Will of Stephen A. Bailey, Lawtey, Bradford Co., FL 1899

I, Stephen A. Bailey of the County of Bradford and State of Florida, being of sound mind and disposing memory, but being mindful of the uncertainties of this life do make, publish and declare this instrument as and for my Last Will and Testament hereby revoking any and all wills by me at any time heretofore made.


I direct my Executor hereinafter named, to pay all my just debts and funeral expenses as soon after my decease as can be done, without inconvenience to him or detriment to my estate. I give, devise and bequeath unto my friend Joseph Crawshaw, Jr., all of the household goods and effects, including my cabinets of shells and curiosities situated in the home where we now reside, and I request that they be distributed in accordance with a certain memorandum which will be found among my papers.


I give devise and bequeath unto my friend Joseph Crawshaw Jr. of the County of Bradford and State of Florida all the rest and residue of my property of every description, real, personal or mixed or wherever situate, of which I am now seized and possessed or which I may hereafter acquire, to have and to hold the same In Trust for the following uses and purposes to wit.


First - To give to my beloved wife, Catherine A. Bailey the net income, rents, issues and profits of my estate, during the term of her natural life, and should the said income at any time be insufficient to properly care for and maintain her then upon her request in writing the said Joseph Crawshaw Jr., hereafter termed Executor, shall pay to her such part of the principal of my estate, as he may deem necessary and he is hereby authorized to sell and convey either at public or private sale, without the order of any Court, giving to said purchaser or purchasers good and sufficient deeds therefor, any and all lands and securities owned by my estate as he may deem necessary to fully execute the trust herein reposed.  Said payment to be made quarterly upon her requisition in writing. Upon the death of the said Catherine A. Bailey, the said Executor shall.


First.  Pay to Mrs. Rosella A Gates, Schenectady, Schenectady County, New York, One Thousand Dollars, to have and to hold the same to her and her heirs forever, in fee simple. 


All the rest and residue of my estate that may remain after the foregoing bequests have been paid, I desire and direct my Executor to convert into money

as soon as can be done without detriment to my estate and pay the same to Alonzo B. Walling Mrs. Jessie M. Dye and Lelia Walling all of the city Utica, Oneida County, New York, share and share alike each to receive a one-third part of the said remaining part of my estate.


In the event of the death of the said Alonzo B. Walling prior to the payment of said bequest, then the part or share coming to him shall go to his wife, Bessie Walling if living and if she be dead then the said part or share shall go to Mrs Mrs Jessie M. Dye and Lelia Walling, share and share alike.  In the event of the death of either the said Jessie M. Dye or Lelia Walling prior to the payment of the said bequests or any of them, leaving no child or children living then the said parts or shares above mentioned shall go to the survivor or survivors of them but if they or either of them be dead leaving direct heirs, then the share coming to them respectively shall go to said heirs in fee.


I nominate, constitute and appoint Joseph Crawshaw, Jr., of the County of Bradford and the State of Florida the Executor of this my last Will and Testament, and I desire that no bonds or other security be required to enable him to qualify or act as such Executor.
That he shall have full power and authority to take charge of and manage my estate, selling or exchanging the property or securities and re-investing the money in other property or securities, as often as he may deem advisable for the best interests of my estate.


That the foregoing legacies shall be paid to the respective parties to whom they are bequeathed upon their request in writing, Provided however, That should the said Executor not deem it advisable to best subserve the interests of said estate and the trust herein reposed to immediately pay said legacies and close said estate then he shall have such time as he may deem necessary to pay said legacies and close said estate, not exceeding five years from the date of their request for the payment of the same in writing.


In witness whereof I have hereunto set my hand and affixed my seal, at Lawtey, Bradford County Florida this 22nd day of May 1896.

The said Stephen A. Bailey, at Lawtey, Florida on said 22nd day of May A.D. 1896, did in our presence, sign, seal, publish and declare the foregoing instrument as and for his last will and testament, and we at his request and in his presence and in the presence of each other have hereto subscribed our names as witnesses.

                                  On this day personally appeared before me Stephen A. Bailey to me well known as the person described in and who executed the foregoing Will and Testament and acknowledged that he executed the same for the purposed therein expressed. 
In Witness whereof I have hereunto affixed my hand and seal this twenty second day of May A.D. 1896.

                               Be it known that on this the 11th day of October A.D. 1899. before me a County judge in & for the County of Bradford, State of Florida exercising Probate jurisdiction for the County and State aforesaid .


Personally came Lewis W. Sayles one of the subscribing witnesses to the last Will and Testament of Stephen A. Bailey deceased late of said County and State.


Who being duly sworn says that the said Testator therein named signed published and declared the same as and for his last Will and Testament and at the same time of the doing thereof he was of sound and disposing mind and memory and understanding to the best of his knowledge and belief, and he further swears he at the same time saw Joseph P. McCully and Erastus G Hill sign their names as subscribing witnesses to said last will and testament at the request of the Testator and in is presence and in the presence of each other.
