Will Of George
A Moye - - Simpson County, KY
I Geo A Moye, of Simpson County, KY, being
of sound mind and disposing memory do make, ordain and establish this my last
will and testament.
1st I will that all of my debts and burial
expenses be paid out of any money, notes or other personal property being left
by me.
2nd If there shall be anything left of the money, notes or other personal
property, after the payment of my debts and burial expenses, I will and bequeath
it to my wife Sarah J Moye, in trust for the use and benefit of herself and my
children by her, and I authorize and request her to use it for her own benefit
and for the benefit of said children as she May deem best for the interest of
them all.
3rd I will and devise to my said wife during
her natural life the home tract of land on which we now reside, generally known
as the Daniel Smith land, containing about 110 acres, bounded on the north by
the lands of Clinton Smith, on the east by the Henderson land, on the south by
the Bradley and Lane land and on the west by the lands of J S Lane, giving her
the right to control and manage said tract of land, during her natural life and
to have and use and enjoy the rents and profits thereof.
4th I will that my sister-in-law, Harriet E
Smith, have the right to live no the home place above mentioned with my family
just as she has been living heretofore, as long as she remains single or
unmarried.
5th I will and devise the home tract of land
above mentioned, at the death of my said wife, to my second set of children,
being the children on my present wife, to be equally divided among them.
6th I will and devise what is known as the
Goodnight land to my first set of children, being the children of my first wife,
said land bounded on the north by the lands of Hack Lane and Fount Young, on the
east by the lands of James Lewis and Chas Doss, and on the south by the lands of
Gus Berry and on the west by the lands of Sam Hunt and Sally Turner, containing
about 107 acres.
7th If any of my children should die before
I do, leaving issue or children, then the interest of the one so dying is to go
and pass to his or her children or issue, but if any one of my children shall
die either before or after I do, without leaving children or issue, then the
interest of the one so dying is to go and pass to his full brothers and sisters
or their children, that is to the set to which he or she may have belonged, my
object being to keep the two tracts separate in their ownership, the owners of
one tract and their offspring to have no interest in the other tract.
The two tracts of land above mentioned are located in Simpson County, KY,
east of Drakes Creek and on the Franklin and Scottsville Road.
8th I nominate and appoint my wife to be my
executrix, to execute this will, and I request that she be not required to give
any bond or security as such.

G A Moye Signed and acknowledged in the presence of the undersigned as witnesses, J H Milliken, Wm Swan State of Kentucky, County of Simpson Sep. Term, Sep 20, 1897 - The forgoing instrument purporting to be the last Will and Testament of G A Moye Dec'd was produced and filed in open court and the issue was proven to be such by the oaths of Dr. J H Milliken and Wm Swan the two subscribing Witnesses hereto which will was duly admitted to probate and ordered to record as such, which is done accordingly.
