LAST WILL AND TESTAMENT OF CALEB IVES DECEASED

 

I, Caleb Ives of Campbell County, Kentucky, now makes this my last Will and Testament. 

Item one.  After the payment of my debts and other charges on my estate out of my personalty, I give the sum of sixteen thousand $16,000.00 dollars to my friend, W.W. Southgate of Campbell County, Kentucky, and to my daughter Mary Ives Duhme, as trustees for my wife, Mary Elizabeth Ives, in case of the death of either of said trustees before the determination of the trust, I desire that Edward K. Taliaferro shall be appointed trustee as the successor of such decendent.

I direct that the said trustees, and the successor in said trust, shall invent and re-invest the said trust fund in a safe manner, having more regard for the security than for the rate of interest, and shall pay the net income derived there to my wife, Mary Elizabeth Ives, quarterly, so long as she remains single and upon her re-marriage, or her death, the said trustees shall pay the trust fund so held by them to my son’s, Franklin Ives and Marvin Allen Ives, in equal shares, or their heirs per sterpes, in termination of said trust.

Item two.  I have heretofore deeded to my wife, Mary Elizabeth Ives, the farm and residence where I now live, being eighteen 18 acres, more or less, in the Highlands on the Dayton Pike, Campbell County, Kentucky, which I bought of Kate Walker Cranshaw, and in confirmation of that gift I now give and devise to her, her heirs and assigns, that real estate.

There is said to be, as against this property, a mortgage of five hundred $500.00 dollars, which however, has been fully paid and should be satisfied of record without further payment, but in order that my wife may receive this property free and clear of all incumbrance, I direct that any payment which may be required to secure the satisfaction of this mortgage, shall be made out of my personalty, prior to the payment of the legacies named herein, as if this was one of my debts.

Item three.  I give and bequeath to my wife, Mary Elizabeth Ives, all the personal property of every kind in my residence and on my farm in Campbell County, Kentucky, including household goods, books, pictures, silverware, jewelry, wearing apparel, horses and carriages, cows and other stock, farming implements, crops and all other personalty there located, except the family pictures and the rosewood set of Parlor furniture. 

Item four.  The provision which I have made for my wife in the Will shall be in full of her dower rights in my estate.

Item five.  I give to the trustees or Directors of Elmwood Cemetery of Detroit, Michigan, and their successors, the sum of two hundred and fifty $250.00 dollars in trust, to invest the same according to the rules of said Cemetery, and to devote the income to the care of the lot which stands in my name in said Cemetery.

Item six.  I give and bequeath to my daughter, Mary Ives Duhme, the sum of three thousand $3000 dollars, to be paid to her so soon as may be after my death, and to provide for this payment I direct that so much of the stock from my farm in Union County, Ohio, as may be necessary, shall be sold.

Item seven. I give to my four children, Jennie Maria Campbell, Mary Ives Duhme, Franklin Ives and Marvin Allen Ives, the family pictures and the set of Rose Wood furniture which are now in my residence on the farm in Campbell County, Kentucky, the same to be divided between them as they may agree.

Item eight.  I give, devise, and bequeath to me two daughters, Jennie Maria Campbell and Mary Ives Duhme, in equal shares, and to their heirs and assigns forever, my farm in Washington Township Union County, Ohio, and all of the stock, farming implements and other property situated thereon, after the sale of what stock may be necessary in order to provide for the legacy of three thousand $3000.00 dollars to my daughter Mary Ives Duhme, together with all the rest and residue of my estate of every kind and personalty, and where ever situated, the same to be divided between my said daughters equally, or their heirs per sterpes, and I request that the personal property may be distributed to them in kind if they so desire.

Item nine.  I nominate W.W. Southgate of Campbell County, Kentucky, and my daughter, Mary Ives Duhme, to be the executor and executrix of my Will, and I desire no Bond be required of them as such executor and executrix, or of them, or Edward K. Taliaferro, as trustees of the trust herein created for my wife I request that no inventory shall be required of my household good and personal effects and other personalty, given to my wife in this Will.

In Testimony whereof I have hereunto set my hand this 30th day of July 1908.

Signed in our presence by Caleb Ives, the testator, who acknowledged and declared to us the foregoing to be his last Will, and at his request we have hereto subscribed our names as attesting witnesses in his presence, and in the presence of each other, on the above written day.

The foregoing last Will and Testament of Caleb Ives deceased was this day produced in open court, filed, proven established and ordered to record as the last Will and Testament of said decedent.
