LAST WILL AND TESTAMENT OF FRANCES BENDEL.

KNOW ALL MEN BY THESE PRESENTS: That I, Frances Bendel, being of sound mind and disposing memory, do hereby make, publish and declare the following to be my last will and testament and hereby revoke all other wills by me at any time made.

First.  I direct the payment of all my just debts and funeral expenses.

Second.  I devise and bequeath all my real and personal estate to my husband, William Bendel, to have and to hold during his natural life with full power to sell or mortgage the same if he finds it necessary to do so. 

Third.  After the death of my said husband, I devise and bequeath the remainder of my estate to Louis Diesman in trust for my grandchildren Josephine Bendel and Aloysius Bendel.  The said trustee is to hold said property and all the income and profits thereof until said grandchildren become twenty-one years of age, when he shall divide said property equally between said grandchildren and shall make deeds for said real estate to them;  said trustee shall care for said property, pay the taxes and make the necessary repairs thereon and if at any time during the minority of said grandchildren it should become necessary or advisable or to the best interest of said grandchildren, said trustee is empowered and authorized to sell the real property herein devised at such price as he may deem right and proper and to re-invest the proceeds either in other real estate or good paying securities to be held by him under the same trust.  Said trustee is empowered to make any deeds that may be necessary to carry out the provisions of this will.

Fourth.  I request the proper court to require no bond from the Trustee Louis Diesman for the faithful execution of his trust.

Fifth.  I hereby nominate and appoint my husband William Bendel as executor of this my last will and testament and request the proper court to require no bond for the faithful execution of the same and that no appraisement or inventory be made of my estate.

The foregoing last Will and Testament of Frances Bendel, decd. Was this day produced in open Court, filed, proven, established and ordered to record as the last Will and Testament of said decedent.
