Will of William B. Dees, Bradford County, FL 1896

Bradford County    }    To the Hon Wm F. Malphurs." County Judge of said County,
                       The petition of L.B. Dees and W.T. Weeks, respectfully showeth


1st - That W.B. Dees, late of the County of bradford, and State of Florida, died on the Nineteenth day of October A.D. 1896, leaving his last Will and Testament, 


2nd - That said last Will and Testament, was, on the 26th day of October AD 1896 duly admitted to probate, and record in said County of Bradford, as the true last Will and Testament of the said W.B. Dees late of said Bradford County deceased


3rd - That your petitioner, L.B. Dees, is named therein as Executor thereof, and is now ready and willing to qualify, as such Executors, and they therefore pray that they may be qualified, according to law, as such Executors, and that Letters Testamentary therein be duly granted to them, and as in duty bound they will ever pray.

County of Bradford }   Before me Wm. F. Malphurs, County Judge in and for said County
                Personally appeared, E.J. Wainright, who being by me duly sworn says that he was personally present as a subscribing and attesting witness, with M.C. Levy and L.B. Rhodes, who were also present as other subscribing and attesting witnesses, and saw the testator W.B. Dees, subscribe his name to the instrument of writing hereto annexed as and for his last Will and Testament. And that the said W.B. Dees, did then and there, in the presence of said M.C. Levy and L.B. Rhodes and my self, publish and declare the same to be his last Will and Testament, That the said M.C. Levy and L.B. Rhodes as witnesses did then and there at the special request of said W.B. Dees, and in his presence and in the presence of each other, subscribe their names thereto, as attesting witnesses, and the said E.J. Wainright further swears, that he verily believes the said instrument of writing hereto, annexed, so subscribed, published, declared and attested as aforesaid to be the true Last Will and Testament of said testator, the said W.B. Dees.

County of Bradford  }    In the Name of God Amen. I William B. Dees, of the County of Bradford and the State of Florida, being of sound mind and memory, and being concious of the uncertainty of human life do hereby make this my last Will and Testament.


1st - I desire my Executors hereinafter named at my death, to pay out of my estate, all of my honest debts, and give me a decent burrial


2nd - I further give and devise to my beloved wife Nancy, all of the Real Estate of which I may die seized and possessed, to have and enjoy, to live upon and use as her own so long as she remains a widow and no longer.


3rd - I further give and bequeath unto my beloved wife Nancy, all of the personal Estate of which I may die possessed of, in my own right, to use and enjoy, also to live upon and dispose of her for her support, subject however to the same conditions and provisions as are set forth in the above second clause of this my last Will and Testament.


4th - Should my said wife Nancy after my decease intermarry with another person then in that event, I desire after she has so married, that all of my real and personal estate of which I may die seized and possessed, on the amount of the personal property, that may be on hand at that time, together with the Real estate, may be equally and fairly divided between my children, the heirs of my body begotten,


5th - I further devise that no more on the lands on which I naw live, in Bradford County may be clared for years to come, and no more of the timber to be used than is necessary to keep the Plantation in proper repairs, believing that the day is not verry far distant, when timber will become very valuable in this potion of the Country, and will inure largely to the benefit of my widow or children.


6th -  Should my wife Nancy outlive my self, and remain my widow until death, then I desire my children, the heirs of my body begotten, to take all my Estate real and personal, but should I have no children as aforesaid living at her death, nor grandchildren in that event I desire my estate to be equally divided between the children of my Brother Lenard B. Dees and my sister Sarah A. Conner, wife of William Connor share and share alike.


7th - Should my Children inherit on account of the failure of any of the conditions aforesaid in that event, I desire that the Real estate, and Cattle, may be kept together and not be disposed of, in any way, until my oldest Child may become of age or Marry.


8th -  I hereby appoint my Brother Lenard B. Dees, to be my lawful Executor to carry out this my last Will and Testament, hereby revoking all former Will and Codicils by me made. == 


In Testimony whereof I have hereunto my hand and seal, this the fifth day of March,A.D. eighteen hundred, and eighty three

Be it remembered that on this the fifth day of March, A.D. eighteen hundred, and eighty three, the above named William B. Dees signed the above instrument in our presence and declared the same to be his last Will and Testament, to which we subscribe our names as Witnesses at his request  }
