Newport Court Order Book A, page 21, 3 November 1795

Washington Berry, Nathan Kelly, James Taylor and Stephen Lyon are appointed Commissioners to let the building of a Stone Jail for this County 26X30 feet from cut to cut to be erected on the Publick Square, the wall to be 3 feet thick, to be two stories high and each story to be 9 feet, the building to be furnished at the discretion of the said Commissioners and to be further ordered that the said Commissioners do collect the money voluntarily subscribed for the purpose of erecting publick buildings and to proceed against the delinquents agreeable to Law and they are further authorized to call on the Sheriff occasionally for the balance of 350 pounds which cannot be raised from said subscriptions.

Indenture made 5 September 1796 between Thomas Kennedy, Washington Berry, Henry Brasher, and Nathan Kelly, Gentlemen Trustees of the town of Newport of the one part and James Smith of Campbell County of the other part.  Trustees for and in consideration of the sum of 5 pounds paid to James Taylor proprietor of the town of Newport sell in lot No. 17 in the Town of Newport lying on the Esplanade.

Indenture made 16 Aug 1798 between Washington Berry, Henry Brasher, Charles Morgan, and Archibald Brown Gentlemen Trustees of the Town of Newport of one part and James Smith of Campbell County of the other part.  Trustees for and in consideration of the sum of #135 paid to James Taylor proprietor of the Town of Newport sell four lots in the Town of Newport and known in the plan of said Town by Nos. 91, 99, 100 and 103.

Newport Court 24 March 1802

At a Court held for King George County the 7th day of February 1793.  This indenture between Cathe Schropshire of the one part and William Gregory and Caroline his wife of the second part, and Washington Berry of the third part was presented into Court and proved by the oath of Lawrence Berry, one of the witnesses thereto and Ordered to be Certified and at another Court held for the same County the 7th day of Mar 1793, was further proved by the oath of John Gravatt and Wm I Jett, and together with the Commission annexed and Certicate of the execution thereof are Ordered to be Recorded and is truly recorded.  In testimony wheof I have hereunto set my hand and affixed the publick seal of my office the 18th day of March 1793. James and Keturah Taylor to Washington Berry sold for 500 pounds including the following- "now is it to be in effect that part of land sold by William Kennedy in his lifetime to Thomas Johnson which fell within the said James and Keturah’s part on the division with the said William as locator."

Indenture made 23 March 1830 between James T Berry of the County of Campbell of the
 one part and Richard Southgate of the same county of the other part. James T in
consideration of the sum of $910 sells all that certain tract of land situated in the County of Campbell on the water of the Ohio river containing 128 acres 3 roods and 35 poles being
 lot No. 9 of the land allotted to the children and heirs of Washington Berry, deceased.

Deed Book 7, page 169 Recorded 19 November 1850

Whereas James T Berry did by deed dated 23 March 1830 convey to Richard Southgate,
 a certain tract of land in the County of Campbell on the waters of the Ohio River containing  128 acres, 3 roods and 35 poles for the sum of $920. Whereas the deed being recorded  but the clerk failed to subscribe his name on the record to said certificate and whereas the original deed has been lost or mislaid and whereas the said James T Berry is desirous to secure to the said Richard the title to said land the same lot of land conveyed by Commissioners to James T Berry as one of the children of Washington Berry, deceased.
