Will of David Donley, Bradford County, FL 1892

In the name of God Amen, I David Donley, being of sound mind and memory, and being now over seventy years of age, and realizing the uncertainty of this life. Do hereby make ordain declare, and publish this my last Will and Testament, hereby revoking all other or former Wills or Codicils by me made.


1st - I desire my Executor herein after names after my death, to pay out of my personal property, all of my just debts, including my funeral expenses.


2nd - I hereby give and bequeath unto my beloved wife Mary Donley all of my personal property, to be used by her for the raising maintaining and educating of my two children, Washington and Flosy Mabell who are my children by my present wife and all other children which she may have begotten by me, in the future, consisting of money cattle, hogs horses and every other species, or kind of personal property of which I may die seized and possessed.


3rd - I give and devise unto my said wife and to her children by me begotten, my place and Plantation on which I reside in Bradford County State of Florida.  Consisting of about Two hundred and Twenty acres, on which I desire my wife to remain on said property use the same for her maintenance and for the care maintenance of my Children by her begotten. But should my said wife after my death and before my said children by her begotten shall reach the age of Twenty one years Marry again in that event I desire that said real estate above mentioned may be by my Executor hereinafter named divided equitably and equally between my said wife and her said children share and share alike. I further desire that should my said wife marry again as set forth above, that also all the personal property that may be on the place should likewise be divided between her and said children by my said Executor share and share alike. The forty acres which I own in Section Twelve (12) Township eight south, of Range Twenty Two east, containing forty acres, more or less, situate in Bradford County Florida. I desire my Executor hereinafter named, to sell the same either privately or publicly as he may think best and on such terms as he thinks best, and execute a Deed thereto, and use the proceeds for the use and benefit of my wife and her said children by me begotten, always paying himself out of any proceeds that may come into his hands, for his legitimate rendered as my Executor.


4th - To my Children by my former wife (to wit) my son Axom Donely and David Donley, My Daughter Rebecca Mitchell, wife of Toney Mitchell, Mary Speed '' wife of James Speed, Emily Bryand wife of Lewis Bryand I give bequeath and devise nothing more having already given to them as much as I feel able to give them and desire that the should have.


5th - I hereby nominate constitute and appoint my esteemed friend and neighbor Jonathan S. Griner My Executor of this my last

The above and foregoing instrument was made signed and acknowledged by the testator David Donley and so published and declared by him, on the date thereto mentioned to be his last Will and Testament, and was signed by him by making his mark in the presence of each of us, and by each of us at his request and his presence, and in the presence of each other ' ' Subscribing our names as witnesses thereto the same being first read to him
