Newport Cemetery Minutes and Deed

Newport Minute Book 2, page 2, 31 March 1834, Ordinance 119

Be it ordained by the Board of Mayor and Trustees of the Town of Newport that from and after the passage of this ordinance no person shall be entered in the public burying ground adjoining this Town without permission first had from at least four Trustees of said Town except it shall be when the person about to be buried Shall have died in said Town and each and every person who shall in any way aid or assist in burying a deceased person in said ground Contrary to the provisions of this ordinance shall upon conviction thereof before the Mayor pay a fine of not less than $10 for each offence with cost of suit.

Newport Minute Book 2, page 293, 1 July 1847

The Committee on Public Cemetery reported in favor of purchasing from Samuel Winston on a lot of land situated about 2 miles from the Town on the State road supposed to Contain about 20 Acres for the sum of $1500 to be paid for by the 1st day of November 1849 with interest on the same.  Whereas On Motion to acceed to the proposition of Mr. Winston and to adopt the report.  The yeas and nays were called which stood as follows:

On Motion of Mr. Taylor Messrs. McArthur, Hayman and Shaler were appointed a Committee to direct in the arrangement and business pertaining to the Public Cemetery.
Page 295-8 July 1847, Wm B Ross added to the Committee on public cemetery.
Page 310-September 25, 1847, On Motion of Mr. Miller it was resolved that the Contract with Samuel Winston for the purchase of a lot of ground on the State Road back of Newport for a Cemetery be now and the same is herby satisfied and Confirmed, whereupon the said Samuel Winston tendered to the board of Trustees a deed for said Lot of ground which was received and approved.

On motion of the same The President and Treasurer were instructed to fill up and execute to the said Samuel Winston 15 one hundred dollar Bonds of the Town of Newport dated July 1st and payable Nov 1st 1849, with interest from date payable semi annually being the amount paid for said tract of land and that the President of the Board was authorized to sign and execute to the said Samuel Winston a mortgage on said premises to secure the payment of the Bonds aforesaid, and the Bond and mortgage were accordingly executed in presence of the Board and It was agreed that the said Winston should have his choice of a lot of the usual size in said cemetery free of charge when laid out into lots.

On motion of Mr. Hayman, It was resolved that a Committee be appointed to take charge of the Cemetery ground and have the same of a portion thereof laid off into convenient lots and walks and to make such other arrangements as they may deem expedient in order to carry out the object and intention of the Board in said purchases.  Whereupon R D Hayman, F A Miller, Jno. Doxon, Wm B Ross and Dr. N B Shaler were appointed said committee.

Newport Minute Book 2, page 337, 20 April 1848

On motion ordered that a sale of the Cemetery take place on Monday the first day of May next at 3 o'clock P M provided it is the requirement of the law and that the Committee on Cemetery be authorized to make arrangements for the same.

Page 338-the following motion was offered by Mr. Hayman viz That a building be erected on the cemetery lot and of the following dimentions Said building shall consist of two rooms 16 by 16 feet each and one story in hight and further that said house not exceed $300 in cost.

Newport Minute Book 2, page 341, 11 May 1848

On Motion of Mr. Gilman the proposition of Mr. Ladd for the building of a house on the Cemetery ground was received and on motion.  The proposition with the plan and specification were referred to the Committee on the Cemetery to report at the next meeting a contract for the consideration of the Board.

Newport Cemetery Deed Book 4, page 373, recorded 2 Nov 1866

Know all men by these presents that Whereas by an act of the General Assembly of the Commonwealth of Kentucky, approved February 5th 1866 all Persons owning lots in the Newport Cemetery, Campbell County and their successors, one constituted a body Corporate with all the powers incident to a corporation under the name of the Newport Cemetery and by section (V) of said act the title of all the lands heretofore purchased by the City of Newport for Cemetery purposes was vested in the Newport Company the City of Newport consenting.

Now therefore in order that the title to said lands may be more fully vested in the Newport Cemetery Company, know all men that the City of Newport in consideration of the premises and in further consideration of one dollar to them paid by the Newport Cemetery Company, the receipt whereof is hereby acknowledged do hereby bargain, sell and convey to the said Newport Cemetery Company and their successors forever the following Real Estate to wit:

All the lands known as the "Newport Cemetery" situated in Campbell County and State of Kentucky being and lying on the Newport and Alexandria turnpike Road about 2 miles from said city.  The description of said lands appearing more fully in two deeds, one from Samuel Winston and wife to the town of Newport and recorded in Deed Book S, page 39 and the other from Heinrich Immegart to the City of Newport in Deed Book ___ page ___; both deeds of record in the records of Alexandria, Kentucky, etc.
