Affidavit dated June 20, 1906, Leon Co., TX Filed August 16, 1906, Vol. 20/395: To The Public. We, the surviving brothers of Lucius and Lovel E. Hibbard, who volunteered under Sam Houston at Cincinnati, Ohio, and came with him to fight for the freedom of Texas, and who were Houstons' Musicians during the Mexican War, and who played the Generals Favorite March that won the Battle of San Jacinto. We followed them to Texas and settled in old Brazoria, where they both came homesick and died soon after. We know they died between the years of 1838 and 1842. It has been claimed that Lucius Hibbard had sold 1/3 of a league of land to a Mr. Bennett, who was his friend, but Mr. Bennett had gone to the Land Commissioner and got a patent for the 1/3 of a league of land that was set apart for Lucius Hibbard in the year 1838, was known to be in Robertson County, known now to be the land in Leon County, and our brother did not sell or convey his land to any one, and after his death, Mr. Bennett got the patent in 1845, and the patent was gotten in Lucius Hibbard's name, he having died a long time before the issuing of this patent, and we, the surviving brothers of Lucius and Lovel E. Hibbard, have sold to T. D. Hennessy our right title and claim to 1/3 of a league of land in Leon County and 640 acres in Leon and Madison Counties, and this 640 acres, lying on Cobbs Creek, was the part that was set aside for Lovel E. Hibbard in 1849. So we will defend the said T. D. Hennessy in any and all claims that may come up against him. Witness our hands this the 20th day of June AD 1906. L. Hibbard, Levi Hibbard, by his mark, X. Sworn and subscribed before me, a Notary Public, in and for Ft. Bend Co. TX, T T Dew, Notary Public, June 20th 1906.

Levi Hibbard died on 15 Oct 1910 at Grimes Co., TX, at age 81. He was buried at Camp Cemetery, near, Anderson, Grimes Co., TX.
