The Plaintiff George Eager by way of Amendment in
his original
Petition said that on the „__
day of February 1865 in the
County of Harlan and State of Kentucky the defendants
Chadwell
Nolan, John Green Farier, Silas Nance, Terry Ledington,
Stephen
Daniel, John Gross, Edmond Gross,
James B. Gross and Isaac
Callahan by force an arms in the night time the defendants
all
being blacked to resemble negroes, by force and arms seized took
and carried away about one thousand
dollars worth of bed
clothing- wearing clothing beds & etc. a bill containing
all the
items taken is filed here with marked (A) and made
part ______
said taking brings unlawfully wrongfully
and without legal
authority, and the property so taken being the property
of the
plaintiff.
The plaintiff further says that at the
time and place above,
refered to it being at the residence
of the plaintiffs. The
defendants by force and arms arrested
the plaintiff held in
close confinement for ____ hours
then put a rope around the
plaintiffs neck and took him out to a Peach tree,
and hung him
up by the neck, twice and, did there
abuse the person of the
plaintiff and greatly terrify the plaintiffs family, said arrest
and abuse being illegally and with legal authority.
The plaintiff further says that afterward on the day of 18__
Sept
the defendant Isaac Callahan departed
this life intestate
domicile in Harlan County, and
the _.___ term up the Harlan
County Court Polly Callahan was duly appointed and qualified
as
Administrator of said Isaac Callahan,
deed, a copy of said
appointment is filed herewith and made part hereof.
The premises considered the plaintiffs ask that Polly
Cailahan
be held responsible to plaintiff
as adminitrators of Isaac
Callahan, deed, for said wrongs and injuries complained
of and
upon final hearing the plaintiff
prays judgement for one
thousand dollars for the value of the property illegally
taken
and five thousand dollars for the wrong and injuries
inflicted
on the person of the plaintiff, he prays for all proper
relief.
