CITATION BY PUBLICATION

     THE STATE OF TEXAS : - To the Sheriff or any Constable of Falls County-GREETING:
     YOU ARE HEREBY COMMANDED
That by making publication of this Citation in some newspaper published in the County of Falls, once in each week for four consecutive weeks, previous to the return day hereof, you summon S. E. Spivey, whose residence is unknown, to be and appear before the Justice Court of Precinct No. 5 Falls County, Texas, at a regular term thereof, to be holden at my office in the city of Chilton on the second Saturday in June A D. 1904, at 10 o'clock A. M., it being the 11th day of June A. D 1904, then and there to answer the suit of G. W. Bowman filed in said Court on the 22nd day of Feb. A. D. 1904, against S. E. Spivey for for the sum of Thirty-Two DOLLARS, besides interest, costs and attorney's fees, instituted upon a certain promisary Note for $80 dated the 23rd 1901, due Oct. the 1st 1902; with interest at the rate of 10 per cent from date until paid, and 10 per cent as attorney fees, if placed in the hands of an attorney, or collected by law. Credit on note $47.91 also interest paid to Dec. the 24th 1903 -$16. Balance due and unpaid $32. Also for foreclosure of Mortgage lien upon. One Black Mule, about 14 years old, if any brands not remembered known as the J. Z. Chaney mule, and further known as one of the B. V. Smith mules. A copy of said note now on tile in this office. File No. of suit 162.
     HEREIN FAIL NOT, But have you before said Court this writ, with your return thereon, showing how you have executed the same, at the June Term, A. D 1904.
     GIVEN UNDER MY HAND OFFICIALLY in the Town of Chilton, Texas this 16th day of May A. D. 1904.
