The last Will and testament of James Jarvis of Brown Township Ripley County

James Jarvis considering the uncertainty of this mortal life and being of such mind and memory blessed by almighty god for the same do make and publish this my last Will and Testament in manner and form following that is to say first. I give and beqweath to my beloved Wife Mariah B Jarvis all my Real and Personal Estate with the exceptions of the South west forty of the south East qwarter Sect [unreadable, ends with 8], Township 6, Range 12, which I give and beqweath to my Eldest son William Jarvis, his heirs and assigns forever, to my Daughter Zarilda I have gave the sum of One hundred and tewnty Dollars and to the balance of my children I beqweath to each the same amount that is to say One Hundred and tenty dollars to be paid to each of them in money of property at the age of viz. to be paid as they become of age my son Harvy Jarvis has received One hundred Dollars of his portion and lastly [unreadable] to all the Rest Residue and Remainder of my personal Estate goods and chattles of what Kind and nature soever. I give and beqweath the same to my Beloved wife Mariah Jarvis. I hereby appoint Thomas Basset and my son William Jarvis Executors of this my last Will and testament hereby revoking all former Wills by me made in Witness whereof I have hereunto set my hand and seal the 3rd day of September in the Year of my Lord One thousand Eight Hundred and Forty

Signed Sealed and delivered by the above named James Jarvis to be his Last Will and Testament in the presence of us who at his request and in his presence have subscribed our names as witnesses thereto.

Personally came before me the undersigned Clerk of Ripley County probate Court Thomas Spencer

One of the subscribing Witnesses to the foregoing last will and testament of James Jarvis Deceased and being duly sworn deposeth and saith that he saw James Jarvis the Testator sign seal and acknowledge the same to be his act and deed and that he in the presence of the testator and in the presence of the other sub-scribing Witnesses subscribe the same as a witness and that he verily believes the said Testator was at the time signing and sealing the same of sound mind and memory and further saith not. sworn to and subscribed this 22nd day of September 1841
