On
this 17th day of September 1832 personally appeared in open court before
Henry O'Brien a Circuit Judge of the Commonwealth of Kentucky of the 2and
judicial
district
at a court held in the courthouse in Cynthiana in the county of Harrison
and Commonwealth aforesaid John Whitaker, 79 years of age in May last and
a
citizen
of said county of Harrison who being duly sworn according to law doth on
his oath make the following declaration in order to obtain the benefit of
the
provisions
made by the Act of Congress passed June 7, 1832, That in 1776 he lived in
the state of Maryland in the county of Hartford about 40 miles
from
Baltimore,
that he was enrolled in the militia in a regiment commanded by Col. Jno..
Rodgers in a company commanded by Capt. Aquilla Hall, where Lieutenant
was
Saml. Griffith, that they received orders to hold themselves in readiness
in a minutes warning and under these orders __ or trained on Saturday,
that
sometime
in the fall of that year in conquence of an alarm or affright at Baltimore
the company to which he belonged were ordered to ___ and did ___
at
Hartford
Town then sometimes called Bush or Burk Town that ___ ____ Capt. Hall did
not command the company in service but that it was commanded by
the
Colonel
John Rodgers, Samuel Griffith acting as Lieutenant and James Giles as ____
and said John Whitaker as Sargeant; that they marched to Baltimore
and
continued
as long as then thought necessary and was discharged and returned home; the
whole term of this service as well as he could now
remember
continuing
about three weeks.
Said
Affiant further declares that in the early part of the next year there
was a call for a company of Light Infantry to continue in the service until
1st of December
following;
as well as he could recollect the call was from Washington upon Maryland
for such troops. The company was __ in Hartfort County. Captain
Holland

Captain Wm. Young, 1st. Lieut. Jno.. Carlisle, 2and Lieut. Robert Morgan
Ensign and said affiant 1st ____ Sargeant. He entered in the first part of
June but
did
not march until about the last of June, that said company marched first to
Philadelphia where they remain 10 or 12 days; thence to Perth Amboy
where
they
remained for perhaps 3 months; thence to Trenton and Reretan the place of
encampment where he continued until discharge which was the 1st day of
December
of
the same year. At this place said affiant stated that he say Genrl Washington
with his Army who were encamped upon the hill. Said affiant further states
that
soon
after ___ the next year there was a call for a militia from Hartfort to guard
against the approach of the amory; that Samuel Griffith then acted as
Captain
Jacob
Edward as Lieutenant and said affiant as 1st or orderly Sergeant, that they
were ordered to the mouth of Swain Creek where the company ___ in
the
service
of between 30-40 men continued several weeks; thence were ordered to Drews
Point 10 to 15 miles down the Bay where they continued several
weeks
longer
and were finally discharged at Drews Point 1st of November after a service
in the whole of their tour of about 3 months. Said affiant further states
that when
discharged
they were ordered ___ to continue in readiness for the service whensoever
they might be called upon. Said affiant further states that he continued
to
reside
in Hartford County, Maryland until about 1784; thence removed to York County,
Pennsylvania where he resided until 1789 or thereabouts; thence
removed
to
Washington County, Maryland where he continued until about 40 years of age
when he removed to Kentucky and resided in Bourbon County near Paris
until
upwards
of 20 years ago when he removed to Harrison County where he has resided ever
since and still continues reside and said affiant further states that he
has
no
documentary evidence and he knows of no person where testimony where he can
procure who can testify to the particulars of his
service.

John Whitaker hereby relinquishes every claim whatever to a pension or annuity
except the ___ and he declares that his name is not on the pension roll
of
any
agency in any state. Sworn to and subscribed the day and year
aforesaid.

John Hamilton, a clergyman residing in the town of Cynthiana and the county
of Harrison and Samuel Chadd residing in said county hereby certify that
we are
well
acquainted with Jno. Whitaker who has subscribed and sworn to the above
declaration that we believe him to be 70 years old and said Chadd who has
known
said
Whitaker near 40 years states he has all __ time been reputed and believed
in the neighborhood and said Hamilton and Chadd each state that he has
been
and
still is reputed a man of veracity and that they concur in the opinion that
said Whitaker has been a soldier of the revolution.

the said court do hereby declare their opinion after
The
amendment of John Whitaker to his declaration made the 17th of September
1832 in order to obtain the benefit of the Act of Congress passed June 7,
1832.
In
answer to the first interrogatory prescribed by the War Department - I state
that I was born in Harford County, Maryland on the 21st of May 1753. In answer
to the
second
interrogatory I state that my age is recorded in my family bible now in my
possession. In answer to the 3rd interrogatory, I state that I received no
discharge
at
the expiration of my first term of service, but was merely discharged by
a verbal order. At the end of my second term of service I received a discharge
but it has
been
long since lost. To the 4th interrogatory, I answer that I am known to the
Reverend John C. Hamilton and Samuel Chadd both residing in Harrison
County
State
of Kentucky, who have testified to my character for veracity and their belief
of my services as a soldier of the Revolution. And, I do further state that
by reason
of
old age ___ ___ of memory I cannot answer positively as to the precise length
of my service but according to the best of my recollection I served not less
than
the
periods mentioned below and in the following grades when I was enrolled in
the Regiment commanded by Col. John Rodgers. I was made a first Corporal
and
continued
in that grade for a few days but I cannot remember the exact length of time
but according to the best of my recollection I served in that grade at
least
one
week. I was made 2and Sergeant, the same company, and in that grade I served
until I was discharged and according to the best of my recollection I served
at
that
time in Col Rodgers Regiment at least three weeks. When I served in Captain
Holland's company of Light Infantry I served in the grade of first or duty
Sergeant
and
continued in the service at that grade for at least 3 months and for such
service I claim a pension.

Stephen B. Curran a Justice of the Peace for the county aforesaid do certify
that the foregoing amended declaration of John Whitaker was subscribed and
sworn
to
by said Whitaker before me on this 16th day October 1833 and I do also certify
that said Whitaker cannot from bodily infirmity attend the court of
Harrison
County.

that Stephen B. Curran who has signed the foregoing certificate is a Justice

the deposition of Ann Whitaker taken at her place of residence in Harrison
County, state of Kentucky on the 16th of October 1833. The despondent states
she
is
the wife of said John Whitaker who claims a pension for his service as a
soldier in the War of the Revolution. That she was married to said John Whitaker
in
Hartford
County, Maryland on the 28th of December 1776 as appears by the record thereof
in our family bible. That previous to our marriage we both resided in
said
county
of Hartfort about 25 miles apart. That a short time before our marriage said
John Whitaker informed me that he was going to the Army and afterwards
he
informed
me that he had performed a
