Will of John Hale, Bradford County, FL 1903

In the Name of God. Amen. I John Hale of the County of Bradford and the State of Florida, being of sound mind and memory blessed be Almighty God, for the same do make and publish this my last Will and Testament.


I     It is my will and desire that all my just debts and funeral expenses be paid


II    It is my will and desire that all my estate both real and personal which I may die seized of which may be mine at my death shall be sold and equally divided between my beloved wife Harriet E. Hale and my beloved son Bishop Duncan Hale that is to say share and share alike of the proceeds of my entire estate both real and personal.


III    It is my will and desire that my beloved wife Harriet E. Hale be appointed as Guardian by the Judge of Probate of Bradford County Florida, who shall take charge of my beloved son Bishop Duncan Hale share or half interest in said estate and to hold the same as such Guardian make returns as the law provides in cases of Guardianship until my beloved son Bishop Duncan Hale becomes of age and when he becomes of age to turn over to him his part or share which may be due.


4     It is my will and desire that the two notes that I hold against my beloved Son M.M. Hale be given to him at my death as his legacy in my estate and that he shall have no further interest in my estate


5     I give and bequeath to my beloved Daughter Margaret E Fielding the sum of Five Dollars which amount my beloved wife shall pay at my death and that she shall have no further interest whatever in my estate


6     I give and bequeath to my beloved Daughter Jane L Newsome wife of W.S. Newsom the note which I hold against W S Newsome her husband which my beloved wife Harriet E. Hale will turn over to her at my death and that my beloved Daughter Jane L Newsome shall have no further interest whatever in my estate

7     I do nominate and appoint my beloved wife Harriet E Hale to be the sole executrix of this my last Will and Testament. In witness and testimony whereof I hereunto set my hand and seal and publish and declare and decree this to be my last Will and Testament. Hereby revoling all former Wills which may have been made in presence of the Witnesses named below this thirteen day of February in the year of our Lord ninteen hundred and three

Signed sealed and published by the said John Hale as on for his last will and testament in the presence of us who at his request and in his presence and in the presence of each other have subscribed our names as witness hereto.

County Judge in and for said County personally appeared M.L. McKinney who being duly sworn says that he was personally present as subscribing and attesting witness with W.G.Ball, T.P. Fowler & F.P. Odom who were also present as subscribing and attesting witnesses and saw the testator John Hale subscribe his name to the instrument of writing hereto annexed as and for his last Will and Testament and that the said John Hale did then and there in the presence of the said W.G. Ball, T.P. Fowler F.P.

Odom and affiant publish and declare the same to be his last will and testament. That the said W.G. Ball T.P. Fowler F P Odom and M.L. McKinney Witnesses did then and there at the personal request of the said John Hale and in his presence and in the presence of each other subscribe their names thereto as attesting witnesses and the said M.L. McKinney further swears that he verily believes the said instrument of writing hereto annexed was subscribed published and declared and attested as aforesaid to be the true last Will and Testament of said testator the said John Hale.
