The Right Honorable Thomas Lord Fairfax, Baron of Cameron in that part of Great
Britain calld (sic) Scotland, Proprietor of the Northern Neck in Virginia,
To all whom this present writing shall come Greeting, Whereas Henry Stoneham
Junr. of the County of Lancaster upon his Suggestion of a certain quantity of
waste Land belonging to me in the County of Lancaster which has not been yet
Granted, did on the second Day of September last Obtain a Warrant from my Office
for laying out the same And having Returnd (sic) a Survey thereof under the Hand
of Mr. James Thomas Surveyor of the County of Westmoreland, Know Ye therefore
that for and in consideration if the Compostition to Me paid and the Anual (sic)
Rent hereafter Reservd (sic) I have given granted and Confirmd (sic) And by
these presents do give grant and confirm unto the sd Henry Stoneham Junr all
that Quantity of waste land which is situate lying and being in the County
aforesaid and bounded according to the said Survey as following viz. Beginning
at a marked Maple standing by two Elm Trees close on the South Side of the main
Branch of Maratico Mill Dam in the Line of the Land of Mr. Secretary Carter and
Extending there along the sd Carter's line South 45(degrees) 30' East 204 Poles
to two Red Oak Saplings marked in a Roam of a Hicory corner Tree corner to the
Secretary's Land that was Bushs formerly and the Land of Thomas Young, Thence
along the sd Land that was Bush's North East 49 Poles to a forked Birch and Elm
Tree standing by the side of a small Branch dividing this land and the Land of
the Heirs of William Norris deceased, thence down the sd Branch and binding with
the Land of the sd Norris North 5 (degrees) East 60 Poles to the North thereof,
thence down the first mentioned Main Branch the several Courses and Meandors
(sic) thereof and binding with the Land of Davenport N 43 (deg) Wst 22 Poles N
83 (deg) Wt 11 Poles S 59 (deg) Wst 8 POles S 88 Wt 12 Poles S 48 Nst 6 Poles S
77 (deg) Nst 16 Po. N 59(deg)Net 38 poles to the Beginning containing in
Quantity Sixty seven Acres of Land, Together with the Rights, Members and
Appurtenances thereunto belonging, Royal Mines Excepted, and the full third Part
of all Lead, Copper, Tinn (sic), Coals, Iron Mines and Iron Ore that shall be
found thereon, to have and to hold the sixty seven Acres of Land together with
all Rights, Proffits (sic) and Benefits to the same belonging or in any
appertaining (sic) Except before Excepted to him the sd. Henry Stoneham his
Heirs and Assigns for Ever He the sd. Henry Stoneham his Heirs and Assigns
therefore yielding and paying to Me my Heirs and Assigns or to the certain
Attorney or Attorneys of Me the sd Proprietor Or to the certain Attorney or
Attorneys of my Heirs and Assigns. Proprietors of the sd. Northern Neck Yearly
and Every Year on the Feast of St. Michael the Arch Angel the Fee Rent of One
Shilling sterling Money for every Fifty Acres of Land hereby Granted. Provided
that the sd Henry Stoneham his Heirs and Assigns shall not pay the aforesaid
Rent so that the same or any part thereof shall be behind or unpaid by the space
of five whole years after the same shall become one of lawfully commended that
then it shall and may be lawful for Me, my Heirs and Assigns certain Attorney or
Agents into the above Granted Premises to Reenter and hold the same so as if
this Grant had never been payed (sic). Given in my Office in Westmoreland County
with my said Proprietary under my Hand and Seal Dated the twenty first Day of
October in the tenth year of the Reign of our Sovereign Lord George of Great
Britain, France and Ireland King Defender of the Faith Ann. Dni. One Thousand
Seven hundred and Thirty Six.
