LAST WILL AND TESTAMENT OF MICHAEL FITZGERALD. DECEASED.
I, Michael Fitzgerald, of Newport Campbell County, Kentucky, being of sound mind and under no restraint whatever, make and declare the following to be my last Will and Testament.
1. 1. It is my Will that out of estate all my just debts be paid by my executor.
2. 2. Whereas I borrowed from Martin Shannon the sum of five hundred dollars, giving as surety therefor a mortgage on lot 139 in Parkhurst’s Subdivision in the City of Newport, it is my Will that said sum be repaid to Martin Shannon and that the same be taken from the real estate hereinafter devised to my beloved wife, Elizabeth Fitzgerald.
3. 3. All of my estate whether real or personal I give, devise and bequeath to my beloved wife, Elizabeth Fitzgerald, to have and to hold the same absolutely, to herself and to her heirs forever, except Lot 139 Parkhursts Subdivision which by Father’s Will goes to Mary Ann Shannon, my sister.
4. 4. I hereby nominate and appoint as executor of this my last Will and Testament, Martin Shannon, and request the Court to require no bond of him as such executor, and I further request that no inventory of my estate be had.
Given under my hand this 30th day of October 1908.
