Military lots lying Westward of Fort Cumberland and which lots were surveyed for
the said Thomas I. Johnson by William I. Ross, executor of Joshua Johnston,
deceased.
TO HAVE AND TO HOLD the said premises unto the said Curtain M.
Graham and Sarah Wright, tennants in common, their heirs and assigns forever.
And the said Thomas Johnson and Julia Johnson his wife for themselves, their
heirs, executors and administrators do covenant promise and agree to and with
the said Curtin M. Graham and Sarah Wright, their heirs and assigns that they
the said Thomas Jonstone and Juliana Johnson his wife, shall and will warrant
and defend the premises above granted unto the said Curtin M. Graham and Sarah
Wright their heirs and assigns forever against the claims of all persons
whomsoever.
IN TESTIMONY thereof the said Thomas E. Johnson and Juliana
Johnson his wife have hereunto subscribed their names and affixed their seals on
the day and year first above written.
